View Full Version : First of the "three strikes" warnings for violent offenders given...

WTF?
http://www.stuff.co.nz/national/crime/86004956/munesh-kumar-jailed-for-prolonged-assault-on-woman

Kumar pleaded guilty to aggravated burglary, intentionally causing grievous bodily harm, threatening to kill, assault with a weapon, assaulting a woman, and intimidation.

Judge Paul Kellar suppressed the victim's name and read Kumar the first of the three strike warnings for violent offenders.

The judge said the unprovoked attack was prolonged, painful, and extremely frightening, and the victim suffered long term emotional effects.

It was premeditated offending, and Kumar had planned for her to suffer a prolonged torture.

He said Kumar's ingrained views from his upbringing led to the offending.

So does he get another "go" before getting his third strike? What unfortunate victim has to be his second or third before ...well, before what? Can anyone explain what the consequences are if you're only a "first or second strike" offender of shit like this?

What the fuck does he have to do to earn the next 2 strikes?

Banditbandit
2nd November 2016, 15:29
he got 10 years in prison, within a non-parole period of five years,

The thrre strikes rule means if he offends again - after he gets out - then the next sentence will be harsher ..

hardly "another go" ... he'll be inside for at least five years - and probably longer ...

Likely, it was a close family member he dealt to - on a 'cultural honour' basis, since he didn't rape her..

Any short time will be predicated on expressed 'remorse' & undertakings not to re-offend..

& is that convict who attacked the female District Court Judge - with a machete - out yet?

Agreed. And it does happen sometimes. Somebody gets a perk flight to Bangaladesh or wherever as escort. If there is anyone on earth who actually thinks a flight to Bangladesh is a perk?

I may be wrong, (although I've been a KB'r for some time), but Wasn't that law changed a while back to mean that an offender has to be found guilty of the SAME offence 3 times for the 3 strikes crap to apply?.

You can read about it here ...

An "Interesting" comment in Stuff.co.nz ...

Stuff.co.nz understands at least two people have been eligible for third strikes, but judges decided serving a maximum sentence without parole would be manifestly unjust.

http://www.stuff.co.nz/national/politics/69006542/threestrikes-law-changes-unlikely-after-five-years

Labour Party justice spokesperson Jacinda Ardern said she did not accept figures showed the bill worked, and that more specific research should be done.

Labour wanted the law gone, as it took away judges' power to look at the circumstances around an offence, with the party wanting to put more focus on helping offenders turn away from crime, she said.

More emphasis on programmes for young offenders and prisoners was a way that could be done.

"You have got to change people's desire to offend in the first place, or their circumstances," Ardern said.

"Nationally, 5378 first strikes and 76 second strikes have been given"

That looks like it's working. We already have a stressed justice system and anything that keeps offending (and reoffending) down has some social benefit.

5302 are still awaiting release from strike one.

And with criminal convictions ... the countries he would be allowed into ... would be very limited.

1, He's unlikely to be so 'culturally compelled' if he was born here, or in Fiji..

2, Have the citizenship laws changed?
I recall that the woman who murdered Doug Gardner (& ironically buried him in their garden),
was English by birth, but having taken up NZ citizenship, she could not be deported back to Pomgolia,
- after serving her sentence.

Other countries would ( & do) strip such serious convicts of acquired citizenship, & deport them.

America will take your citizenship if you get pinged fibbing on your paperwork. Otherwise it is off to jail you go just like any other citizen.

Yeah, & when you think you are due for release for time served, its off to a deportation detention centre..

I wonder if Barry will presidentially pardon Hilary in advance - before his time in office is done..

Yep.. some old school Nazis were stripped of their US citizenship, & sent back to Europe/Israel..
Whereas moon rocket man Dr von Braun, despite being an SS officer with a 'dirty' history, kept
his, & got a presidential citation to ( jack) boot, even in the face of Jewish-lobby pressure..

That's why I wrote "political/diplomatic" - same applies to the Saudis flown out straight after 9/11,
when no 'civilian' flights were permitted, & yet they were not even interviewed by the FBI, either...

Without Wernher, the yanks would never have made it to the moon!

Personally, I think they should have used jews instead of perfectly good monkeys and dogs when testing the early ( pre gemini ) space rockets.

not a fine, thank christ. reparation.

150 hours (while not hard labour) is still a months worth of work... for someone gainfully employed that would be a huge pita.

but still. vote akzle. the guy driving poorly would have been shot previously, so this would never have happened.

Not quite a three strikes but looks like this chap got this months special deal on concurrent sentencing (doesn't say but I assume).....

http://www.nzherald.co.nz/nz/news/article.cfm?c_id=1&objectid=11810673

"....jailed him for two years, 11 months and disqualified him from driving for three years.

He pleaded guilty to six charges of reckless use causing injury - an offence punishable by up to five years imprisonment.

Also covered by the sentence were unrelated offences, many while on bail, of assault, escaping custody, threatening behaviour and twice failing to attend court.

But the crash was "without doubt" the most serious, Judge Cathcart said."
