Carrying on from my last thread

I have court next Tuesday, And I have been denied legalaid, so far the cheapest lawyer I have found is $500-600 for a hour and half defendant hearing.
I will be asking for the court to put this case off to another date as I was denied legal aid and want to hire my own lawyer.
Does anybody no a good lawyer ( preferably cheaper if there is such thing ) that can help me defend my case.? My work lawyer is no longer available to me. Cheers for any advice.

I think they mean you can afford a lawyer - they dont place any need for you to have a good one.
Depending on the risk of the fine / penalty you may want to simply defend yourself?

yeh I no but they will probabally win if I do that. Risk is- loose my licence 6months, bike impounded for 3months.
Really need to keep my licence for work ect ect and I generally do not want to loose it. And the fact that Im not guilty as well.

Sounds like you are between a rock and hard place ... my bro had to pay a coupla thousand years ago to defend his court case. He did get off with reduced penalties and still able to keep his licence.
He did say having squiddies to pay the lawyer was a handy thing indeed! :whistle:

Really need to keep my licence for work ect ect and I generally do not want to loose it. And the fact that Im not guilty as well.
If you do loose your licence you can apply for exemption for the period of your working hours so that you can drive/ride during that time - if your work requires it. If your work does not require it I don't think that you can get an exemption .. e.g. you just need to get to work .. .might not work.

If you do loose your licence you can apply for exemption for the period of your working hours so that you can drive/ride during that time - if your work requires it. If your work does not require it I don't think that you can get an exemption .. e.g. you just need to get to work .. .might not work.
Yes but applying for one again is more $$$ I have already lost out on enough by taking days off work and its like a bloody anoying fleebite that keeps itching. Imsure there used to people just weighing it up and thinking...........

What is your license worth to you?
I lost mine for the summer but it didn't make a lick of difference to me. I applied for a work license and got it, paid a lawyer etc and kept a bullshit log, it's all about the money, make no mistake.

Yeh I guess it will come down to that. Ill drag is out for a bit see if it difuses its self and comes to a end ( I no it wont ) but Ill drag it out another few months then defend my self, Get a few episodes of boston legal under my belt and I should be ok.

Only prob with draging it out if you do loose your licence it will be over summer you loose it not winter.

A few years back I got stopped with 4 mates for doin 155kph in a 100 zone coming out of the Lindis. The cop was a bit out of his depth with 5 pissed off bikers lookin hard at him, so he wrote us all tickets and said "I'll let a judge to sort you lot out". We then rode away into the distance(on the rear wheel)
We got a real good traffic specialist lawyer( bent as a pie-cart fork, we part paid him in illicit goods and cash) and he stalled the court hearing off for 6 months. He GUARANTEED us we would get off.
We had a strategy meeting with him just before the court case(in Oamaru with two old JP's who new shit about law) and he told us all to change our appearances, wear ordinary clothes, bring 3 mates extra along and all have crash helmets(not our own) in hand.
All 8 of us sat in the front row of the court and the lawyer proceeded to tie up the prosecuting sergeant and his witness, the cop that busted us, in legal jargon and points of law. It was hilarious, I almost laughed aloud in court!
He then reminded the cop about the identification of the defendants that was needed to be carried out (legal requirement in a court case).
The cop that had stopped us all 6 months previously got all our names etc mixed up BECAUSE HE HAD NOT DONE HIS HOMEWORK THE NIGHT BEFORE!!!
At that point our lawyer had a word to the JP's and low nd behold...case dismissed.
The lawyer sought reparation for our travel costs, time off work, lawyers fees etc, but the JP's declined it.
Upshot of it was....we kept our licenses, no record, and no fines to pay!
Result.
Who ever said honesty is the best policy???

I'm surprised you all managed to make it to court; don't you know speed kills? I know a piece of me died after clocking 170 in the old pushrod V8 on Saturday on the way to Mohikinui. Just after I backed off a cop in what looked like an old Hilux (yup, even the cops are hillbillies round there) went the other way!

I think it was the fact I live about 300m -400m from the waitakere head quaters and that there where 4 cop cars in my st. all full of cops I think & officers in total, they didn't seem to happy on wasting "valuable" police time on something so they did what they could any way.
Thing is they don't car how " BULLS***" affects me.

And speaking of work licence, do it your self if going for one - the Courts can help you and it saves you the lawyers fee for doing the same thing - and as peasea says, it's all money and the saving could easily be $1,000+, money well saved..

To be honest If I ran I know for a fact I would have got away cop car cant follow me down the alley near my place or cut across the hospital car park and across the feild to my place. I wouldnt even need to nail it to have got away from where I saw him.

That's the thing I want to fight it but unless I defend my self It will cost me lawyers fees $500+ 3 days now lost wages. thats gettin pretty up there for a 3month suspension plus maybe a fine of say $200 . where it costs $150 for a limited license.

The old guy waved him over had a word to him. I was left on my own. He came back and said " Sorry mate," but im going to have to arrest you for dangerous speed" I was like huh? just a second ago you where asking me about the mods on my bike. lol

Well in his summary of facts he was approaching speeds of over 100kmph so who was doing the dangerous speed lol, when he couldn't find me im guessing he drover around my neighborhood with his lights flashing. Because I no my "concerned" neighbors directed him to my place as he told me so..

Good call... I actuall like most cop's I have met and i thought this cop was a nice guy. But some things have to come into question. If you read the thread you should have picked up on these thing's aswell.?
I don't wasnt to ruin the police officers credibility. And I feel like he was "made" to do something about it, from the obvious' senior police officer who showed up.

Im going to put the detector back in the car. Evey time Ive been stopped I think it was because of it but I'd pulled out the power cord and turned if off, so they couldnt say jack shit and they knew it. Is the law changing so I cannot even carry one not working in the car??? If thats the case Im definitely going to be breaking the law - FUCK THAT SHIT!!! HURAAH! He got busted for 52 in a 50 area, no school anywhere in sight. Apparently he was told this was going to be the norm from now on. He didnt ague and went in and paid the fine straight away, but we all agreed that this now has gone too far with the pigs doing this shit. The oinker that did this must have a really small dick or uncle helens stuck up his arse...

The problem is that doing 52 in a 50, while technically illegal, is not beyond the speedometer's margin of error. You could be doing 47 as far as your speedo is concerned and still be done for 52. In Switzerland they actually deduct 5kph from the ticket before working out the alleged speed. This is an official thing (i.e. is printed on the speed camera notice) and not just the cop being nice.

That policy has been changed. There's now a 5kph tolerance around schools.
Last year I got a speed camera ticket for doing 55kph in a 50kph zone.
Fortunately the fine was very small - I think it was only $35 (but I can't remember for certain).

I've got plenty of experience on bikes and misbehaving but little with upsetting the Police in the process because I had a think about what, where and when before I put anything into action, be it alone or with others. We had a similar thing with cruise control in our Honda,used to set it when speedo was at 55km for town driving,partner was pinged at 56km in town,she said to the cop the c/c was on and set at 55,cop said is it calibrated?She was suitably pissed off and said what,he said certified calibration or some shit,she said yep when the car was new,cop had no humour at that answer,she said your going to ticket me so gave him shit.Managed to get it chucked out in court.

The fine for 2 km/h over is $30. If the ticket cost more than that, the driver is making it up.
The cost of the administration for processing a ticket has been worked out (by the people who process them) at $25.
So, revenue collecting. I guess Helen will be able to have a cup of coffee at this guys expense with the huge $5 the govt made from this ticket.
The extra $5 is just a huge way to say "IF YA DON'T WANT TICKETS DON'T DRIVE OVER THE SPEED LIMIT..............DAT'S WHY IT'S CALLED THE SPEED LIMIT"

Good to know there is some tolerance given,fair enough lower for heavy vehicles,they are stuck at 90km,and many are governed to max road speed of 100km anyway.

And what would you advise on my case with the police, I was not clocked at a speed and even if I was speeding where did dangerous speeding come from ( under dangerous driving according to prosecutor ) But shouldnt it be a basic speeding ticket? i wasnt 40kmph over or anything.

For example - currently the ticket for exceeding the speed limit by up to 10kph is in a lower grade than that for exceeding the speed limit by between 11 and 20kph. As I understand it, under the new law this distinction will be removed and the same ticket will apply from 1 to 25kph (from memory) over the speed limit. This will have the affect that the tickets for 1 to 10kph over will actually increase in monetary value, not decrease.
The apparent individual ticket price may be dropping but some pundits are predicting that the overall take will increase. You may even find that tolerances drop and quotas go up.
Something else that may come into play. With higher demerits there will be more disqualifications and more applications for work licences. This will also increase the overall fee intake.

Give out points, say 5 a year that your license is clean, make them tradable so they have a value i.e. give people a reward for their good behaviour.

"Key Performance Indicator" - 1 ticket per hour patrolled. Call it what you like, but if you're patrolling around doing bugger all and can't produce a single ticket in 1 hour, then the bosses think you're useless. Hard to argue, really...

You'd have to produce accurate figures of how many tickets get issued in this speed range, (and others) before your propaganda would have any meaning beyond pure speculation.
Why is his comment pure speculation, but yours is not?
You state that "fines are reducing". He states (correctly) that some are reducing, but others are increasing. That is not speculation it is reporting the government annoucncement. He does not have to produce any figures , he is simply reporting the government statement. Your statement is , at best, only partially correct, and thus misleading. If you mean that "all" fines are reducing, that is incorrect. If you mean that "the overall take from fines will decrease" , then you are the one purely speculating.
What CAN be accurately stated is that the government have announced that some speeding offences will attract a higher fine, some a lower one. But ALL offences will attract higher demerit points.

You could make more accurate speedometers but I don't think there'd be many people willing to pay the price.Performance Bikes magazine recently got an engineer in to look at bike dashboards in to see what the deal was. After testing them all, he concluded that the inaccuracy must be purposely built in, as they were simply to inaccurate to be able to be explained through things like production/component tolerances.

After testing them all, he concluded that the inaccuracy must be purposely built in, as they were simply to inaccurate to be able to be explained through things like production/component tolerances.
This begs the question as to why... I can't think of a single reason to deliberately add error to any measuring device. Curious...

The latest batch shows most reducing... only one increasing. That is for parking in disabled spots up from $60(?) to $150.
Not wearing motorbike helmets is reducing from $150 to $50 - for both rider and passenger... Assisting Darwin, I guess...

I presume that there are still some that are merging, like the 1-10kph and 21-20kph over disappearing and being replaced by a 1-25kph ticket? (effectively increasing the cost of 1-10kph over).
