Hi Guys & Gals

Am looking to locate our car somwhere on the North Shore:

Grey Subaru Legacy Sedan 1993 - SI3968.

Just hoping on the off chance that someone might have seen our car, but more importantly where it is living !

Basically lent it to a family member and he has been AWOL for a month and we are now receiving tickets in the mail etc. :(

We can't utilise the Police system as we lent it to him and Spotter won't list it because it is not technically "stolen".

We know from the Service Station drive-off forms that it is located in the Glenfield/Northcross/Mairangi Bay/Carlisle Rd Area on the Shore.

Stify and his brother are going to follow up on a couple of address leads tomorrow, but any other help would be much appreciated.

Please note that funds from the disposal of this vehicle (should we find it) will be going to the stify and gg racing fund and we will extend a finders fee of some description :)

Please don't approach anyone who is in or around the car if you happen to find it..... We need the element of suprise.

Well it used to, it may have deteriorated substantially since we last saw it.....
And to help with the bigger picture, you might want to imagine a couple of 30 year old ex Westie stoners driving....probably with some barely legal chickies in the back!

Without knowing the full story of "lending" the car... if it was lent to them for a week and has not been returned, two or three weeks or so later (for example...) they have "Converted" it for thier own use (same as stealing it...) and it is something they can be arrested for and the vehicle entered as "stolen."

They legally had it for the 1 week, with your permission, which is fine and dandy to all involved... after that, it is converted for their own use, without authority of the owner, which is an offence under the Crimes Act 1961.

well what a total fuck up, didn't find the car, the offender, got lost and a bad case of arse rash due to todays heat an lots of slow speed driveway perving(a couple of folks thought i was m/bike mormon), but on a positive note we ended up with a new set M3's on the bike instead, and they aren't too bad, bike feels like new again, so please keep ya eyes peeled, and i'll try and dig up a police five badge for information leading to stify getting some dosh back on the car to cover the new tyres

check the illegal drags tonight on quay st meeting point might see it down there, friday night ones were huge and *alot* of those sorta cars hang around there...
thrash the car get some tickets.. why not! that's why they'd be there.

We purchased it as an extra car to use when the weather was crappy and Mark didn't want to ride to work.

My brother was in a bind and we lent him the car "for a while" to use to get to his new job that I got him at my work.

After a small period of time my brother asked us if he could keep the car and he would make weekly payments and we agreed that this was okay, but with one strict proviso that if his situation changed (wasn't working at my work anymore) and he couldn't afford the $30.00 per week then he would return the car immediately.

We very obviously made a huge mistake and did not document this and have him sign an agreement to that effect. We didn't change the ownership because he hadn't "paid" for the car as such and we decided that with me seeing him daily we would change it once he had paid a reasonable amount.

Basically over 8 months he has only paid us $300.00. And he lost his job at my work too.

We have learnt our lesson in general and on a personal note this will be the first and last time we ever "assist" my brother ever. He is still my brother and my childrens uncle and for those reasons I will not cut him off because of this.

He has been AWOL for 2 months now (no family member has heard from him) with the car and we need to take action due to the fines that he is acruing.

Tell me if I am wrong Patrick, but I believe that we can't honestly report the car stolen can we? Advice I have received says that we can't.

2. tell the guy behind the counter "my car was stolen"

With complete respect: Because this is my preferred option and appreciate feedback;

When I am asked where my brother stole my vehicle from, the truthfull answer would be "we don't actually know physically where the vehicle was when it was stolen". (of course we know that my brother had the vehicle, we lent it to him)

I have discussed the situation with a recently released into the community Police Officer and he was clear that unless we had a signed agreement (in terms of returning the car on default) then the Police cannot help.

Hey Patrick thats good advice, but what if OG doesnt want to prgress the matter to the point of prosecution, could she list it as stoilen then dropp charges, sounds like we are talkin family here, no one really wants to bust their reletives..do they??

Absolutely agree and really wanted to clarify that once a complaint was laid with the police then the matter was usually seen through to its legal conclusion

And we realised that we could have probably "used" the system to get a result but that we would be required to see it through to it's conclusion which wouldn't be worth the wider family backlash.

I just wish that we had changed the ownership and taken that risk; then we wouldn't be having this drama, we would have just written it off as loss and down to experience.

We had not helped my brother like this before and we never will again, and when I get to talk to him he will understand this clearly and we will move on.

My kids love their Uncle and that is more important than $1800.00 (less $300.00 + the drama)

You could still change the ownership to his name?

I had a situation where I sold a car and the buyer never did his part of the ownership process. Ended up with the police on my doorstep one night coming to arrest me for me reckless driving.

Ended up having to do a retrospective change of ownership and sign a form that if I was ever caught with the vehicle all fines etc would be sort from me plus criminal charges for lying.

Might be worth looking in to it at your Post Office as he is technically buying it from you and take the loss on the chin. Has to be better than all the fines and pissed off gas station owners banging on your door

Tracking it down just based on a random sighting will be tricky, but with lots of KB eyes out you might find it.

Rack your brains... anywhere he might have another job, mates who might put him up, girlfriends name & address, favorite pub, favorite dope supplier, favorite supermarket - bottle shop on dole day...

If tickets are arriving addressed to you as the vehicle owner, you can make a statement identifying your brother as the driver, transferring the liability to him - maybe he will get unlucky at a checkpoint.

WOF and rego will run out too, so more chance he will be picked up at a checkpoint.

Good luck, look on the bright side, its a Subaru so it will break down soon.

As someone else has said try and deregister the car at keast the fines will then stop. And somthing that hasnt been mentioned is that there is a good chance that your brother is nolonger has the car and whoever does will have a issues if they happen to be in the same place at the same time as a cop.

Why do you care so much for someone who obviously doesnt give a crap about you?...I know hes family..., But as I understand it you entered into an agreement, be it verbal or written , it doesn't matter it is still legally binding, ....unless you or he was drunk at the time.

All you have to do is prove it...and as he has absconded with your vehicle , I don't think this is going to be very tough at all.....don't let crims get away with the small stuff ,cause its the bigger shit that comes along later thats harder to deal with...if you love your bro then a bit of loving corrective action is needed.... maybe a smack upside the back of the head will work.....l

thanks to everybody who offered to keep an eye out for our car, after a bit of outstanding detective work from girlygirl and a whole day off work for both of us, we found the car(although it's condition is nothing near it was when he took it- only three straight panels, fucked axles,tyres,electrics etc etc), and fuck was he a bit suprised when he opened his front door.....

now we just need to get the collection's people off our back for the debts he incured and give the car a full check over to decide if it's worth repairing and on selling, the whole "lets help out someone" will at the moment cost us aprox $2000.00 less anything we get for a fucked car(not counting any costs we may end up owning from the accidents he was at fault for)

oh well, shit happens- now the family bullshit to deal with, as no doubt it is all our fault he can't manage to keep a job and pay his bills.....

Glad to hear you have finally got your car back, albeit not in the same shape it was in when you lent it out.

Hope you still dont receive any more outstanding tickets or debts on the car, since it has been involved in a few dings over the past month or so.
