    Joggers on the road

    Biking into work this morning about 6.15am, heading down Abbotts Way towards Remuera.

    I noticed a hell of a lot of joggers who decided to run on the road rather than the pavement. No problem with that as such (apart from the couple with the his ‘n’ hers backpacks who ran out in front of me) but the main gripe is that not one of these people had any kind of reflective clothing or something to show that they were there.

    For those of you who know Abbotts Way, it is quite dark in places and although I was keeping my eyes peeled, there were a few who just appeared.

    Now, my question is where would you stand if the worst happened and someone got hit? Bikers are always told that we cannot be seen and therefore the accidents are construed as our fault, but what if it’s a jogger?

    Just wondered if you guys had any thoughts or experiences with this….

    I would say if you hit any pedestrian and kill them you would be charged with vehiclular manslaughter. I don't see how you could avoid a man-slaughter charge, since someone was killed by accident.

    Based on that reasoning, I would also say you would be charged with careless driving (or dangerous!) if you just injured them as well.

    Sureley the OSH Nazi Department do not require joggers to wear hi-viz... yet. It has also been the responsibility of a pedestrian to head into oncoming traffic, so as to be able to avoid an accident, or has that mentality been bred out of kiwi's?

    That would be hilarious. OSH fining a professional jogger for dangerous practices on the job. I bet it will happen one day.

    All persons have the right to pass and repass on the public highway (even joggers)

    And you are not allowed to hit them (even joggers)

    Dark colours and stupid behaviour do not help their cause - but they do have the right to be there

    Along with the fallen trees, wandering stock, boy racers and other potential road pizza

    Same thing every Sunday morning here in the 'Naki - couple of dozen fitness freaks running straight across intersections - against the lights - ignoring the oncoming bike, car, bus or B-train. Even worse, the 20 or 30 cyclists pack riding down SH 45 taking up the whole lane. Even her-in-drawers, who's only been riding pillion with me for a few months is about ready to plant her boot in tail-end charlies lycra clad ass

    Ive been in my tintop, 100 zone, around blind corner to find the road occupied by cyclists, hit the brakes to just miss them, they seamed to find it funny untill the bloke following me swerved to avoid me knocking 3 off.Cyclists and joggers seam to be trying to make a point, but metal will always win, its just stupid of them.Id hate to see anybody hurt but everyone to themselves.

    I think they do have a point - they have as much right to be on the road as you do.

    Its YOUR responsibility to ride in a safe manner

    Which has to include making allowances for such blind corners, idiots and other hazards
