View Full Version : Conditions of class 6L/R licence... loophole?

coop

On my licence (1,2,4,6R), it has conditions printed on the back, that being 'Correcting lenses must be used at all time while driving'. It doesn't say 'cannot operate motorcycle bigger than 250cc, cannot ride between the hours of blah blah'.

Would this stand up, say in court, if one of us on our 6L or R were to get done on a larger bike, or out of hours?

From memory, I could not remember signing for the conditions of my licence, only for saying the particulars on the application sheet were correct. I only recieved a leaflet saying what the conditions were after I sat and passed the test. Surely we would have a leg to stand on with this issue if we were to get caught?

Just something that crossed my mind while looking at my licence.

Cheers.

Hey I see what you mean. Mine has no conditions regarding the 100kph speed limit - so I guess its a free for all.

Oh dear oh dear

Does it say "You must obey road rules"? If not, perhaps you could cheerfully ignore all road rules, confident that your licence excludes you from those requirements also...

No it is not a loophole at all, legislation states if you hold a 6L or 6R etc you must obey the conditions of those classes.
If you get caught breaching the conditions of a licence then its a $400 fine and 25 demerits for each breach, so riding out of hours and on a bigger bike would be $800 and 50 demerits.
So no will not stand up in court, sorry to burst your bubble.

There's an idea! Let's have a BOOK for a license! :eek5:

If one was to list all the conditions/restrictions for the class of license, oh dear, that would be a big piece of plastic to fit into the wallet.

No, it would not stand up in court. :bash:

Shit yeah, you could probably fly a plane on that license too.

Exactly what Oscarnz said is what will happen if you dont obey the law for 6L as well as 6R Licence holder. If you want to keep your licence then Im sure you know what to do.

On my licence (1,2,4,6R), it has conditions printed on the back, that being 'Correcting lenses must be used at all time while driving'.
This is a condition that is not applicable to everyone that holds that particular class of licence. It is applicble to you (and me) and as such, is printed on your (and mine too) licence.

It doesn't say 'cannot operate motorcycle bigger than 250cc, cannot ride between the hours of blah blah'
These are conditions that apply to everyone that holds that particular class of licence. As such, there is no real need to specify these conditions on your own drivers licence, is there?.

I'm pretty sure they can only "award" one lot of demerits for multiple offences at a single time. They will "award" the higher of any multiple demerits incurred and the rest don't get recorded. AFAIK for the scenario you described above, it would be $800 and 25 points.

Yeah, I had realised that after typing the above, as well as the fact all conditions are laid out in the road code.

That sounds like a great idea. Do it. Can I call you Forrest GUMP if I stop ya? (Stoopid is as Stoopid does?) I need the quota.....

My licence doesn't say I have to stick to 100kmph, not ride into oncoming traffic on the wrong side of the motorway... the list is endless...

when you sign ur liscence your signing for all the condiyions, not just the ones listed, its your job to know them, i agree with all the restrictions placed on l & R platers exept the 70km limit, i just ignore that 1 completely on the highway, been pulled up 1ce and i told the cop id rather pay the fine than be a menace on the road and get tale gated at 70, he let me go so they can probably see the stupidity themselves

presented, second, and past. all dumb questions will now get you 25 demerits.

Sorry i know you were just testing us but come on. although in his defense writing that you need glasses to see on the back of a licence is pretty dumb also. would a g in a bottom cornor not point out to police that driver/rider must wear lenses?

I believe it would but i think it needs to be a bit more prominent than just a "g" in a corner somewhere. It is a serious issue if you cannot see well....

Yes, but even printing the condition itself on the back of the licence is a bit moot. I have that condition on mine, but I wear contacts nearly always when driving. I have been asked by police when stopped if I'm wearing contacts, to which I reply "Yes", but the only way to prove it for sure is to take 'em out and show 'em :) I guess if they suspected something, they'd be within their rights to ask you to do that *shrugs*

Agreed but at least it lets the officer know that this persons eyes are a bit on the dodgy side. At the very least you have made him wait while you take one out and show him/her!

Or you could just get some coloured contacts aswell "Yes officer, i always have fire in my eyes when i drive!"
