He shoulda just pulled over...... It's a legal requirement. Now he's dead and really it's his own fault. Sounds heartless but if he'd run wide and taken someone innocent out we'd all be condemning him for running.

"Diane Davis, who drove the front vehicle in a line of three or four vehicles passed by Abney, testified that she was 'literally scared to death.'"

Sure she was...

I'm kinda with the run and you take your chances thing but using deadly force to stop someone is wayyyyyy over the top. It wasn't even a high speed pursuit!

Kinda like saying it's ok to use deadly force to stop a shoplifter that runs off without paying.

Lets just shoot everyone before they all commit a crime. No people = no crime. Woohoo :niceone:

That is a legal precedent for future chases, fuck that!

No - running from police and endangering everyone elses lives you sign your own death warrant.

Well, it does seem excessive compared to the crime.
Lets face it, the woman a few weeks ago resp. for the death of a motor biker that got a 6 mnthy ban and $3000 in reps vs. an unsafe manoevre (although the article does not establish that the original going across the centre line was dangerous) vs. death.

I posted this in another forum, but its another example of disproportionate responses. In about '87 when I was living in Belgium a morroccan kid was pulled over on his moped for doing what they all did - wear his helmet over his arm rather than wear it. Stupid yes, but oas he then panicked and 'sped' (ie. 50cc) away from the cops they shot him 7 times, once through the head. Ironically I reckon the helmet would have saved him ... twice over. Anyway, it was a huge case over the police (who were, the court accepted, apparently not aiming at him directly and therefore accidently shot a moving target through the head).

Would prefer the police shoot and ram burglers and taggers caught in the act.

Pedestrians and potentially anyone else on the road on a bike or in a vehicle.

Id like to see you hit a car at 55mph, now that would be funny.

But they didn't run. The article states they kept to the speed limit.

My reading of the article is that they were killed for failing to stop after overtaking on double yellow lines. It's quite clear that it's not a high-speed pursuit or anything of that nature.

I've seen plenty of cages not pull over on the motorway but wait until the next exit where it's safer to pull over. Should we start ramming them off the road? :angry2:

and you agree with that?

its acceptable to have your life taken by a police officer for a traffic infringement?

Old argument.....this guy was not speeding, it was on a mountain road so little chance of pedestrians. He did not hit anything / anyone and he did not crash on his own like most runners.

If the cop got close enough to run him down he was close enough to snap the bikers plate number, give up the chase and visit his home.

If you run a biker off the road, it is obvious that serious injury / death may occur.

But that is the yanks for you......shoot first, ask questions.

Hmm lethal force...does that mean they can shoot him while hes riding away?

I dont really have any issue here, maybe with the first time forcing him into the ditch but not after him continuing to ride after that.

That's for sure. Had one of those myself years back. Heading up Waiwera hill (south side of Waiwera, passing lane) I passed a mufti... Slowed down a bit as I went across the bridge at Waiwera, looking for mate - spotted mufti coming down hill, lights flashing away. Thought about doing a runner - but had a chick on the back - it hadn't been a good weekend - so I thought "Naahhhh, I'll stop..." BIG friggin mistake. Never made again (at least not with a mufti - "What lights?").

I'd slowed down to about 60 k's, just near (past) the Wenderholm turnoff, when SCREEECCCHHHH!!!! behind me. FUCK! No second thoughts - hard left off the road into the drain! Bounced up the drain wrestling the bike (GSX1100) to a stop. Cop car stopped PAST me - big skid marks up the road.

Arsehole then had the nerve to rant at ME for "SLAMMING" on the brakes! And the Fckr still gave me a ticket (for like 120kph in 100). If it hadn't been for MY quick bailout reaction, me and the chick would have been well underneath his car - no door impact...

Sadly I was so shaken by it that I didn't think to get his badge number and file a complaint.

I'm glad you noticed that too, Bob.

"Diane Davis, who drove the front vehicle in a line of three or four vehicles passed by Abney, testified that she was 'literally scared to death.'"
...
"The fact that Abney was driving during the day... means only that Abney had the opportunity to scare more motorists to death," the court wrote.

You see, the biker had already killed one person and he was off to kill more! You can't just go around scaring innocent motorists to death and get away with it.

Notice Diane Davis was driving the front vehicle. What's the bet she was driving waaaay under the speed limit and hadn't looked in her mirror for several miles. Then that horrible big biker came out of nowhere and scared the poor thing to death!

Just as well the police officer executed Tiny before he could cause more harm.

RIP Tiny.

Thousands do every week and all we do is bury our heads in the sand and use immigration as the answer to the dwindling supply of productive individuals.

I just spent a week in Aus catching up with friends who have emmigrated. ALL of them are far happier over there. Sure there are some negatives but the positives outweigh them.

Eg: A women climbed over a railing and fell from a bridge recently. Hurt herself so tried to get compo. The court told her that it served her right for being a dumbarse, next please. Could you see that happening here???? There'd be ACC, OSH audits, 6ft high safety barriers etc etc etc.

So, yes thank you I am seriously considering pissing the fuck off as you so eloquently phrase it.

New Zealand is a shithole, full of small minded people who think that everything is the governments fault, and anything they don't like should just be banned, regulated, licenced or taxed.

But we don't fuck off, we stay and try and change things, for some reason we still think the place has potential.

"Deputy Coe first noticed Gerald Abney when the motorcycle driven by Abney crossed a double yellow line to pass a vehicle on a curve at an estimated ten
to fifteen miles per hour above the speed limit. Diane Davis, who
drove the front vehicle in a line of three or four vehicles passed by
Abney, testified that she was "literally scared to death"; "thought
[Abney] was going to hit [her]"; and "felt in danger."

"Deputy Coe turned on his blue flashing lights and siren — to no
avail. Abney did not stop. Instead, he led Coe on an eight mile chase
during the course of which he committed numerous dangerous traffic
violations. Abney, for example, illegally passed vehicles by crossing
double yellow lines on no less than five occasions — many of which
involved speed, sharp curves, or both. On one occasion, Abney ran
Thomas and Dorothy White off the road when he took a curve in the
wrong lane of traffic. Ms. White testified that her husband "jerked the
car and ran off the road. And I looked up, and there was a motorcycle
on our side of the road." While plaintiff argues that Deputy Coe did
not actually see Abney run the Whites off the road, the incident amply
confirms Coe’s assessment of the nature and risks to others posed by
Abney’s conduct.
Even the Green Farm Road collision between Abney’s motorcycle
and Deputy Coe’s patrol car did not stop Abney. He instead continued
to flee, running two stop signs. At the first, Abney not only refused
ABNEY v. COE 7
to stop but also illegally passed a vehicle that was stopped at the sign.
The driver of the vehicle, Linda Flecken, testified that, while she was
stopped "a motorcycle c[a]me flying around [her], cross[ed] the yellow
line, into the other lane of traffic, [and] pulled out." At the second
stop sign, other witnesses testified that Abney pulled "straight into"
traffic, causing several vehicles to slow down quickly. When Deputy
Rozier attempted to stop Abney by placing his vehicle and his person
directly in front of the motorcycle, Abney again refused to pull over.
Instead, Abney swerved around Deputy Rozier and sped away."

Add to this that he was on Speed.

So what was the police to do? Allow him to carry on and maybe kill someone innocent, or try to stop him???

Glad I did not have to make that decision...

No - running from police and endangering everyone elses lives you sign your own death warrant.

If passing cars at <88 km/hr,constitutes endangering everyone elses lives, then there are a lot of filterers in NZ who should be executed.

Crappiest logic ever

And the bint who testified that she was "literally scared to death";
I know forensics are getting pretty advanced, but have they really got to the point where the can have a deceased person testify in court?
Did her car run off the road after she died?
