Hey Guys,
Just wanting your opinion on an incident had tonight.
I was driving down a road, coming up to a roundabout, with my lights on and everything.
Just as I get to the roundabout car pulls out very fast from my right (so I'm supposed to give way)
I'm not too sure whether she saw me coming because she slowed right down as we nearly hit each other.
SO I as soon as I saw her pull out to the roundabout I slowed down - Brakes on, as this happened I slipped off my Vespa, and causing damage to my bike as well as my phone in my pocket. She then got out (her car was in front of my stopping lane for the roundabout) and asked if I was alright. I didn't say anything - pissed at her but gave her the thumbs up as I picked up my scooter to make way for the traffic coming behind me. She took off not giving me any details. A witness noted down her plate number so I have that.

I know I am supposed to give way to the right, but it didn't seem like she looked before she took off.

Am I completely in the wrong or is she to blame as well, I want to contact the police.

I am not insured.

Let me know what you guys think.

Cheers

Then you already know the answer to your question. Sorry to be harsh, but imo, ride defensively or not at all.

To be fair I didn't really have enough time to give way- by the time I saw her pulling out I slammed the brakes...
but thank you for your opinion.

You only didn't have enough time because you weren't riding defensively...

Certainly.

Get off the road until you learn basic road rules. And get some insurance.

Sorry dude, you're in the wrong. You have to give way to people approaching from your right. No ifs, ands or buts. As said, give way means be ready to give way to traffic, not travel so fast that you can't. I'm sure the cops would tell you the same. At least 3rd party insurance would be a good idea but obviously not mandatory in NZ

So you came up to the round about without being able to stop safely if you had to give way?

Always approach round abouts expecting that someone is going to blow through it at 50kmh because quite often people do (pet hate).

Never asume any other road user will see you.....you failed to stop safely which is careless driving/riding on your behalf and is a traffic offense...

Lucky for you in this case its just things that were damaged,

Take advice and learn the road rules and how to stay safe on the road, get insurance it will save alot of dramas later on.......

So it sounds like she had right of way, but slowed because she thought you weren't going to stop in time, you hit the brakes and binned it all by yourself.

At least she had the human decency to stop and check if you were ok, even though she had no legal obligation to do so, most people wouldn't.

To be fair ... at roundabouts you give way to the right. Stop before you enter the roundabout if you have to. You know you have to give way ... so treat the entrance of the roundabout as if a usual give way situation is in place. Slow down and be prepared to stop.

Go to the Police if you want ... but they can take "Failing to give way" seriously ...

Just out of curiosity
what would you tell the cops..?
I mean.....
what do you think this lady did wrong?

any other road rules you don't know about ?
Or know about but choose to ignore?

Forget about 3rd party......
You mind I take out a life insurance policy on you...?
sounds like a safe bet.....

Are you saying if you had been txting your phone would not have been damaged?

iYRe

actually, if you can prove you were already IN the roundabout before the car on the right entered, they are in the wrong. Its illegal to enter an intersection occupied by another vehicle.

Note I said _PROVE_.

Really?
Try this theory tomorrow morning at the Greenlane and Ellerslie/Penrose roundabouts and see how you get on.
You'll need video evidence for the "dodgy driver" thread.

iYRe
4th June 2012, 09:12
I did say "prove" and in some cases, you can not. Same with the Rosscommon Road roundabout. It is the law though. If you are already in an intersection, the person coming from the right has to give way.
The best evidence apart from video, is being hit in the rear right quarter.

Your point was that vehicles cannot ENTER an intersection (although we've got a discussion on a roundabout) if it is already occupied by a vehicle.
In the real world this doesn't work as with the two example I gave they are occupied by vehicles yet other vehicles continue to ENTER.
No-one is disputing the give way rule, but thats not the example you presented.

Give way, and Enter are two separate issues.

iYRe
4th June 2012, 09:39
No, the rule applies to every intersection, roundabout or not, its just whether you can prove that you were rightfully in the intersection before the other vehicle.

Its the law.. proving it is a whole different story though (i know, someone once hit me in a roundabout and this what they were prosecuted on)

So let me get this straight, Tomorrow morning when I (legally) enter Greenlane roundabout no-one else can cross the give way lines at their entrance to the roundabout until I exit.
The whole roundabout is "mine" because no-one else can (legally) enter.

Awesome!

The fact you slipped off your Vespa would indicate that your emergency braking technique needs looking at too.

No.. that is not what I said.

Dont be daft.

They are not allowed to enter the piece of road you have legally occupied, regardless of whether they are on the right or not. The _intersection_ on a large roundabout like that, would technically be the piece of road (roundabout) and the giveway intersection. The WHOLE roundabout isnt necessarily an intersection, there can be quite large stretches of "un-intersected" bits of road. Comprendes?

I understand what you're saying but why belabour a point which is a completely different scenario to the OP's? Obvious if you're already going around the roundabout and the person behind you hits you, they're at fault. The OP failed to give way - he's at fault, end of story.

By the sounds of things he grabbed the brakes and slid off the thing... being a Vespa he might off fallen into the step-thru bit... mental image is still funny as fuck :D

yeah dont call the cops, and hope no one else did, and either make sure you can stop in the clear distance in front of you, or else stop caning the poor little vespa and get something with bigger wheels and brakes. ;)

50 km/h on a vespa blowing through a give way sign at a roundabout is pretty crazy!

I didn't think i would ever say this to a scooter lol but slow down brah! If you dont got time to react coming into an intersection you are going to fast.......ahahahah:lol: sorry but your up shit creek and you aint got a paddle.....
I do love however at the eagerness of those who told him to get off the road. Like when they were young they never ever ever came into an intersection too hot because at birth they were the best most adherent road users of all time.

Visibillty approaching round-a-bouts is always unimpeded, because of where they are situated (in the middle of an intersection)
You give way to all traffic coming at you from your right, you should have that well sorted before entering a round-a-bout.
Your fault, no biggie.

As your speed increases, you get to the point where relative time slows and for most purposes the traffic moves so slow as to be considered stationary. However, for this you need skill, balls, boogie, and sticky tires, and a powerful intuition, and you had better be right - every time. :devil2:

if you get to 88mph time starts to go backwards so if you stuff it up, you get a 2nd chance.
