I really needed a electric drill so I went to TM to find a cheapy for the ONE job I had, I found one here
http://www.trademe.co.nz/Browse/Listing.aspx?id=395169110

So I brought it from Jobita (barrie Randerson) who lives in Wellington

we paid for it immediately, and he contacted us 3 days later saying it would be sent out today (August 6th) nothing arrived
We then emailed numerous times with no reply.
I sent him and email last tuesday indicating I would be contacting the Police and within an hour he rung me, noting he has been in hospital blah blah blah and he would sort it out.
A week has gone by, and still no drill, no refund, nothing.

He is trading actively again buying and selling.

I note now he has multiple negative feedbacks noting the same situation

We have contacted Trade Me and they dont seem to be to active, or worried about it.

Im Pissed off about it and I want this mutha fucker on a stake to burn at will.

so, question is is this a police matter?
can I take this cunt to the cleaners in another way?

I realise its $31.00 but its not the money its the princepal.

Trade me only want the $$$,fair go proved that last week or so,my account was suspended 4-5yrs ago when I complained about people selling Livestrong bracelets which is cancer fundraiser in USA,and they specifically stated not to be onsold at inflated margins or profit on ebay etc, trademe said we aren't ebay are we,so I told them what a bunch of tossers they were, next thing account blocked, took a while to get back on.

And is basically a fraud charge, obtaining money by deceit means.

Why don't you pay him 'a little visit'? As you said it is only $31 but I for one would make the trip.
BTW, always always ALWAYS check the feedback before doing business on Trademe, ebay etc.

You have learned a cheap lesson. Forget about it, go to Mitre 10 or Bunnings or Placemakers and buy a decent drill. They have shitloads of "Fathers Day" specials on so the discounts cover the $30 you've lost.

Its just not worth getting bent out of shape over. Leave negative feedback, move on. Karma will bite him in the arse one day.

Oh, and that looks like the single shittiest piece of shit drill I have ever seen. Do yourself a favour, buy a decent Makita. Spend a couple hundy. thank me later.

My little Makita 12V cordless (which has done a shitload of work) fell off my bench in the stupid earthquake and bent the spindle. Just enough to be annoying and make it difficult to start a PZD self tapping screw. but it still goes like a champ. Not worth fixing so I replaced it with another Makita.

You could try what I did in a tardme ripoff to bring it to a head when I wasn't getting any satisfaction.

I took the buynow on all of the turds auctions (that had buynows) and bid tens of thousands on all of his other auctions. (about 40 in all). I immediately placed comprehensive negative feedback on all the auctions I had won using buynow (about 25).

That set things in motion featuring a few threads that he started in the tardme online community (Which I was notified of by another trader) I had a heap of fun kicking him around in the threads for several hours which turned into a massive dogpile before they all got removed along with all (bar one) of the auction feedbacks which I had placed and his membership was terminated (though his details were left up and may even still be):kick: I used to visit his page to make sure it was still dead and have a little giggle over it.

Tardme never said a single word to me about it other than censuring and banning me from the online community for the abusive content of my posts. I felt pretty satisfied with myself

Hypothetically, It could be worse though. Imagine the following scenario for instance:

Could be far, far, worse. My old lady transferred the sum of $4,000.00 to a family members boyfriend (now ex) for a car that 2 years later still hasn't been delivered. She had stupidly given him her full trust in regards to the car.

Been taken to court, where he attempted to muddy the waters and make out that it was nothing to do with him. New court date was set. He failed to file any required paper work, and never showed on the day of the court hearing. was ruled in my mothers favour, he was given a time frame in which to pay the full sum back yet failed. Went to court again and they were sending someone around to remove a few of his possessions to be sold at auction. Somehow the little weasel knows how to work the system and 2 months later up and decides that he wants the decision reviewed (he sat through his 28 days notice). And yet here we are still waiting to see a single cent from him, meanwhile he's still out there selling cars to people.

Small amount of money. Large amount of money. Doesn't matter. Rip off scum. Fucking hate them.

At 12 weeks you cancel the order and get your money back from Visa

Meanwhile, he quietly convinces his bank to give him back the $800

I'm VERY surprised the trader was able to do this. As a business operator who accepts credit cards I was told very strenuously by the bank a customer has up to 6 months to put in a charge back claim and the bank WILL remove the money from my account and only put it back once BOTH parties had come to a mutual agreement. Sounds like someones bank in this situation has not followed the rules in this case?

Thats cos you were using one of those useless keyless chucks. If you want a reliable drill, use a keyed chuck. And mains power. I'm still using a 30yr old Skil and the damned thing won't die. In the meantime various cordless things have come and gone. :pinch:

To be fair, got a cheapie drill and angle grinder (mains) from Supercheap and they won't die either.

Ouch nice, but what did that do for your own account and feedback ? you would have got equally nailed ?

Not at all.

He did return the negative feedback but all of it was deleted. Tardme said and did nothing about it.. Maybe because he admitted (in the community forum) that he sent a different product to that which I won. I dunno. Maybe Tardme were scared of what I might be capable of doing if they got on the wrong side of me. My Tardme profile gives people specific and fair warning not to fuck with me or I will make their lives a misery. (it's the type of guy I am).

I have over 400 trades only 3 negative feedbacks and they are all from sellers (none from buyers) If you investigate peoples feedback and have a proper read of the comments from both parties you will see that the underlying constant when sellers give negative feedback, is that they were nearly always first given negative feedback by the buyer. They are whiney little fucks who have no reason to give negative feedback other than because the buyer told the truth about them. Exactly what happened to me in all three cases.

Accordingly I ignore seller feedback when looking at other peoples feedback.

Never be scared to stand up for yourself or to do what is fair by your standards.... chances are the other party hasn't got any..

That must be a real pisser ay. Innocently buying something from a so called honest vendor and it not turning up or finding it doesn’t work. That really sucks.

Hypothetically, It could be worse though. Imagine the following scenario for instance:

What if the item wasn't $31 and was say...er...$1895.00 and when it turned up after 9 weeks (and not 3 or 4 as promised) it was poorly designed , manufactured , not to specification and is basically fucking useless.

Imagine then, that when you raise the problem, the vendor gives you a line of bullshit about solutions and denies all responsibility for any of the problems with the product and blames you for the specification. You send the product back for checking but he still denies responsibility and basically covers up and lies about the cause. He has your $1895 and you, as a paid up customer, can go and get fucked. He only offers a replacement which you have to pay for. That would be worrying... and rather unfair don’t you think ?.

Being desperate to salvage something from the total loss situation you face without taking legal action, imagine you eventually agree to pay a further $800 to get a replacement product that actually does what was promised in the first place on condition the vendor delivers when he says he will (4-6 weeks) so you could use it when you want it. Maybe you can get a few bucks back by selling the first item. So, knowing you’re being screwed, you suck it up and pay up and wait.....

When 6 weeks pass you ask what’s happening and get told "It will arrive when it arrives and we will do no more for you" .... so you wait some more and then some more and then some more.

At 10 weeks you get pissed off being screwed by him and give him 2 weeks notice of cancellation if he doesn't deliver. Nothing happens. At 12 weeks you cancel the order and get your money back from Visa and take the bastard to court to recover the cost of the first product which is about as much use as a chocolate teapot or to get a product which will actually do what was promised.

In the meantime the vendor himself writes defamatory remarks about you on a well known internet forum whilst daily portraying himself as a whiter-than-white honest purveyor of fine wares to all enthusiasts. Slagging off competitors and promoting his own products at every turn. It seems whilst you’re a prospective customer, you’re a mate, a bro, a dude and a fellow enthusiast. Once you become one of his legion of dis-satisfied, pissed off customers you are a nothing but an irritation to be abused publicly and dealt with by contempt. His high pretence to customer service only goes as far as the cash hitting his bank account. After that, his interest in you extends only as far as future sales, not in fixing his fuck ups.

Meanwhile, he quietly convinces his bank to give him back the $800 and attends the court hearing and says nothing about it. The court rightly orders him to swap the poorly designed and manufactured product he supplied in the first place for something less defective free of charge. So there is some justice then…..

But he knows he still has the $800. He just has to stay quiet about it. Just imagine the smug feeling he has. Probably the same sort of achievement a pick pocket feels when lifting your wallet from your pocket.

A few weeks after the swap takes place, your own bank comes back and asks you for the $800 which has been debited from them by his bank... and when you take that matter up with the vendor himself, guess what ? He denies all knowledge of it. So, you will probably have to drag his ass back in to court again to enforce the order you got and prove the truth….. again. That is what it takes it seems.

So, you might advise anyone thinking of buying from a trader like him to go to a local, reputable shop with decent customer service and buy a product made by an actual reputable brand. A product which has a meaningful guarantee, is available immediately, is value for money, has no design or manufacture faults, and can be used straight away. In other words, everything which buying a product from a poxy online trader is not. That is something which you might deeply regret you should have and could have done in the first place.

You might avoid any dealings with such a vendor in future and surely it is fair to warn fellow enthusiasts about him and the way he operates as you might with any dodgy brand. ….. hypothetically of course.

Kharma... great concept, but not enough of it about.

Since no settlement was reached i feel its appropriate to restore my post

So this is where I wrote at the time but removed in the cause of world peace

But clearly hostilities were still open even after the court case

And was further discussed here until it was posted to PD by a supporting moderator (http://www.kiwibiker.co.nz/forums/showthread.php/144797-New-leathers.-BE-WARNED?p=1130212745#post1130212745)

Hehehehehe I loved the gay anime theme to that thread. All KB threads should be like that. Especially the ones relating to waving, whiskey, religion and politics.

Why don't you pay him 'a little visit'? As you said it is only $31 but I for one would make the trip.

Somebody obviously did if he was in hospital!
