if the job requires, you can obtain an exemption under special conditions. And I think the whole list of exemptions can fit on your little toe nail. However, I don't want to see it. What sucks, is that TM is banned at work, so I can't see this link..
I'll check tonight, and probably see 214 unanswered questions on the whole '400-on-a-restricted' issue.. I do think that it should be ok to graduate to a 400 on a restricted tho. Make the jump to bigger bikes a bit easier when you obtain your full..

i completely understand what you are saying, but what i'm saying is that a cbr is only 150cc over the limit whereas a busa is 1050cc over the limit, so it's more of a slight bending of the rules than a complete and utter idiotic decision to let someone ride a busa when they aren't qualified

Small point here...not the Govt (they wouldn't know the diff on cc size) but LTSA (who would). Have heard of restricted getting exemptions for a 400 but good excuses needed. Doubt a learner would though (and shouldn't either IMHO).

You can apply to the LTSA for an exemption from almost all the graduated licensing stuff. Over 250cc bike, sit the test immediately without waiting, etc.
But - it's NOT automatic. You have to send in a form (get it from AA or VTNZ). Provide lots of info on why you are special , and should be excused from <whatever> You need to have GOOD reasons AND be able to prove them. And the "bigger" the exception the less likely.
So they MIGHT approve a 400 for a restricted rider, if he was very big/tall, had to ride long distances TO WORK (not just for blatting) - etc . But probably WOULDN'T approve a GSXR1100 for the same reasons. And they do have people who know what's what. And (in the case of a capacity exemption) it would be for a specific bike, and you'd have to carry it and produce it if you were stopped. No getting an exemption for a 350 BSA Sidevalve (they approved that one - argument was it was slower and safer than any modern 250, and the guy was a vintage nut) , then jumping on a Hayabusa.
Same rules for cars by the way. But - you either have to be very good at lying , or have a genuine good reason. Just "cos I want to" is not a good reason.
The fundamental criterion is that what you want must not reduce safety.
EDIT. Costs about $20 or so, and you don't get a refund if they so no. Which they usually do. BTW, it appears that you have a much better chance if you are over 25 - unbder 25 seems to be almost automatic "no". But, having said that, prolly someone under 25 has been lucky.

I think you'd have to argue (and try to prove) that you were so big that it was actually a safety hazard . Probably produce pictures showing how you had to double up, couldn't reach controls whatever, on a selection of bikes.Or maybe that you weighed so much that you would exceed the rated weight limits for the bike or tyres - I imagine that would be VERY big. Just "looking silly" wouldn't work
EDIT: Is 5:30 illegal? I thought the curfew was 10pm to 5 am - but I can't be bothered looking it up.

The "outside hours" exemptions are, I believe , the easiest to get. Just need a supporting letter from an employer. But it is only an exemption to ride to and from work I think - by the "shortest practical route". Like a "work licence" that you can apply for if you get disqualified. Get caught outside the "direct route" and you get done. And , once again, have to carry the exemption letter to produce if need be

As Ixion said, you can try for an exemption on basically any restriction on any license. Handled on a case by case basis. The form is called a "Application for an Exemption", form DL4
Was researching on my learners, managed to get quite far up the ltsa ladder to someone in Christchurch (I believe they manage all the applications). Said, on a learner, that it is very unlikely, only very exceptional circumstances.
Exemptions to a driver licensing requirement can only be granted in very special circumstances. If it is considered that granting an exemption will make you or other road users less safe, the application must be declined.
There are also other factors that must be taken into account when considering that the risk will not be increased by granting an exemption. Additional factors that must be considered are:
- the requirement for which you want an exemption has been mostly complied with, making further (complete) compliance unnecessary; or
- The alternative yuo are asking for is just as effective or more effective than complying with the requirement itself; or
- The requirement is clearly unreasonable or inappropriate in your particular case; or
- Events have occured that make the requirement unnecessary or inappropriate in your particular case.

We just don't like the fact you state you can ride it on a restricted. The law is clear that 250cc is the maximum, unless you have an exemption.
Not everyone can get one, the evidence has to be clear that you are just as safe, there is a need for it etc etc.
Wouldn't mind some more details on your exemption experience, as I will be heading in that direction in a week or so...

on the topic of exemptions I decided to go up to AA and pick up a form so I can ride past 10 for work purposes. ive scanned it and attached it for anyones perusal (dont try printing it and taking it in. its littered with cc copies and crap)

it's all very well making light of getting an exemption to ride a cbr400 legally on your restricted, but using that as the main selling point for the bike is just bullshit buddy. Exemptions are hard to get unless you're "oversize".
Wouldn't you be pissed if you bought a bike that you were told you could ride legally just by filling out an easy little form, then only have a 1% chance of that form getting approved? I know I would.

Weight or size did not come into the equation.
I explained that i was currently riding a 400cc motorbike to polytech every day.
We talked about the parking at tech and how it was a real problem. After her advise to apply i went to local AA and filled in form with Details of bike and main use.
About a week later i recieved a letter in the mail and a new licence with Indorsment note on back.
Im not trying to led people the wrong way and hopefully will sell to a full licenced rider anyway.
THis is a sick bike and im thinking about saving the hastle and keeping it.
Its cracks me up at how little it takes to get the Forum peeps upset.

OK so Ive never been in the 250cc market, thanks for that, I stand corrected. But never would have thought there was actually a shortage. We were actually discussing this for our soon to be 15yr old the other night. The fact that, he can get his bike learners a go ride without a fully licenced rider(driver) with him, but in a car has to wait another six months for that priviidge.

I know that i never had to even pull my exemption out!!!!
I was pulled over a few times, only for speeding once, never was i asked about size of bike or questioned about conditions.
I'm sure that there is a bunch of riders out there riding 400's on Restricted.
If you look at mine it has no cc ratings, and you can only really tell if you look at rego.
And even then the cop has got to really have it in for ya to slap dirty fine on ya.
SPEEDING IS A DIFFERENT STORY, you may have to write a good letter to get off those.

i was granted an exemption to ride between the time of midnight and 12.30am due to work. i had to provide a letter from my supervisor stating my hours of work. it was granted, no worries. honestly, i find midnight a safer time to ride than say 9pm....no traffic anywhere.

i rode a gpz400 without a lisence and have a 650 on my learners :eek5: :stupid: so it would be a bit hypocritical of me im sorry :bleh:

AS a general rule i always challenge fines, dont we all?
I was confident with this one as ive got a mirrored visor and there is not really any identification other than my custom paint work.
Anyway i wrote in for photo and to deny, but after recieving the photo i decided that rather than take it any further i would wear the $80 fine and be thankfull that i jumped on the breaks when i did.
Also being a camera there was no Demerit points and was only munituary.

no, what I meant was the CBR400 and CBR250 are almost the same physically, it's just one has a 250cc engine, the other has a 400cc engine.. not a great deal in it.. just wondered that's all..
And with no plate on the front of the bike, and no way (from what I know) of the cops able to trace a vehicle back to the owner cos it's a specific colour, did the van dude swing round and get your rego then?

we'll all be laughing so, so hard when that photo's presented to the pollies as a supporting reason for bikes being required to wear front numberplates.
think a bit harder, back off in future, and just be grateful when you do actually fail to notice a camera and the snap doesn't result in a ticket.

Nah man i underestimated those bike and they do 100 easy, but then again i have a skinny arse, and the bike didnt feel like it was towing a ford ;)

I finished uni about 4 months ago. I just have to print & resubmit my thesis and then I can graduate (again). But I've got meself a job at Tait Electronics being an embedded software engineer (programming radios like the police/fire bridage etc use).
Can't say I reconise the bike though.

Whoops... must remember that. Seems from where I am, everyones got a bit of everything... some Tait, some from the darkside (Motorola) and maybe even a few Kenwoods for good measure.

Hmm... you have given me a good puzzle! The only person that I've meet at tait who is anywhere as tall as me is my boss and hes slightly taller (somewhere around 6'9" I think). Everyone else would be lucky to push the 6 foot barrier...

The "outside hours" exemptions are, I believe , the easiest to get. Just need a supporting letter from an employer. But it is only an exemption to ride to and from work I think - by the "shortest practical route". Like a "work licence" that you can apply for if you get disqualified. Get caught outside the "direct route" and you get done. And , once again, have to carry the exemption letter to produce if need be
Local cops here don't bother with getting the exemption, if you're in a work uniform and say you're on your way home they let you go free. Also worked good for me a couple of times when i wasn't in uniform, probably coz at bp we had to give cops free coffee.
