Got myself in a spot of bother today and all things considered cant for the life of me work out why :gob: Day kicked off with a few household duties whilst the Mrs had a sleep in (her birthday yesterday) and plan was to take her out for lunch/shopping blah blah blah.Long story short we set off and upon reaching the desired one way street (old part of town in Ommers) i head down it to turn the first right hand corner to find a bloody great dump truck parked up blocking the whole street...bloke driving it had just got out and said "sorry mate will be about 5 minutes etc " so had room to back up and go back up the one way street to find 2 blokes walking down it i stop wave them to cross and one of em walks up to my window and says "its a one way road" in an arrogant enough tone to make me a little pissed so reply "re the truck round the corner" only to get a gob full back so i stop get outta the car and attempt to explain again why the fuck (yep still angry" i am doing what i am doing:brick: next thing this guys boyfriends in my face so i give the bloke a tap on the chin and he falls over,by this stage its a fucking public display,embarrassing beyond belief and am thinking fuck this so get back in the car just in time for the law to turn up:oi-grr: So despite numerous written statements from those that were there laying out the facts ie the boyfriend got all hands on i find myself heading to court:mad::pinch:Copper told me he was simply doing his job but bugger me this is really fucked up,could possibly understand if i was a young fella but jesus H at my age :yawn: Cop didnt want a bar of any explanation seemed it was all about the knock on the chin no matter what caused it to happen:wacko: Cant imagine anyone reading this would have done any different ie a guy runs up into your face grabs you round your shirt collar yelling so hard his disgusting spit is hitting your face.

Well, that is why it goes to court - as described - I see it as one person trying to intimidate another, mouthing off etc. and the other person making it physical, since it was our fellow poster who crossed the line to take it from verbal to physical, I see him as at fault.

Others have different opinions and are welcome to them.

It would be a different story (for me) if our poster said that it looked like the other guy was going to attack him or had laid a hand on him/pushed him etc. - but that isn't how he described it, just that someone was in his face.

Theres a few paths to go down a) deny deny deny b) say sorry and take it on the chin c) self defence.
I'd be pulling all your own witness statements (will need to be affidavitised for jews) and even character references ("he's a kitten and would never hit someone unless scared for his life") - do not, repeat, DO NOT trust that the cops has done any kind of job in taking statements that do anything other than back up himself.

Back in the day (also in Oamaru) the driver of a car I was in got smacked through the open drivers window of the car by some guys who we had some history with. That guy somehow got off with self-defence. I guess it comes down to who tells the better story.

The only reason someone gets out of their car in this sort of scenario is when they are a bad tempered shit head that want's to intimidate someone or to have a fight. You lost your temper and the case when you got out of the car. No excuse for it other than to provoke an attack. The judge would probably make concessions for a young person who makes a bad choice, but less so for a grown up who should know better. You should probably go to jail.

I'm in and out of court all the time with work - best evidence helps so you need to get yours to counter the two pretty boys matching story.

I have done some dumb shit like this once in a while, some people seem to spend their lives walking around asking for a smack, but are surprised when it arrives. Luckily for me it never ended up with the law involved.
In hindsight staying in the car and carrying on would have been the smart option, but as they say hindsight is 20/20.
Get a lawyer and as long as no serious damage occurred, hopefully you get a sympathetic hearing.

It was so long ago and I wasn't there, but suffice so say, the one with the attitude and gob online, was less attitude and gob in real life, as is normally the case. I know two people that have posted in this thread that were there.

Ended up seeing a lawyer first thing this morning,long story short he reckons if i can provide him with written statements (more the better) from people there re the guys mate grabbing me then he believes the coppers will see sense and we may not end up in court.Ive managed to get 3 people willing to do so inclusive of a lady working in a shop directly in front of where this shit took place,as someone here pointed out sure i shouldnt have lost my rag and punched the guy but as the lawyer pointed out if someone rushes across a street to grab you round the neck (area) you have every right to fear for your own safety and act accordingly,another point he made was up until then this had been a verbal exchange between two people then for all intent and purpose a 3rd person raised the bar by making it physical so if witness statements show that then it was the 3rd party that should be getting done for assault not me,regardless of how it worked out for him...will see what comes of it,lawyers confident.

Both are good blokes and helped a lot of budding SATNR's with advice and demonstrations.

Yeah, 13.89 but it's so 'long legged' that it only used 1st & 2nd gear.

Lower geared dif would see it into the 12's no sweat.

(Gas mileage might suffer though!)
