hey, here's one to chew on...
my bike is one of three in the country bought out by Suzuki NZ a couple of years back for some show and i bought it from a dealer a few weeks back...
i got snapped by the fuzz down taupiri way doing 116kmh and i had the right to write (repitition, as my english teacher would say) in and argue it...so, i did.
my bike is in mph, and i had the dealer put a 'white line' at 60 (around 98kmh) but i argued the fact that the guy actually put it on 65, he was taller than me, so angle of sight also contributed, and the angle of the speedo did exacerbated the problem...i then admitted that i exceeded the limit, as every kiwi rider and biker does, by what i figured to be 5-odd kms, being a quiet road so early in the morning. i did not dispute the fact i was doing 116, i plainly said i wasn't aware i was doing 116. makes sense???
so why was my lengthy explanation including maths and physics turned down when a friend on four wheels got a 124kmh ticket wiped because he was overtaking???
if there are any cops on this site, i would love to hear a reason...it surely is not because my explanation was above the mentality of those in the infringment bureau, and i am sure you are spending more time on unsolved rape cases in sth auckland, and then of course, it does take time to clear porn off your desktops...
should i take this to court? love to hear views on this...

as i said, i knew i was speeding, but by the grace of god as my witness, by the same amount as everyone else, ie less than 10kmh over. i DID NOT think i was going over 110, and had no intention of it...

Personally I reckon just drop it and cough up the cash. Despite all that you were going over the speed limit by 16kph, reason enough for them to ticket you. Some people are just lucky that they get off with simply writing letters.
Excuse me for being daft - but I though you said you were doing 116, yet you then state that you were going less than 10KMPH less than the limit. As the limit is 100 then you were doing 16KPH more than the limit.
I've tried the, "sorry" card to no avail. You win some you lose some. Pay up I say - lesson learnt.
Saying that - I've also neen clocked doing 130KPH + and the cop that clocked me couldn't catch me and radioed ahead for help. When an ocoming police car flashed me to pull over, I did, waited for his colleague to catch up and the pair of them admired my bike and let me off with a warning.
I think it's a Honda thing. :msn-wink:

You were speeding, pay the infringement before it goes to court or one of my compadres will be knocking on your door collecting the fine from you. And as a PS, overtaking is somewhat different, and different people different circumstances. I have had people who have not been let off for overtaking, comes down to judgement, and really, if the police have already said no to you, more than likely the JP who gets the file at court is going to say the same, so stop whining, stop speeding and pay up... :cold: I guess you could put it down to a costly lesson! :Punk:
PPS, sorry if that seemed a bit harsh, but like I am floating away on the cloud of painkillers at the moment so am a bit moody.

As to the ticket, just pay up, if you go to court the only thing you will end up doing is paying an extra $130 court costs ontop of the ticket you already have. Easiest way to not get tickets that i have heard is not to speed, yeah i know it sounds stupid but try it and see.

You've admitted speeding. The courts are not terribly interested in why.
My personal tactic, is to pull up the very second I see a cop make the mental decision to stop me, the INSTANT he hits his lights, the second he pulls out of his hidey hole, the moment he cracks his door. I pull up, hard, and safe, jump off, or out, sun glasses/helmet off, look him in the eye, and either take my lumps, or state my case. I have about a 70% sucess for nearly the full range of variables. I've even had patrol officers thank me for braking and stopping safely straight away, from 137kms, to talk to them. (Matamata, got off!!!) Also know that when you are wrong, and dangerous, your own mama would smack yor arse. Don't whine afterwards, book it up to experience, if you never fu*ked up like you didn't want, you'd be the rider you wanna be...... Right????

Got pulled on the way to puke on sunday. Was doing 125kph on the motorway.
Cop told me to have a good day and keep the speed down a bit.

There seems to be a bit of this happening lately. A change of approach perhaps? Did he know you were an Ambo person? Most of the MOT guys never booked them and it paid off for me when I left the job and an ambo turned copper caught me and let me off.
How about taking responsibility for your actions. Its your bike and you ride it. If your instruments are not right or cant been veiwed properly - its up to you to get it fixed. If you choose to speed (and most of us do sometimes :msn-wink: )and get caught, just pay the fine. Thats life.
If only fellow man insurance was more widely practised.

Don't think it would be worth your while,
Speeding is a strict liability offence, so even if your speeding was genuinly an accident and there was no negligence on your part, you'd still be guilty.

My nephew tried to run the chopper outa gas, coz he was on his restricted, with 2!! cases pending (16 ). Loss of car, loss of license for 2 years, whats he gonna hang round for. C*nt had 4 others in the car, chased for 2 1/2 hours, ran 3 road blocks, beat the spike mat, stopped because he missed a corner drove of a bank, into a carpark, blew a tire.
Not supporting that little F**kwit, but, when I was younger, an same shit was goin down, they weren't trying to financially cripple me, but dad would've, an that was ok, coz I'd much rather (not) pay some fine, than be beaten with a stick.
Same at school.

Here's a similar story courtesy of a mate of mine who is the comms officer for Greater Manchester Fire Service (UK) (cut n pasted from a recentish mail):
"...Got called to a shout (called out) on the weekend. A factory unit had gone up, and as I was on call I had to get out of my pit (bed) at 3am - fuck was I pissed off. Anyhow, I was panelling (speeding) it along Bolton Road with my blues and twos going in my Discovery and I noticed a Fed (police) traffic car up my ass. I thought he was on the same shout as me so I carried on, but wondered why this cock in a T5 didn't overtake. Anyhow 2 minutes later an on coming fed with his lighs on came towards me swerving into my lane and back out, so I slowed up then stopped, got out of my motor and this wanker of a copper, an inspector, came at me from the T5 with his fuckin baton drawn!! He was fuckin screaming at me, "Why didn't you stop?". I said I was on my way to a shout yadda yadda hence the fuckin disco lights on my motor. He didn't believe me (it didn't help that I was in my jogging botttoms as I hadn't changed!!). He was fucking furious. Asked me for my ID card and gave me a fucking lecture about speeding failing to stop and all manner of crap, even threatened to report me to my gaffer.
After 5 minutes he let me go. What a wanker......" etc etc
There's wankers on every continent and in every proffession in the world.

I gota disagree with that, i have had some bad experiances with cops (theres a bad seed in every profesion)...being young and driving a "sports" car. (no im not a boyreca...and you wont see me driving round with a cap and a hood on at the same time, looking like a gangster)
But Im always polite and they usualy return the favour. Ive been let off more times than ticketed in my experiance. Depends on who pools you up

I had a cop tried to give me a ticket based on the speed he needed to catch up to me when he was like 800m up the road. I was doing just under 60 in a 50 zone and i got a ticket for 80kph. I went right to court with witness and map and calculations. He didn't even show up! :no:

Coming back from South up the Mangaweka hill in the mighty Legnum I got pinged for 115kmh. My excuse that it was the minimum speed where the transmission would not hunt between gears wasn't good enough. Bit of a pisser actually as on the way south I had been flying in places but returning north I was generally obeying the speed limits except for the odd situation as above. Cop seemed like a decent sort apart from the giving me a ticket bit.

There is a push by the Govt to introduce front plates, but so far it hasn't happened. It doesn't help when riders go through them deliberately way over the limit giving 'the finger'.

No front plates, pics only taken from front BUT if the camera is a mobile one the operator can write down your number and post you the ticket.
No demerits from a speed camers ticket.

This probably doesn't help your situation, but it is an approach I have used in the past to make me feel a little better, and to make sure that the police dot all their I's and cross all their T's.
I'm not sure how you were 'snapped', but you are entitled to make sure that all the equipment used was properly calibrated and up to spec.
Tickets I have had in the past have taught me these things, all of which are information you can request:
Certificates of accuracy are issued for all police speed radars once a year, and this certificate must be up to date.
Highway patrol officers test their radar daily before they go out on the road, and record the results of this test in their log books - you can ask to see this at the road side, or request a copy. (I'm not sure if this is necessarily a legal requirement, or if general duty officers do this)
If a patrol car was used, you can request a certificate of accuracy for the speedo of that car - this is not so relevant, but police can guage your speed using their speedo - the radar, to the best of my knowledge, fires off a pulse at the ground to determine patrol car speed, rather than using the speedo.
You can certainly request copies of this information under the Official Information Act, and anything else you'd like to know (Like $$ collected by speed cameras etc if you're interested).
I'm not sure what the deal is with speed cameras, having only been snapped once (and not being too pissed, as the fine wasn't big, and the photo was hilarious) but I'm sure the equipment used is subject to similar calibration, and you could request info on this.
I suppose you could request evidence that the radar operator was trained appropriately - but that could be possibly be denied on Privacy act grounds if it identifies the individual. (Don't see why this couldn't be edited out).
I don't know if any of this is of interest to you, copies of the OIA are available at Whitcouls, and online I think - although I don't think you'd have to necessarily quote section numbers for a request to be successful - just be very specific about the information you want.
My advice from a tutor (who practices) was to pay up - as going to court is expensive, and the police are not at all keen to allow any precedents to be set! (My assertion, not his!)
I ended up getting an entire police operation, calibration, and training manual for police radars and laser guns with my request - a very interesting read!
This probably won't get you out of the fine, but it is nice to keep the b*stards honest - and to compel them to do something for you.
2 things to point out - requests can be denied if they are vexatious (But I can't see how getting this type info could be!) and organisations *can* charge for the information (copying costs etc) but usually don't for such a small ammount of info.
Further to my rant, it is attitudes like that of scumdog in this thread that led me to install a radar detector in my car when I lived just out of Dunedin ( Car is an '82 laser 1.3 that is a feeble, out of tune pissbucket - sad that I need a detector). I have noticed since moving to Auckland that most of the general duty police cars up here don't have their radars on, whereas those in Dunedin usually drive around blazing with radar. Perhaps Auckland cops have better things to do...
(That said HOW a cop behaves when writing you out a ticket makes a huge difference - some are complete w*nkers who give all cops a bad name, soem are pretty OK in their attitude - the w*kers in my experience have been young highway patrol cops, and the OK ones mostly older guys with a bit more life experience under their belt perhaps...)
IMHO, I see a need for speed limits, and the need to police them, but the current application of the law makes a mockery of the purpose of the legislation - which is surely to promote *safe* roads rather than ticketing anyone slightly above the limit as a matter of policy.

the other stuff (operating manuals etc) make for 'interesting' reading, that's about all - if you were pinged by a HP unit, you can guarantee that they have all the appropriate qualifications, and that their speedo/radar etc are up to date. it's worth a crack though - costs nothing, and it's always worth while seeing what is written on the back of the police copy.

hey, don't get me wrong marty, and spud, but me, my wife, and kid, pay good money in taxes to feel secure in the belief that i am safe in my home, on the roads, and in my wellbeing...and cops took an oath (as i did to serve in the navy) to fulfill that promise...now this whole thing about understaffing is bullocks, i see a truckload of cops on our roads revenue gathering and not investigating incidents such as rape, and i would be livid if i knew cops were sitting on sh1 with a radar and my 18yr old daughter's rapist was still at large and no-one was assigned to it...and then, they are viewing porn as well? hey, i'm a bloke, i love porn as much as the next guy, and girl as the case may be, but they have an image and job to uphold...and its hard, no probs from me (i was accepted into the police two years ago before a rugby injury forced me out) but some consistency sure would be appreciated...we have heard in this thread some guys doing greater speeds and being let off...where's the f__ken consistency there?
i said it in my very first post (under newbie intros), "if i offend anyone, i apologise, but i will never apologise for what i have said", isnt that what forums (within reason) are an avenue for, free speech?

Of course. They're people being told what to do, not at all their fault. It's their bosses that are the problem. Not once have I had a tail-gater behing me pulled over by a cop for dangerous driving. They're all being forced to focus and speeding as thats where the money is
And the only real reason for me hating them when it comes to tickets anyway is how they treated me when I sent them that letter. Come on, they got two simple facts wrong

That is exactly what I found out - I would not expect a well rescouced outfit like the HP crew to put a foot wrong often.

hey, here's one to chew on...
my bike is one of three in the country bought out by Suzuki NZ a couple of years back for some show and i bought it from a dealer a few weeks back...
my bike is in mph, and i had the dealer put a 'white line' at 60 (around 98kmh) but i argued the fact that the guy actually put it on 65, he was taller than me, so angle of sight also contributed, and the angle of the speedo did exacerbated the problem
Just outta curoiusty (sp) since when did a GSXR600K2 have an analouge speedo to put a mark on it? Aint they all digital?
What type of Gixxer6 was it, wasn't a Telefornica rep by any chance as they brought 15 into NZ and i destroyed one of them.
Anyhow, if i get caught i pay it, no questions asked and i've been pinged for um well more than 116kph, infact most of the time i'd be happy for a ticket of 16kph over, if by some miracle i can talk my way out of it, i take it.
But yeah at the end of the day, you get caught, pay for it and move on.

So there you have it... we get criticised for using discretion and not being consistent and criticised for trying to be consistent and ticketing everyone over the tolerance level.

Not so sure about the logic of that. I think (based on the words of wisdom from our esteemed masters) that the 10kph was to allow for speedo error and such like. I seem to remember that the police wanted no tolerance, and accepted 10kph because speedometers on new vehicles (or used ones for that matter though they don't test them) have a +/- 10% tolerence. In reality they are always fast (over read) but legally it can be the other way.
But I would argue for individual cops to use discretion beyond that. Where appropriate. An example. Tootling along yesterday (within the 50kph limit) on Li'l Rat Bike, when an Interchangeable Mabel decides (as they do) to pull out of the carpark directly in front of me. Never even slowed down, just shot up to the carpark exit and out. Saw her coming as she approached the exit but braking would have been touch and go on a wet road, bearing in mind the possibility of oil and muck on the road where those carpark driveways come out. But there was a gap ahead and to the right (four lane road, me and (now) Mabel in the left lane). That's fine I'll just nip in there. Standard practice , happens all the time. One problem, there's a cage right beside me on the right.(He'd closed up on me a bit when I slowed down when I saw Mabel heading toward that carpark exit ) . So I need to get ahead of him enough to slip right away from Mabel. Standard procedure again, a bit of throttle to move me ahead of the car on the right , indicator, check he hasn't speeded up (surprising how many bastiges will do that, if he has, brake and go behind him) , no, good chap, and nip right. Sail past Mabel, who never realised that anything was amiss, I think. No drama, just the usual fun and games. Only problem, in doing this I got up to 70kph odd for a few moments (then down again). And coming toward me, a police car. "Oh shit, I hope he's not going to be silly". He didn't, just carried on past.
Now I don't know if he didn't notice (damn unobservant if he didn't) or if he realised what was going on and decided to ignore the few seconds over the limit. If the latter, then I think it was the right decision.
In this case a few seconds speeding was the safest thing to do. And the cop allowing a bit of discretion was the sensible thing to do.
(And, to nip lectures in the bud, I knew the gap was there, I'd been keeping an eye on it just in case. And I still had other options: to steer left behind Mabel into the car park she came out of; or blast her with the horn, hope she braked and go past the front of her. Or hope she came out and accelerated hard, in which case I could easily brake enough to fall in behind her (would have picked that one if she'd been a boi racer - they can at least be relied to blast away hard) . Or just brake hard and hope not to hit oil. But relying on what Mabels may do is dangerous. There is no predicting them. Nipping into the gap was the safest option because it was the option that did not depend on predicting what Mabel might do)

i see a truckload of cops on our roads revenue gathering and not investigating incidents such as rape, and i would be livid if i knew cops were sitting on sh1 with a radar and my 18yr old daughter's rapist was still at large and no-one was assigned to it...
Rape is a purely indictable crime and as such is a matter for a CIB detective to investigate. Nobody expects general duties or traffic cops to investigate these offences beyond whatever initial action is required upon receipt of a complaint. Equally nobody expects a CIB detective to allocate 20% of his or her time to traffic enforcement either. If rapes aren't being investigated its because there aren't enough detectives, not because there are too many traffic cops.
Try gaining a little understanding of the matters you are critiscising.

Anyways - I got a wee bit excited, and I will accept some of your criticism, and partially resile from my comments. I am sorry scumdog, I do not have enough information to make sensible comment with respect to your personal attitudes, it is almost certain that you have never ticketed me, I should have known better, and I apologise.
I'll give you a free shot - as I too am heading towards a sometimes maligned profession - I'm another scummy law student.
A little clarification: The firey part of may rant is based on conjecture, but on 3 actual incidents, and my radar detector, which objectively verifies that the majority of general duties police cars I have seen in Auckland are not using their radar, which is in stark contrast to what I observed in Dunedin - I can only speculate as to the motives for this.
I should point out that I do my best to be polite to any officer who pulls me over for whatever reason ("Sir" etc...)
2 of the incidents involved tickets (unsurprisingly on a downhill stretch of road, given my car...) One officer was young, a little smarmy for my tastes, and said all the things that push my buttons...I carried on home in a dark state of mind that likely did road safety no favours. The other officer was older, and in spite of being obliged to write me a ticket, was a very pleasant gentleman who admonished me in relatively benign and soothing terms, and I went on my way lacking the bad taste that I had from the previous incident - the differrence was attitude.
The 3rd incident involved being pulled over on a deserted Dunedin night by a GD car with radar for the 'suspicious' act of going up one one-way, and down the other (the officer also happened to independantly do this). I think he was bored.
See my previous post - IMHO I would love to see the attitude applied to speeding applied to those who do not indicate, in fact I could *accept* the policy on ticketing for speed offences as a quid pro quo if it was extended to non-indicators, and other aspects of poor driving - which I believe pose at least as great a road safety threat as those who speed to excess.
There is a *perception* of police roading policy (Which somehow unfairly seldom extends to the polical masters of the police), which rightly or wrongly ends up colouring the attitudes of the public WRT police priorities in a negative light.
Maybe I'll meet you someday touring in South Otago :ride: - a fine part of our beautiful country, I'm sure you're a lovely chap :D

For sure - why radar detectors are only an odds evener at best (ironically, they are obliquely aimed at policy rather than at frontline police)
Impossible to cheat a laser, even if you can detect it (no one reacts at the speed of light)...and you'd need bloody quick reactions, and to not be too far over the 'de facto' limit to beat instant on (even though radar is usually a few km/hr in the motorist's favour due to the angles they are set at for good doppler return).
'Quiet' cop cars (except on Tamaki Drive) are just an observation I've made in my few months here...vaguely interesting...probably not much more to it than that...

I think the only thing he would have noticed would have been me slowing down from 70. To an observer it would have been very undramatic. Mabel trundled out into the traffic stream doing 40 -50kph. I zipped sideways with a bit of acceleration. Doubt anyone else even noticed what was happening. Of course if I'd stayed where I was and hit Mabel it would have been dramatic. But that really was not very likely, I try to avoid such things.
Only a biker would have thought - "Hm what would have happened if that motorbike *hadn't* nipped sideways like that - oh yeah, shit" Cagers just don't think like that.
Obviously what Mabel did was the more serious offence from a safety POV. I regard failure to stop/give way as always serious.

If that is the case, then my wild-arsed assumption that you spend way too much time playing computer games should be totally reasonable - on the grounds that while your assumption was based on the "objective statements" in the popular press (who have no political axe to grind and are not at all motivated by gathering revenue - I feel a new Tui ad coming on...), my assumption was based on observation of your posts.
You do not appear to have learned that the other "players" in these on-line forums are real people with real jobs - you seem to behave as if they were merely computer-generated images in a computer game - hence my assumption of your computer experience.
You have a self confessed attitude of "fuck 'em all if they get offended, I have every right to treat them as I please" - the "bravery" that comes from knowing that they can't smack you in the gob. You trade on the relative anonymity of your profile to say things that you would not have the balls to say to the faces of the likes of Spud, SD, Marty &c if you met them in a pub.
The same applies to your sweeping comments about kiwis and poms. If you tried that crap in a pub you'd get hammered and you know it - which is why you say it here where you feel "safe".
"Free speech" is not defined as "feeling free to say what you'd be too scared to say under other circumstances".

FYI "Free speech" is the right to speak out against the policies of the government without being summarily arrested and jailed, not the right to behave like a total arse in public.

Many either aren't interested or aren't capable of completing the extensive study that is required to become a qualified detective. Joining the CIB is a career choice made by the individual, it isn't something that is decided for you by promoting a person to that position regardless of whether they want the job or not.

I've been nabbed for speeding in the past, done all the "sure fire" things to get off - stopped quickly and safely, got off the bike, removed helmet and walked part of the way to the cop's bike. Was polite, apologetic, explained the situation - still got the ticket despite all that so I paid it. Why? Because I was speeding and I got caught. Simple, really.
I don't get speeding tickets any more - anyone want to hazard a guess why?
And as to tarring all cops, or anyone else (except lawyers, bankers, accountants, doctors, dentists, marketroids and politicians :D ), with the same brush - most the cops I've encountered when pulling me over for speeding or random breath checks or stopping me for questioning whilst I'm on my midnight perambulations though this fair(ly shitty) town, have been polite, professional and well mannered. Once a friend and I were picked up by a couple of cops who did their best to get us to swear in public so they could hold us on that but they weren't too much of a hassle and once a cop was rude and abusive to me whilst asking me questions and then asked "fuckin' goody-good, are ya?" when I told him I had never been in trouble with the law - but he was a rookie fresh out of training and needed the rough edges knocked off him (which I suspect happened once he and his senior partner were out of my earshot). Even the cop who came to take me to the police station for questioning regarding allegations of me discharging a firearm at someone was polite and easy to get on with.
Yeah, so it's annoying getting ticketed, it cost money, can cost your licence, and writing letters doesn't always get you off the hook (despite it being a popular topic for threads) c'est la vie. The alternative is to stick to the limits (ensure your speedo is properly calibrated and legible. I've been sitting at "80" km/h behind a mate's car and they've sworn they were at 100 - we both can't be right, hope theirs was wrong...)

Yes, but don't forget they have to be new ones, pre-recorded ones won't work as the recording ruins their ability to deflect the laser.

i havent got anything to hide, spud will give you the rest of my details (BTW, i have told cops that, i told the cop that got me years ago - see below- me, he was quick as a flash and replyed "of course you do, its the only way i can afford to get taxis round to your house to see your missus!!" and that my friends is a good cop, although he did call me a wog, and i had to correct him, i am a spik!), and if you want to come round and smash me, as you so eloquently put it, maybe i deserved it. the site was to talk all things two-wheeled (three if thats your thing) and i had a view and needed somewhere to put it. i never really had a problem or attitude about it, just chanced my arm, but as text based communications cannot portray sarcasm, humour, or any other emotion, if you take it wrong, hey. take it as it was intended, a place to get something out. i dont beat people up, i dont murder, i dont rape, and apart from one incident in a car, and the speeding ticket, have not broken the law. as i said, i was accepted into the force some time back, and would hope to have another crack at it now, although the mind is willing, the body is to fat!!

Actually, you're quite right! Interfering with lasers is possible, but I believe that actually interfering with radar is illegal (Can anyone inform me?)
I was speaking more WRT radar detectors - the laser detectors on them work, but aren't worth the shinyness, as they do you no good because once laser is detected, it's too late! [All mine found was a "cheap" replacement ignition part...AD INFINITUM!!!!!!!! until I got a better part...]

Quite right Wolf - we're all human, and most people carry out their roles professionally - there is always the odd bad egg or person having a bad day/week/month (Or perhaps the odd good egg in the case of lawyers? :msn-wink: ) Of the 10 or so times I've been pulled over, only one cop really rubbed me up the wrong way. The issue is more bad policy/application WRT some traffic policing (IMHO) It is all too easy to get excited based on one or 2 bad personal experiences (Guilty here :weep: )

Not so sure about the logic of that. I think (based on the words of wisdom from our esteemed masters) that the 10kph was to allow for speedo error and such like. I seem to remember that the police wanted no tolerance, )
