View Full Version : Give way rule for parking spaces?

Trying to find a car park in town at 1:30 probably wasn't the brightest idea id ever had, but I needed to go to the bank.
Driving down the main road, the're angled carparks on each side. I indicate to turn into one on my left, at the same time as a falcon heading in the opposite direction to me indicates that he wants the same park on my side of the road, I drive into the space, he proceeds to go ape shit. I couldn't be bothered arguing with him, so just let him have the space after he held up both lanes of traffic for 30 odd seconds while we discussed the matter..
Who is at fault here? Does the new give way rule give me, or him right of way? or is it just down to courtesy? or whoever has the biggest car ?, who knows the most swear words??

Whoever gives in doesn't get the park, simple as that. You got owned lol.
Maybe if I wasn't recovering from a broken leg I may have been more inclined to stand my ground, hard to hold any sort of presence while still using crutches. He probably would have got a kick out bullying a cripple.

I thought turning right into an angle park was supposed to be a "bad thing".
(Possibly because it's a bit like doing a U-turn then parking, due to the angle?)
Dunno...
If it's legal at all, I'd say (semi educated guess) the left turner has right of way.

Then shouldn't you have been using a disabled parking spot?

You had the right of way,both in law an that other thing so many forget about today.
I had a similar thing out side the Howick gun shop many years ago,some arse council worker dived in front an cut me off to get into the space.
I just drove another 50 meters up to the next space,but he had seen the dark look on my face when I realised what he'd just done.
Then when I got out of my car an walked past him carrying my .308 he suddenly got all humble and actually said "oh sorry mate"
I just smiled an carried on into the shop.:weird:

It's a courtesy issue, there's no actual legislation covering this as a give way rule. However, according to NZTA, Section 8 of the Land Transport Act 1998 which deals with driving carelessly or without reasonable consideration would apply.

Whoever has the worst paint job gets the park IMO.
If someone with a nice shiny paint job snakes a park from me they can expect it to have a little less paint when they get back than when they left it.

LOL. I hope you're joking cos if I ever catch anyone removing paint from my car or bike, they'll have less teeth than before they acted so cowardly :niceone:

It's NOT an intersection ... so the give way doesn't apply. You could use the new rule as a guide ... but first in first served.

Sorry mon Id argue the toss on that one.The standard give way rule now is that left turn traffic has right of way. So if it was an accident then the guy turning right would have failed to give way to the guy turning left

I thought along those lines originally FROSTY but when I called NZTA about the chip seal problems I'd been hearing about, I asked them about this as well.
