View Full Version : When are you obliged to stop?

I was talking to my brother in law the other day, he's just gone back to the uk for a while after living in Belize.
He was telling me that over there they've got a problem with people painting up their cars to look like police cars and pulling people over and taking money for "fines"/ confiscating their cars or bikes/ feeling up the girls and beating up the guys, (or heaven forbid the other way around) in the name of the law.
I thought that was rather enterprising but he told me that's happened in the uk too, you get unmarked cars over there like you do here, and people were getting flashing lights to put in the front window and pulling people over to take money for "fines" etc. it probably works well on imigrants that would just pay up.
I got pulled over buy a bloke in the uk in an unmarked car flashy lights in the front window, suit on not a uniform, and he started spouting off all sorts of laws at me beside the road. i thought it unusual at the time, he probably was a real cop though cause he called me "sonny" and all real cops do that even if they're younger than you..
My question is; who are you actually obliged to pull over for? What if you suspect the car with the flashy lights is a fake and they just want to pull you over to steal your bike and duff you up?
Is there a court in the land that would convict you for not pulling over under these circumstances?
You're supposed to give your name and address to a uniformed officer, but what standard of "uniform" does a car need before you can be satisfied it is a real police car and pull over?
I'm bound to get some joyless, condescending berk like shrodingers cat, sat behind his incredibly clever sudonym, ready to flex his amazing intelect on me from behind his temp desk, so if you have anything boring to say, start your own thread.

If the car has lights and siren, you should stop.
If he is not in uniform, ask to see his Police ID card.
No ID card, ride on.....

Oh this thread has the potential to be epic
Patrick, I heard somewhere (probably in the bush, where I do all my lawyering) - that if you're in any doubt about whether the undercover car (not applicable for marked patrol cars) is a Police vehicle or not, you're allowed to carry on to the nearest Plod Station.
Any truth to that?

The officer has to identify themselves as such upon request from any member of the public, you can always ask them for their QID and if they refuse to tell you that, or they don't know what you're talking about then that's a clear sign that they're not a real officer of the law.

Nope. As above. See the ID, if none, drive on.... and grab the rego to report it..... Since most folk have cell phones, ring 111 if in doubt. Comms will soon let you know its for real.....

So if you know you're probably going to lose your licence anyway, then you might as well do a runner if you know you can get away with it.

Those are just the ones who get media coverage. The majority of police pursuits are abandoned due to an "unjustified risk to members of the public". Most of the pursuit crashes are due to some dumb 17 year old who stole a Skyline by shoving a screwdriver into the ignition and thinking he can drive like a Formula 1 driver in a car sacked on kutties.

Would suspect that what many consider doing a runner, may be passing a cop at high speed, but before giving the cop a chance to give chase, takes off and gets outta there, hiding somewhere down the ways.

The vast majority never get caught. If the person being chased is prepared to run a red light at high speed, then the pursuit gets abandoned. Comms then tells the officer (s) in the chase to pull over, turn their lights and sirens off then advise comms where they have pulled over.

I'd just like to know where you get the stats from, since Patrick doesn't know, how do you know? He has 100% success rate even when the chase is abandoned, he's obviously got enough details of the offending vehicle to round the driver up in due course.
Who's got the actual figures? So while even if the majority of chases get abandoned, how do we know how many get rounded up later?

I listen to my scanner every day. In most cases, if the pursuit was abandoned then other officers will do some areas to look for the offenders, but in many cases the pursuit is not allowed to re-commence if the vehicle is seen again. The vehicle is usually stolen as well, so finding the offenders proves very difficult. It's then up to the police to prove who was driving at the time. A delta (dog) unit is usually called in to chases to catch the offenders if they ditch the vehicle.

Perhaps, but if they've got to turn around they are at a disadvantage right away, esp with a bike, as there's no front plate. All they can hope there, is that the rider stops as required. But we've seen on the Teev that bikes can be caught and a number tend to crash trying. There was that famous one out West a year or two back?

I considered the pros and cons of it a few years ago and decided that if I ever saw the red/blues behind me I'll just pull over and take my lumps. Decision made back then in a calm and rational state of mind meant I wouldn't make a stupid decision at some time in the future. Like on Friday night in Wanaka for example. Doing 100 in an 80 zone and whizzing up behind the car in front of me when I passed a cop going the other way. Red/blues come on and a big U turn ... bugger! Pulled over like I promised myself I would then watched the Xmas lights come up, pull alongside then proceed to chase the car that was in front of me. Forgot the old rule ... 'First in line, pays the fine'. Would have been doubley stupid to run huh! Best of all ... the car in front of me was being driven by Mrs Oakie. Priceless!

Many years ago i was attempting to catch up with a 140km/h speeder on sh29. I came upon a motorcycle which, when I pulled level with (overtaking) he took off - obviously thought I was after him.
70km later he bailed into a ditch and a paddock after running a stop sign at about 100km/h at a T-junction in the country. I was about 200m behind him at the time.
What a waste of a Ducati. His own one too.
He's still in a wheelchair. I still have no idea why he ran, I suspect he was moving some meth or other class A drug.
Moral of the story - pull over - it just may not be all about you.

I do wonder if that is less the case these days than it used to be. My father has plenty of stories of being pulled over at insane speeds and getting a warning. I've been pulled over three times (62 in a 50, 75 in a temp 50 zone on the motorway with no roadworkers in sight, and 102 on a straight section of an 80 zone on a back road) - I've always waved acknowledgement, pulled over at the nearest safe spot, taken my helmet off and been more than courteous with the cops. For my troubles I have 90 demerits and am yet to recieve a warning. FWIW not all of these were on a bike either.

yeah, I think thats true. My uninformed perception is that the po po have "performance targets" which mean that they are less likely to want to give a warning, especially for easy meat like a traffic stop. Plus they can enhance it if the car isnt registered or warranted or unlawfully modified or whatever. The other thing too is that traffic cops probably get sick of taking shit from fuckwits so tend to treat everyone as a fuckwit. And someone being pleasant and co operative to them is just a punter with something to hide. (Maybe).
Remembering back to my last ticket (122 in a 100, oncoming cop who turned around and nailed me... I just sucked it up and paid the money) the cop was a bit of prick till he realised that I wasnt going to be a dick, and all he was going to get out of me was the $80 or $100 or whatever, and in the end we had a nice wee chat.
Ive been riding round for a few days without a speedo because the cable broke (new one here today, yay!)... thats been interesting. OK when there is other traffic but otherwise its "put it in third and that feels about right": no revcounter either so its just about the sound.....

I just sucked it up and paid the money) the cop was a bit of prick till he realised that I wasnt going to be a dick, and all he was going to get out of me was the $80 or $100 or whatever, and in the end we had a nice wee chat...
To be fair, each of the cops I've dealt with have been very professional and polite. I do take exception to a cop sitting in the safest ever multi lane temporary 50 zone on the motorway in the evening with no roadworkers around, but other than that I have no complaints as to the attitudes of any of the police I've been pulled over by (this includes alcohol checkpoints etc).

Has anyone tried bribery?
Getting your tits out?
1. Only in Queensland...
2. Only if you're a chick....
I have found I don't get stopped when I don't break the law....
NOOOO.... THIS CAN'T BE SO.....:gob:
But, a fake police officer is easy to spot. They will have ass-less chaps and a ribbed baton. :shit:
Sounds like Scummy - not sure about the arse less chaps and ribbed baton... chaps and a tassled baton, maybe.....?

Oh this thread has the potential to be epic
Patrick, I heard somewhere (probably in the bush, where I do all my lawyering) - that if you're in any doubt about whether the undercover car (not applicable for marked patrol cars) is a Police vehicle or not, you're allowed to carry on to the nearest Plod Station.
Any truth to that?
Nope. As above. See the ID, if none, drive on.... and grab the rego to report it..... Since most folk have cell phones, ring 111 if in doubt. Comms will soon let you know its for real.....
Failing to Stop for red/blue lights or siren (Or both, since they have both...) = Arrest, car impounded, minimum 3 month disqualification on top of any other disqualification imposed arising from the same incident.....
Many years ago in the UK my ex wife was being indicated to stop by a plain car with flashing lights in the grill and the driver wearing a fluro vest. Thats all she could see, it was early evening and dark enough to have lights on which restricted her view of the driver behind.
Only that week there had been several reoprts in the national news of drivers posing as police and indicently assaulting women.
She rang me on her cell phone and asked what she should do and I said drive to the police station while I phoned ahead to the station.
The driver twice pulled along side her trying to force her to stop on her way to the station but she carried on (now fukin scared shitless)
I got through to the police station and there were unable to confirm if one of there officers was trying to stop a car. I told them to expect a car there very soon with a very concerned women at the wheel and explained the situation.
She drove into the front car park of the station and was met by the desk sergeant waiting outside. closely followed by the 'real' police officer in the unmarked car who blocked the entry/exit to the car park with his car, leaping out
The officer that followed her was well pissed and ready to through the book at her for not stopping blah blah but is boss wound his neck in for him and was able to point out the concern my ex wife had.
The impression my ex had was that this officer still did not think she should have gone to the police station but just stop as directed despite what was very current in the news but sucked it up because his superior was there. In fact the problem of people inpersonating police became so problomatic the public were being advised to seek hi visibilty public places to pull over or indeed go directly to the police station if in any doubt.
The reason her wanted to stop her in the first place was to caution her for failing to indicate off a roundabout. An offence so serious he felt it neccessary to persue her through a town centre, pulling alongside twice forcefully pointing at her with a jabbing finger movement!!
In summery the officer following her came across as insightless cock who's only concern was getting her to do what 'he' wanted her to do. It took the comments from a senior officer to calm him down although the impression left was he hadn't changed his view.

Classic - next to poor Mrs Oakie, this is the funniest thing in this thread.
I think I would stop, but I don't believe there is any instance in NZ where the police will ask for payment road side. Instant fine yes, but not instant payment.
Unless you've got a backlog of fines and a warrant for your arrest. There was an episode of Road Cops where a guy on a Daytona 675 got pulled over. He had to pay $9k on the spot (friends and family credit cards) or be arrested and have his bike impounded.
He knew to stop though.

Wow, shows what I know, I didn't realise you could be asked to fork it over immediately. I guess he/she had let it get pretty bad in that case though.

Every so often there's an operation where they stop all the boyracer cars and see who owes what in fines and invariably there's a car or two plucked from under the arse of their owner and sold to pay for the outstanding fines.:crybaby:
They do get the change back:rolleyes: - if there's any left over after the dust has settled....

Everyone has overlooked the obvious question here...
Where the hell is Belize?
Exit the Panama Canal at the Atlantic end, then hang a left and follow the coast for a while.
