mate of mine got knocked off his motorbike the other nite by two asians in a rental cage.they couldn't speak a word of english
he was doing 30kms a hour at the time
yet the cops are still going to give him a ticket for $150 for not driving to the conditions
wat a crock eh?have ya
so like the tv ad says drive to the conditions or the asians will reduce your speed for u

sounds like we are only getting one side of the story here. You say he was knocked off yet he gets a ticket for not riding to the conditions. Whose fault was the accident??

bloody asians were pulling out with out indicators
they stopped half way out in to the road.he slowed and started to go around them
then they just carried on and forced him to lay bike over to avoid t boning them
dry road and not in rush hour traffic
the rental company said they were a bit worried bout these two women as to if there car would be damaged or not
they had only had possession of the car for half hour

the cops have charged the asians with dangerous driving yet hes gettin pinged too .the asians admitted fault to a interpreter.
the cops that was at the scene said his sargent has told him to ticket my mate

so they had indicated, paused, he decided to go around them even though they had indicated their intention to turn, he lay his bike down ON PURPOSE? and it's their fault?

i'd like to see him with an imminent car crash - would he open the door and get out?

Maybe he failed the attitude test once the Police arrived.

If it goes to court the test will probably be did your mate do what a "normal prudent motorist" would have done.

Look, I reckon the bastards will do anyone they can lay a charge on - it's happened to me before. I got off in the end but had to go to Court twice, had 2 unpaid days off work - bastards:argh:

I never understood this idea of crashing to avoid crashing.

Sounds like your mate dropped his bike due to lack of skill/experience. I had a very similar situation happen last week and I managed to keep it upright - not saying I'm more skilled or experienced - but logic would say that given they had already pulled out without indicating that he should have proceeded with extreme caution, or better still waited. Hindsight is a bitch after all.

My guess is the officer who said to charge your mate with not riding to the conditions is doing so on the grounds that he lost control of his vehicle when he otherwise shouldn't have.

They pull out a bit. He slows a bit. They misinterpret his slowing as him yielding. He expects them to stay put. They don't. Bam!! :pinch:

If your mate goes to court and describes it as you have done I reckon he's toast. Expect the prosecutor to dredge up this little pearl.

He is not entitled to rely on the expected. He must guard against the unexpected and that is the standard required of a reasonable, prudent driver.
Defensive driving 101: expect the unexpected. Motorcycling 101: you are invisible. Either of these courses would have kept your mate out of trouble.

Car pulls out suddenly in front of you, you are riding at a sensible 45 km an hour, and it is mere metres in front of you.

Two options:

1. Plough into the car that has pulled in front of you as you desperately try to scrub off speed.
2. Attempt to counter steer like a nutter, pull it off somehow, but then drop your bike missing the car.


I would take the option of avoiding the semi immovable object.

But that option might not result in an unscathed bike or body, but bound to be less. Not withstanding that the actions of the car still directly caused the accident.
