Fark!
OK is was bad enough that I binned my ZX10R at the pukekohe track day, 3 weeks ago, star insurance were champs getting me a new ride...and i binned that one yesterday!
They are not going to be happy with me!
I was riding with 3 other bikes down pukekawa way today, came around this sweet cambered corner, and hello gravel, low sided into the ditch. One of the other guys was behind me he locked up and high sided. it wasn't pretty!
We practically dropped into a farmers lap who was fixing the fence from a car accident two days ago on the same patch.
Where were the fuckin road signs? Why didn't the council sweep it after the last accident?
Cops, ambo & fire turned up and got shit sorted and cleaned the road.
Meanwhile, Darryl has broken collarbone in 3 places, i have 2 cracked ribs and 2 sprained thumbs.
I got home tonight to find that i had 1/2 a cup of gravel in my boots, funny, i didn't notice it till then!
Revit Leathers: two thumbs up!
Carbon Knuckled Gloves: the shit!
HJC Helmet: took a couple of good whacks to the head...it was solid!
Gotta love good protection!
Thanks to Darryls mates for dropping my bike home, i'll get you beers...as promised!

Ouch, Bummer! Glad injuries weren't more serious!
Someone should get a rocket up the bum for that! You've got enough witnesses in the Police and the farmer to go the Council and your insurance company will hopefully take the circumstances into account!
Broken ribs hurt! I know! hope you both felling better quick.

3rd time lucky... my flatmate has a shitty street magic, i might throw on the leathers and go crash it down the street just to get it over with!
i figure it's bad luck to polish your bike too, both times i've binned i had them in showroom condition the night before...never again!
and yeah i'm going to chase up the council, slack bastards!

It is about time those responsible for the roads were held responsible. They put up road signs to protect the roads not the users and motorcycles don't seem to count as users anyway.
I wonder what would happen if we all complained to our local council everytime we found poor maintenance or lack of signs where they had tossed some loose chip? Is this worth thinking about.

That really has to suck! I'm sure that you would have some claim on the roading authority, but it will probably take the insurance co to have the clout needed.
In the meantime, you concentrate on getting better.

nice to see the subframe so bent the zx10 06's are very flimsy in the rear. and the mg covers on the engine get eaten up real ****in easy... gravel hitting it chips bits off it. plastic bikes these days eh... that why i want an older mid 90's srad/cbr for stunting. real frames real bikes.

There is a case where a council was successfully sued over road works signage, or rather lack there of.
Shame it doesn't happen more often.

Don't envy you but let us know what happens.
Well at least you're still OK and was able to walk away from it. Been there before once or twice:shutup: But bikes can be repaired or replaced.

Keep on top of Star...if they were one of the big normal insurance companies I would expect (being a pessimistic cynical prick – about insurance companies anyway) that they may put chasing a council or road contractor up for liability in the “too hard basket” It may very well cost more to chase them than the claim is worth. I would then cynically expect an insurance company to lay blame on you (so they can raise your premiums/cancel no claims discount etc. or worst case cancelling the insurance)
I’m pretty confident Star won’t do that – they may try it on just to see if you would accept it without fuss But IMO it would be pretty bloody stupid of them with all the good PR they have got out of you from your Puke crash. They do seem to try really hard to do right by motorcyclists…I swapped my insurance to Star because of that (and your first bin - track day insurance!!!), and I’m sure plenty of people you and I have talked to recently have done the same. Getting a replacement bike in six days is bloody impressive. You should ask them if they can beat that this time!!!
BTW, when I changed to Star I was impressed that when I called up to change they made sure I knew that some insurance companies can charge up to $200 to cancel a policy. They wouldn’t sign me up until I found out my previous company wouldn’t!
I hope Star insurance can keep their deserved reputation,

Sorry to hear and hope the injuries heal quick.
Chris Parkin, A wgtn City Councillor sucessfully took the (Wairarapa or there-abouts?) Council to court over his similar crash caused by no warning signs on a bend under repair. The council initially denied responsibility because they used Contractors. But the Judge threw that out saying, (IIRC) they could not delegate out their responsibility for maintaining our roads and the resultant safety of the users.
Make sure you get all the Police details/records as evidence.

Mate.... I don't believe it, not again, but then if it was on SH22 I'm not too surprised about the gravel on the road. Still bad luck though.
Hope Star Insurance look after you as well this time. Even I... who have been with the same insurance company for 25 years, have considered changing my bike insurance to Star because of your last experience. I'll wait to see how you go this time!!!
Hope the injuries heal up quick... and hopefully see you on a new bike at the next trackday!!

Riding through Porters pass to Aurthers pass a few weekends back and without warning on a reasonably fast corner there was gravel and grit all over the road, managed to get my bike upright as quick as I could before before a big slide into a ditch,had to use most of the road lucky road was clear, I can only assume Fulton Hogan know something about how the grit got onto the road with no warnings.

Sorry to hear about your bin man.
A friend of mine took on one of the local firms contracted by council to repair roads when he came round a sweeping bend with no warning signs and there was gravel and shingle all over the road. He could not avoid or stop in time and slid out on the shingle. He took them on in court after their lame excuses didn't wash with him. It cost him (in insurance) and the whole accident was not his fault.
It's not your fault from your description so someone is responsible for your accident. It could have been avoided. People have been put at risk and now someone has injuries and their is property damage.

I agree with some of that and I don't think that the gripes here about loose metal are attempts to shirk our personal responsibility as riders. Well not from me anyway. The combination of less than careful riders (myself included on occasions) and less than careful roading contractors culminates in an accident (search the Dr James Reason model). Then it would be fair to say that some, perhaps punitive, learning should be brought upon the roading contractors as well as the riders. We pay rates and taxes and expect a reasonable return and duty of care for our money that is spent on roading. Just like we pay our insurers who ultimatly punish us for our own folly's. Loose metal left in the middle of a bend is just as slack as a (road)rider hitting the corner too hard with no room for error. When the two meet, chances are, your off....! Wouldn't part of our responsibility for our own actions be in eliminating our own risk? Pointing out road errors to the roading contractors is part of that. Eliminating risk.
There often is an attitude among riders that it is external factors and only external factors that cause us to crash and there is a reluctance to accept personal blame. It's part of being human by finding it difficult to accept our own weaknesses.

Council is responsible, but only if they know about it. If we advise them of poor maintenance or faults and they don't do anything about it then they can be held responsible. If no-one has informed the council of the fault then it is difficult to hold them responsible. Complaining to the council every time poor maintenance is found is the best thing you can do.

ok whoever the stms contractor was for the signage is the people to go...find out who repaired the road and who ommitted to leave sighs behind warning of loose metal...if they havnt done the job properly take them to task..its not the council, they sub contract the jobs , besides get in touch with LTNZ they are the ones who will get the ball rolling.
