far to many loose ends for him to be found guilty....fathers incest, glasses lense etc

Sigh. There's always one.

Does seem that an injustice has been done, however, at end of day who really knows..................hopefully for all involved it will sort itself out..I guess if the matter is being re-visited there are some unanswered questions.

all I know is hes going to get a MASSIVE compo payout!

Let the uninformed masses vote. Let's face it - who out there knows all the relevant facts.

Or perhaps - (s)he with all the facts should simply speak! It'd save a lot of time and heartache.

I think hes Guilty, but thinkiong about that case with that lady who was jailed for killing her son on 20/20 last week maybe hes not,

Don't feel too strong on the subject as I don't know all the facts.

since when has KB ever been about making informed discions based on facts? Let the good times roll and vote what you think, sorta like a gamble - time will tell who was right.

far to many loose ends for him to be found guilty....fathers incest, glasses lense etc

which doesnt mean he IS innocent...it just means you think the jury should have found reasonable doubt....yes?

I have voted Guilty on this poll, becasue that is what I believe.

If I was on a jury I would have to vote Not Guilty, because there isn't sufficient evidence to say Guilty beyond reasonable doubt, and because there is an equal possibility that it was Robin Bain who committed the crime.

He's not going to re-offend if he does get out. And his family is dead.

What concern is it of the (largely uninformed) public?

Need to add a "have no idea/fixed opinion/need to hear all the facts/ignore the spin" option I vote that way..........good poll though!

Sorry - these KB pols never seem to have the option I want.

Have to say - DON'T KNOW.

Its a real toss up.

Robin fit the bill best for motive. But the fingerprints in BLOOD were on the gun unless an ESR scientist lied. And it's most suspicious how Bain claims the blackout of memory at the crucial time.

I had a theory at the time - that Robin did it then tried to get David to shoot him. When David fainted instead - maybe after getting a rifle to the head, then Robin shot himself.

Alternately Robin shot the family then forced David to shoot him once he got home, and this is Davids motive for forgetting - or Dad made him promise to say nothing of what occurred, hence the wall of silence.

damn I should of put a don't know option, all my years at AC NEILSON have taught me nothing!

Have to say "don't know" as well. As written above, if I was on the jury (looks like a real chance at this stage, as I've just received a Jury Summons in the post...), I'd probably have to vote Not Guilty as well, due to the lack of damning evidence against him.

If he's guilty - he's a liar and the Privvy Council has potentially freed a killer.
If he's innocent - he's suffered more than anyone ever should. Not only has he lost 13 of potentially the best years of his life (jailed at 22, now he's 35), but he's lost his whole family and blamed for killing them too. If he is innocent, I'm surprised he didn't just off himself in jail.

Get everyone in the country to flip a gold coin.
If there's more heads than tails give David the coins.
If it's tails give the coins to Joe Karam.

Well done OAB, cheers. Have added my vote as don't know. Probably leaning more towards not guilty than guilty, but there is enough doubt either way for me to vote 'don't know.'

On the day of the killings we saw David Bain being carried out of the house in a wheelchair. I thought at the time, "He killed them", and I've heard nothing since that has changed my mind.

The whole "You are the only one who deserves to live" scenario is just too bizarre.

Not good, but if (big if) Dad did it then I'd call his fate a blessed one, he was very lucky not to now be 6 foot under with the rest and jail sure beats that option.
I don't think he would have had 13 good years living it up - he'd have been too traumatised by the loss of his entire family. Sad wherever he was. Might have needed institutional care of one kind or another. At least he now has a kinda dad substitute in Karam out of this - there is the silver lining.
My decision may depend on how he comes over - if he does not go for compo I will be more swayed to "innocent".

Could have been another (third) person, perhaps one of the house burners, did they (police) look far enough?

Strange people, surrounded by even stranger people, why the urgency in burning down the house? Secrets? Guilt? Fear? Shame? :spudwhat:

So many unanswered questions, probably not even asked! :nono: John.

I'm not aware of all the facts (granted, no-one really is, but I'm talking about the facts that are availlable), but my theory is - particularly after spending some time working in a prison during the 2001 prison strikes - everyone inside claims they're innocent. The only ones who are innocent, are the ones who work there... I'm with Toaster on this one...

I know a few cops that were on the case and they basically said... guity and and another said not enough eveidence...

well anyway its not up to us but the jury, we haven't heard all the eveidence (neither has the sitting juries... and this goes for many more cases as well... they obviously don't want to hear the whole truth)
