Update: It was my brother Jamezo. As far as we know he's only broken his wrist. He was well enough to text us that he'd gone down again :(
I'll try and keep him informed of what you guys say.

Thanks all you guys and guy-ettes.
I'm back home now, after getting plastered up. Damage is a not-to-badly broken lower radius. Wrist thingy.
Was splitting down wellington motorway, mild differential, about 70K. Dude in front (courier, buhhhhh) pulls from the right to the left just as I approach him. Didn't even confirmicate.
On the anchors, but obviously not in time, collected his left corner, went down like a sack of potatoes. Somersaults etc.
Bike seemed alright. Bunged front fairing (just exacerbated what was already cracked), bent bar end. Didn't get much of a chance to examine it.
Courier dude got a tail light, scrape, and mirror. Bastard.
All this is supposedly my fault cause I was behind and was splitting (though was very explicit with the Officer that I was on the RHS of the left lane, as I was). Might be facing 'following too closely', fuck that, I've got enough on my plate!
Cheers guys,
James

Edit you were in the right he was in the wrong, too close in the other lane he turned into without indicating? Too close only includes those vehicles in your lane does it not!?

Mate, well done for getting your story straight regarding being in the other lane.
Technically he moved into your lane without indicating. Even if they do throw a following too close at you it SHOULD be in relation to the car in your lane. You can't follow too close to a car that is in another lane........ ie. the courier should be liable for damages...
I'm sure we'll all be very interested to find out how this turns out.
Glad you are (reasonably) ok.

Trust the pain killers are working well. Let the bones knit, do the physio and you'll be fine.
Hope that you can get the business with the courier sorted. From what you've described it may be a case where both parties have to share a degree of blame, although changing lanes without indicating or checking is a definite no no.
Oh the joys of biking.

Erk. Come back after 4 hours at hospital.
Additional fracture at the top of my forearm where there was a plate. Cracked halfway through my ulna where a screw sat.
In a full arm cast, trying to get this fixed without more surgery.
Interesting experience: Manipulating a fractured wrist that has been displaced half a centimetre back into position.
Not going to bother with meds, they seem to just make the pain worse when you don't take them.
Investigation proceeding. Dude's being a prick. Says he did indicate (was that before or after a bike scraped down your side?.......)

28th June 2006, 18:06
People seem to think that indicating means they can do what they like. Indicating is just that, indicating!! They still need to look to make sure there's no traffic coming along!!! Bloddy twat!! Same excuse from the prick who knocked me over 2 weeks ago! "I indicated", he said... big, fat, hairy deal!! You still came out into traffic in front of me, you prick!
I'm getting increasingly bitter at cagers even though I spend as much time in one as I do on a bike, and my wife and most people I know drive 'em. What's happening to me!??!

Jamezo that sucks dude, so it was you who gave me a long trip home the other night. Wondered if it was a crew member.
Yeah the courier van is definately in the wrong mate, pulling into your lane. Stick to your guns, be beligerent, firm but not an asshole and you'll come out on top.

That's what I would think - because otherwise, you could be the only vehicle in the outside lane with a huge queue of vehicles in the inside lane and it would be YOUR fault if one of them suddenly decided to move into the outside lane without indicating and you hit them. I think the cop is trying one on if he thinks you were solely to blame here. Strange, because they usually love throwing the book at couriers. Maybe the cop hates bikers more than couriers?

Agree with Squeak & Beemer...have to add that if said biker is young then cops seem to think 'No matter what, he is at fault'. Bad luck & hope it all comes right quickly

I've been scratching my head on this one.... Did the courier actually change lane? If so that would imply that you were not next to another car, otherwise you would have been pushed into the car you were passing.
So, if you weren't next to a car at the time of the incident, then you weren't lane splitting - you were in a gap in your lane, albeit positioned on the right hand side of the lane.....
Sounds to me you were technically doing nothing wrong. Unfortunately it's very easy to type this into a web forum, but another matter convincing the authorities. Good luck, and bummer about the "extra" injuries. Please do let us know how you get on.

Yeah, I was a few metres in front of a car in the left lane that I had passed. As far as I can gather, I was 100% legal by being in that space at that time.
I'm in correspondence with the investigating officer. I am NOT going to let myself be jerked around by this driver.
