Was going down avalon drive in hamilton when a car pulled out from a side road and hit me side on, they said that they didnt see me :( the bike is pretty much stuffed car not so bad and i got a sore ass from flying thru the air and landing on it.
neither me or them had insurance :( am yet to find out if they are willing to pay for damages or if im goin to have to take them to court over it

How is the bike?
The drunk taxi driver that hit me many years ago didnt have insurance I went to cort and ended up getting $10.00 a month. Even then It took allmost 6 months to get anything from him.... Worse of nothing happend to him as driving a taxi was his income so he got a worning me no bike.

Sorry to hear that man. Good luck with getting this sorted out. If you do end up getting another bike I would strongly recommend insurance. I wrote my bike off and totaled a car a few months back but insurance covered both me and them.
Keep us posted.

Hmmm you don't have your car license either? All they asked me was how long have you had your NZ driver license, any kind, and I said I've had my full car license for 4 years and that's all they wanted. Didn't ask for motorcycle specific lol.

Exactly what happened to me a wee while back...
I got t-boned, neither of us insured.
I'm still trying to get the money out of him..
Go to the police, most important advice. Then take him to court if he starts trying to buy time or whatever.
I feel for yah mate.. i'm in the exact same situation.

Compulsory Third Party Insurance is part of the Registration Fee (as it was in the 70's). It was carried by State Insurance as I recall.

call them up and say how many years you've had a car licence (ages) and how many accidents you've had in a car (none). state will change your insurance profile to say you're on your restricted MC licence for insurance purposes.

I rang state, under 25 is the age they do not under 21, your looking at 1500 dollar excess for a learner/restricted with 500 roughly premium. Not cheap. I have rung a lot of insurance companies believe me, I'm forking fuckloads out for comprehensive insurance.
What grinds my gears though is how 90% of motorcycle accidents will be rider at fault as a lot of the time no one else is involved i.e we hit oil and low side, slippery corner we low side, ice we low side, diesel ad you highside it, tire blowouts then crash etc. You can't judge a motorcycle with the same rules as you judge a car *cars don't fall over on as easily*. There should be different rules and stipulations where even if there wasn't another party, if evidence if given of an anomaly out of your control happened, then you are not at fault.
Cop out for the insurance company in my view. Especially with learners when they're like, that'll be 1500 bucks please....but your bike is worth only 3, and the remaining 1500 gets devalued cos they ring tim-bak-fucking-too to get a price so you end up with like 500 bucks in hand.

But thisn't even based on opinion, it's based on fact, and you're wrong.. Unless it's randomly changed to 25 over the past few months but I doubt that. Last time I checked, 21-24 year olds inclusive was an excess of $400. So that makes $800 excess.
I was paying $140 a year, with $1,100 excess due to my age, on a GN only valued at $2,200. Now on my CBR I valued it at 3 grand and I think it bumped up to $160 or something.
So, $160 premium, with either a $400, $800, or $1,100 excess sounds pretty damn good to me. As I'm not planning to cause a crash, I'm not planning to have to pay an excess so going with a low premium is ideal.
Maybe they just ask extra questions and charge more to people who have crashed before. Just as you'd expect them to.

actually it states in my cover that i am an MC Learner but that I have been granted COVER EQUIVALENT to an MC Restricted because of my driving experience. that is what it means when i say "restricted for purposes of insurance"
it's a very rude assumption to say people would ignorantly "fork out money" to defraud an insurance company when i was legitimately saying it was possible.
perhaps your driving record didn't impress state. in any case i don't know why they wouldn't give you cover. but definitely not worth getting your panties in a knot on a forum :mellow:

Oh yeah, hmmm from my experience quotes have differed from the online quote to the phone quote. State insured me on the basis of my years of driving, have you got a car license?

I have had more insurance woes than you, now if they said that to you, good for you. I was merely stating that people have to be carefulk how they state facts to an insurance company as they can turn around and screw you over.
I's good your getting a good deal, but you can't just rattle off your policy and expect new riders to get the same deal or ask for it.

Or you could always pay the same premium, for a policy with a lower excess, a higher bike value, and when you crash it with it being your own fault and write off the bike, the company pays up quickly and to the maximum value of the policy.
That was for a teenager with a 6L license they'd had for two days, a restricted car license which they didn't care about, and a sporty 250.

Haven't read all the way through this, but if you can't get bike insurance, at least get some health insurance that you can call on for your own health. Even with ACC, I just spend I dunno how many hundreds gettin my knee fixed up from a minor spill. Just slipped on paint, fell on knee cap and slid, at very low speeds. With a 200kg bike behind my knee... Doesn't take much...
Of course you can get free treatment on public health system. Just take a ticket and we'll call you when your number comes up...

So if i did hit the car i was clearly doing some bull shit james bond powerslide as i attempted to lay the bike down and limbo under the car....... yeah right
so off to court we go and things look grim..... 2 witness going against me and all i have is the damage to the bike to show what has happened Good luck to me :(

if you havnt got insurance yet and no one will insure you.. give NAC a ring. they are national auto club and will give you insurance on a leaner licence. i just got mine. It is 12 buks a week for full cover and road side assistance and they will pay out up to 2500 worth of riding apparel with no extra excess in the event for a crash.

Going over 100 km's/hr (not saying you were) DOES NOT MAKE THEM BLAMELESS. The cops may charge you for speeding if they can PROVE you were. Bouncing off a car at 100 kms/hr makes you go a fair distance... and hurts.

Witnesses can lie, evidence doesn't. Did you end up filing a police report?
Make sure you get all your facts straight to prove you case when you go to court. Like you and others have said, you've got the damage on the bike to show it was hit by the car, and you would be flying a lot further if you 'hit' the car at 100.

Avalon Drive is either 60k's or 80k's max. But if you were on a morning commute I'd be surprised if anyone is doing those speeds. You would have to be cutting it up the centre line passing everything in sight. Was that the case ? or were you in the flow of traffic ??
If you are heading to court, best get some advise from a lawyer... and there is a m/cycle lawyer in town that maybe can help. I'll PM you his name.
