Biking into work this morning about 6.15am, heading down Abbotts Way towards Remuera.
I noticed a hell of a lot of joggers who decided to run on the road rather than the pavement. No problem with that as such (apart from the couple with the his ‘n’ hers backpacks who ran out in front of me) but the main gripe is that not one of these people had any kind of reflective clothing or something to show that they were there.
For those of you who know Abbotts Way, it is quite dark in places and although I was keeping my eyes peeled, there were a few who just appeared.
Now, my question is where would you stand if the worst happened and someone got hit? Bikers are always told that we cannot be seen and therefore the accidents are construed as our fault, but what if it’s a jogger?
Just wondered if you guys had any thoughts or experiences with this….

I would say if you hit any pedestrian and kill them you would be charged with vehiclular manslaughter. I don't see how you could avoid a man-slaughter charge, since someone was killed by accident.
Based on that reasoning, I would also say you would be charged with careless driving (or dangerous!) if you just injured them as well.

Sureley the OSH Nazi Department do not require joggers to wear hi-viz... yet. It has also been the responsibility of a pedestrian to head into oncoming traffic, so as to be able to avoid an accident, or has that mentality been bred out of kiwi's?

That would be hilarious. OSH fining a professional jogger for dangerous practices on the job. I bet it will happen one day.

All persons have the right to pass and repass on the public highway (even joggers)
And you are not allowed to hit them (even joggers)
Dark colours and stupid behaviour do not help their cause - but they do have the right to be there
Along with the fallen trees, wandering stock, boy racers and other potential road pizza
So just watch it :)

Same thing every Sunday morning here in the 'Naki - couple of dozen fitness freaks running straight across intersections - against the lights - ignoring the oncoming bike, car, bus or B-train. Even worse, the 20 or 30 cyclists pack riding down SH 45 taking up the whole lane. Even her-in-drawers, who's only been riding pillion with me for a few months is about ready to plant her boot in tail-end charlies lycra clad ass

Ive been in my tintop, 100 zone, around blind corner to find the road occupied by cyclists, hit the brakes to just miss them, they seamed to find it funny untill the bloke following me swerved to avoid me knocking 3 off.Cyclists and joggers seam to be trying to make a point, but metal will always win, its just stupid of them.Id hate to see anybody hurt but everyone to themselves.

Nobody "wins" when metal gets involved
I think they do have a point - they have as much right to be on the road as you do.
Its YOUR responsibility to ride in a safe manner
Which has to include making allowances for such blind corners, idiots and other hazards
Shame the following driver didn't have your skills

The Harbour Bridge is gazetted as a 'motorway'
Not quite the same thing - special rules apply
But yes I think the bridge should be open to all (suicidal black clothed ninja joggers with a death wish included)

i understand it to be part of the highway - as in SH1.
Do pedestrains still have right of way in most cases? Or something that gives them some legal protection if they step into the street.
I seem to remember if you hit one you get done, virtually no matter what.

I do understand that these threads that exist to curse cyclists, walkers, joggers, et al serve just to give the afflicted an oportunity to vent. But just in case someone is actually interested...
Footpaths are often concrete. Concrete is bad stuff to run on, it's too unyeilding. While the roadway itself is softer, running either side of the white line would create an unnatural angle of the ankle potentially causing an injury.
The best place to run, therefore, is right down the middle of the road. So that's what I used to do - at 5.30AM. Best not to be wearing yer iPod though as your ears are your first line of defence for anything approaching, particularly from behind.
It would be truly surprising if none of the runners were wearing reflective material, for many years now running shoes have mostly had reflective inserts and most rain jackets do also.
I was wondering if the OP had his lights on? :whistle:

I respect cyclists on the road, but when they are in the middle of the road, where they should not be, thinking they have a right to be in the "middle of the road", the only point they will prove is metal will win.

Mainly in areas where the street lighting is bad and I cannot see the surface of the footpath.

I know this has been said before..... but dam cyclists are a pain in the arse for us riders...
i live on the Thames coast.... and its a bit of tight riding there sometimes,,
come round the the corner and heres 20 lycra arses in from of ya..doing 20 ks..dont get the joggers here.. but the cyclists are a real problem..... they just cant move with the flow of traffic................

Road running is best done one the right hand side (facing on coming traffic) then you can get the fuck off the road when vechicle appear...Pedestrians have no legal right to "travel" on roads. Crossing is another matter

Having a bionic knee I don't run anywhere now, but disagree with the above for the reason given earlier. I guess if your local roads don't have any camber it wouldn't matter, otherwise it's unwise.

I think they do have a point - they have as much right to be on the road as you do.When they start paying road tax on their trainers I'll agree... Till then, there's a virtually infinite number of places they can run that cars can't drive on.

I am pretty sure that there are laws that stipulate that you can not obstruct a public road without proper cause. I.e. you can't just make a roadblock for the hell of it.
If you use the public roads you have a duty to exercise due care and awareness - if someone for reasons unknown decides to use your vehicle as a means to commit (conscious or unconscious) suicide I dare assume you wouldn't get done for manslaughter.

From a biomechanical/health point of view the middle of the road is best (if the road has crazy camber). Fucked if I'd run with my back to traffic though.
I run on the right side of the road - other than around blind corners or steeply cambered areas that way I can rely on my ears and my eyes to avoid traffic.
Getting back to the point of the post though, I wouldn't be so arrogant as to expect traffic to go round me (not even a push bike). Next jogger you see who chances it is work 20 points.
