I was out riding me bike home at 3am in the morning when I was suddenly knocked clean off me bike, I saw nothing, got up off the road my helmet was gone, too find that a drunk driver had knock a power poll down and had put power lines across the road. I never saw that coming lol, the low down from the Five-0, was that because this drunk nutter had his crash 5mins before I did, hes was at no fault and was not charged with anythink, what would you do and is there anythink that I can do, yes this went to court and I was told unless this coat hangering had killed me nothing would have been done.

any body have anything like this happen too them?

Yikes mate!!! Thats scary! Glad you're ok...ummmm...are you ok? I'd talk to the Police about it. Maybe some of the :Police: lads here can give you an idea.

lol yer I am all right,when I came off my helmet was ripped of me head with the strap still attached believe it or not, hit me head quite hard on the road, but me bike is was a right off in the middle of a rebuild now close to finish, wont bee riding at night in a hurry tho

How has this affected your insurance?

Sounds a little like the case I got into a discussion with Oscar about.

ie The drunk actually caused the accident but legally, he didn't (if you get my drift)

Thats some freaky shit bro, you could try talking to a lawyer or something dunno really, at least the lines were dead when you hit them. Like i said brop thats some freaky shit, haven't heard that one beofre, pleanty of farm fence stories and those cheese cutter median barriers but power lines, stuff that.

I'm glad to hear that you are allright. But I do not believe that he should be responsible for your bike... Just one of those things. Hope your insurance co is good to deal with.

Musn't of had your helmet done up tight enough
it was, the power lines court the strap and dragged it over my face, I guess thats the believe or not part the scapes up my neck and face proved it for a little while

Mate that's rough! nearly happened to me once on a 4wheeler in a farmers paddock. He had an electric fence wire strung a bit low in a gully. Managed to pull up enough to avoid decapitation, but I a got a decent crack from the power wire wrapped round the handle bars. :angry2:

glad you're ok(ish) could have been a lot worse. Small Claims?? I don't know nothing about how that works in this country, but it was the best way to go after someone in the UK

lol would have be decapitated as it was a 100km zone for some reason, being
3am in the morning I was only doing about 75-80kms when I hit the lines a local who was hiding in hes car when I hit did nothing because the lines were still live

Like one up the road a couple of years ago - he had a heart attack and hit a parked car....but seeing as he was unconsious at the time it was not consisered his fault,at least by the insurance company anyway.

wow, not sure if your lucky or not... bloody scary though

the same sort of thing happened to my uncle. Riding off road on the side of the Waimak river, came a cropper when some bastard put a line of #8 wire head height across a track. Luckily he was up on the pegs at the time and caught him in the chest - that bruising lasted a looong time.
apparently somone was protecting a plot...

The difficulty is that the drunk driver didn't "intentionally" place the lines across the road and he didn't intend for a M/C rider to nearly be decapitated. Also because of the time delay it is difficult to prove that the second crash happened as a direct result of the first. Having said that though I think it would be harsh to lay the balme squarely at the feet of the M/C rider, (its pretty hard to see lines across the road at night time).

I think that all the police could do here is include some of the details in the summary of facts and hope the judge takes it into account when sentencing.

I've never dealt with a situation like this so I'm guessing a little here but on the face of it thats how I would sum up the options.

BykeyCop might be the better chap to offer an opinion on that one.

I find it very unusual that the scene was not protected properly.. normally Fire and Police are there with lights ablaze to stop this very thing happening??
Even at three in the morning in northland, there are plenty of fire police, volley fireys and the police around.. particuly after 5 minutes or so.
I have NEVER been to an accident where there are wires down that was not OVERLY protected by those pesky fire police (who do a good job btw... just a pain in the ass sometimes).. and yes that is rural... RR would vouch for that and prolly spud and FF too.
Yup, fire police guys are awesome at controlling traffic and keeping a scene safe.

seriously I dont have anything against you and I respect your right to free speech but seriously, there is a line - and your always crossing it, cops are people to like you *shudder* or me, they make mistakes but not often. They do there best to keep us safe and we should respect them for that.

I do feel sorry however for getting hit by the low lying powerline, you can see where they are comming from I mean he didnt do it with intent with harming you or your bike, but still he shouldnt have being DUI, so I hope a judge sorts it out for you - I'm sure in anycase you will recover your losses.. so good luck and hope it goes well for you.
