View Full Version : Questions for our KB coppers

Lias
23rd February 2005, 12:29
Given the multitude of police related/bashing threads lately, I thought it might be an idea to start a thread to actually ask our resident KB coppers some questions.

If anyone has any reasonable questions, throw up a post and hopefully our local law enforcement will respond. To my mind it will be an interesting insight into things. (well assuming they respond LOL)

It'd be cool if we could try and keep the thread to just actual questions/answers, rather than cop bashing and ranting about what happened to my mothers cousins aunties nephew etc :-)

I'll start off with a few questions I'm curious about.

As coppers, do you support the traffic-centric policies that are being forced on you?

Have you ever seen another cop do something, or act in a manner that cause you to think "geeze what an asshole, nor wonder the public doesnt like us"? If so did you do anything about it?

Do you obey the speedlimit yourselves while offduty and on your bikes *grin*

Cheers :-)

Either you're trolling, or you're lazy.

All of the resident coppers have answered these questions quite a few times over already, with duly attendant fizzing and counterargument about the positions they should or should not be taking. I don't imagine they want to do it over again on a semi-monthly basis.

If you really are interested, use the search function. And then ask about anything that hasn't been discussed yet.

My question.....
Why if you're a copper and bike rider and on KB, why would you admit it/disclose it? wouldn't it be more fun not to?

When I joined KB I had no intention of advertising the fact, however it only took a few of "those" threads before pretty anyone with half a brain knew what I did for a living.

After a while there was no point in pretending otherwise.

Yes.

And, just on the quiet, like, did you realise that Firefight is actually a cop?

I think you very shortly thereafter switched to that avatar picture of the patrol car with red and blues going... bit like the gay dude who finally admits it to everyone and then immediately starts wearing pink lycra everywhere.

As coppers, do you support the traffic-centric policies that are being forced on you?I think the focus is too much on the traffic side but I don't have a problem the current level of traffic enforcement. I would like to see more resources put into general policing and leave the traffic as it is.

And I don't think it is "forced" on us. I write on average about one ticket every two days and they aren't for 61kph. No one is coming down on me because I aint a ticket writing machine.

Have you ever seen another cop do something, or act in a manner that cause you to think "geeze what an asshole, nor wonder the public doesnt like us"? If so did you do anything about it?I can only think of one incident I have witnessed where I thought the cop went too far. I was only one of about five to witness it. There was a complaint, I was questioned, the guy got some counciling and as far as I'm aware he is still doing the job.

Do you obey the speedlimit yourselves while offduty and on your bikes *grin*In my car I pretty much never exceed 110kph. I use cruise control a lot! On my bike I like to ride twisty roads that are fun without going crazy speed wise. I like acceleration and power a lot more than i like outright speed, thats why I ride a V2. Sure, the bikes been given the occassional reaming out in the middle of nowhere, just to see what it can do, I'm only human. :niceone:

You'd already answered the main ones I had, but seeing as your being a good sort, heres a few other random questions off the top of my head.

Is it illegal to yell abuse at people? Like if I lean out a cage window and shake my fist while voicefully discussing someones probable ancestry can I be arrested?

Do you think self defence should have more legal standing in NZ?

Do you think our firearms laws are screwed up when its danged hard to get your license legally if you've ever had any trouble with the law (even relatively minor), but criminals always seem to have firearms anyways?

jrandom

Is it illegal to yell abuse at people? Like if I lean out a cage window and shake my fist while voicefully discussing someones probable ancestry can I be arrested?Offensive language or disorderly behaviour would be appropriate offences. Both are under the Summary Offences Act 1981, sections 3 & 4. If you want to look up legislation go here: http://www.legislation.co.nz

Do you think self defence should have more legal standing in NZ? Self defence already has a strong legal standing under the Crimes Act 1961. Look up section 48 at the same web site. Problems arise through people not understanding how far they can take things before they become unreasonable.

Do you think our firearms laws are screwed up when its danged hard to get your license legally if you've ever had any trouble with the law (even relatively minor), but criminals always seem to have firearms anyways?Haven't ever given this much thought but I would say I am happy that there is very rigid vetting of firearm licence applicants. Hardcore crims will always have firearms, even if guns were totally banned they would still find a way to aquire of produce their own. Thats a situation I would like to avoid, if guns were outlawed then only outlaws would possess them, not a good idea.

Hey spud any idea how far someone can go if they catch another person in the midst of damaging thier property or trying to steal something of thiers? Would that be in the same area you listed above or would it be somewhere else?
Defence of property is covered in sections 52, 53, 54, 55 & 56 of the Crimes Act. You will note that in prety much all of these sections the right to protect property is capped by the words, "does not strike or do bodily harm to the trespasser" or something similar.

Section 35 gives everbody the power to arrest peopel found committing certain crimes.

35.Arrest of persons found committing certain crimes—

Every one is justified in arresting without warrant—

(a)Any person whom he finds committing any offence against this Act that is punishable by death or for which the maximum punishment is not less than 3 years' imprisonment:

(b)Any person whom he finds by night committing any offence against this Act.

The power to use force to effect an arrest is covered in section 39. The key points are that the arrest must be justified and the force used reasonable in the circumstances. This is the area of law that is very subjective, (the element of reasonableness), and that which most civilians would get wrong in most cases.

It would be best just to call the police unless iminent threat to peoples well being existed.

39.Force used in executing process or in arrest—

Where any person is justified, or protected from criminal responsibility, in executing or assisting to execute any sentence, warrant, or process, or in making or assisting to make any arrest, that justification or protection shall extend and apply to the use by him of such force as may be necessary to overcome any force used in resisting such execution or arrest, unless the sentence, warrant, or process can be executed or the arrest made by reasonable means in a less violent manner:

Provided that, except in the case of a constable or a person called upon by a constable to assist him, this section shall not apply where the force used is intended or likely to cause death or grievous bodily harm.

I've had my nose broken 3 times - 1 football, 1 basketball and 1 lucky punch - none seemed minor at the time, and that pain paled when compared to the feeling of having the packing removed after surgery.

The radar units have a sticker on them that shows the next calibration date. They get checked once a year, I think, not too sure.

They don't carry a copy of the calibration documentation in the cars but if you were to defend a ticket then you would get that as part of disclosure.

how often are police radar meant to be checked/calibrated for efficientcy, and can i ask them for a copy when/if or after being pulled over?thanx :done:

Yes, they are calibrated once a year. They will have a sticker with the next calibration date on the unit that you can look at but the actual certificate is held elsewhere which, as Spud says, can be sent to you if you defend the ticket.

Can you pull over more than one bike saying that you Hawked them all speeding?
It's always bugged me that I didn't say 'well which one of us did you get?' when he showed us the readout.
Of course that would have made it me but I would have taken the hit for my mate :niceone:

they are actually speed checked at auckland airport. there is a ring road that runs parallel to the runway - 4km long, and it is set up with camera pads and calibrated equipment. quite often there is a red ss commodore doing 200k next to the fence, testing the gear. they are calibrated 12 monthly. they are checked for accuracy before each day of duty, with tuning forks calibrated to set speed. (i think 24 and 47k from memory - it's been a long time) the hawks were 80 and 45k, i know that much...

the lasers are checked (before duty) using a length measurement at a calibrated spot.

absolutley. the test is a visual one, which the cop has to say on oath that all were travelling at the same speed - that is, none of them were visibly faster or slower. i have written many tickets to 2 cars - one following the other closely. it's a simple matter of asking the front car how long the guy behind has been following (or up his ARSE) never to bikes though - the only pace it happens regularly enough is paeroa, and gangster rides, and then they have a sacrificial lamb out the back who will stop for you.

So I assume that the 'never bikes' policy is your own?
And if the bike in front simply says that he has just passed the other one or (if he doesn't want the ticket) that the one behind has just caught up then it's no dice on getting them both?
Gotta get my story straight ya see :D

Good news in latest changes with LTSA

Special vehicle lanes (bus lanes)

Only cyclists, motorcyclists and buses are
allowed to use bus lanes.

Finally we can ride in bus lanes. (Got a ticket a few months ago but after writing in to complain they let me off. I guess they knew the new rules were coming in. Whereas I actually thought the new rules WERE in place. Anyway now they are.

Cheers

I would like this to be confirmed by spud and the other police on here etc....that we can NOW use the Motorway bus lanes to ride our bikes on without getting a ticket. Cos in the past it was $150 fine. I would like some sort of verification that its true. Thanks in advance.

I couldn't care less if you ride in a bus lane.

So long as the bus doesn't squash you and then I have to clean up your guts off the road, then I'd be pretty pissed about it and post a ticket out to your estate.

But seriously, we don't have motorways or bus lanes where I live so I really have no idea about the legalities of it.

Ok this one has me in two minds. Why pull up the front car if the tailgater is obviously intimidating them?? Cos I HATE tailgaters unless they are bikes.

Other hand Pull the front one up cos they are (and/or have been) holding up the tailgater and frustrated them. Cos there are far too many inconsiderate drivers in this this country. Not such a big deal if speeding cos then they may not be holding up the back car unless they are braking at EVERY slight bend in the road and hoofing it on the straights.

Hmmmmmmmmmmmm. Is this the discretion thing?

I guess the real question is, Do you in a circumstance like this observe both drivers before pulling them up, or book em both........... everytime?

I think we could do with a little Texas mentality in this country but I'd draw the line at slugging somebody for singing to you.

Depends what they were singing - if it were a Garth Brooks song or anything about wives leaving, dogs dying, driving trucks or mining disasters then a broken nose would be UNDER-reacting. (PT Alert)

What you do, if you see someone stealing your bike, is loudly say "hmmm, the last person who tampered with my bike was also a father-raping faggot"

And then the broken nose you dish out will honestly be self-defence, plain and simple...

Can we be sure of this?
The problem is thus:
Bus lanes in the city are ARC controlled, the motorway are Transit NZ.
The council are OK about using them, ( a bylaw), but the motorway requires a change in legislation. Or something. :brick:
So if they have changed the motorway rules, is it posted somewhere, then I can laminate it, and stick on the the fuel tank...

I just rang the LTSA and the nice chappie on the end confirmed there are new road user rules coming into effect on the 27th (in 3 more days) whereby a M/C (and a cycle and a bus) can use bus lanes... nation wide!

I specifically asked if that meant only those covered by Transit, or those in cities also (i.e. Wellington... which previously had a no M/C in bus lanes rule). I was told it is ALL bus lanes.

Thats great, but I want to get it in writing first before I ride on the bus lanes on the motorway.... just in case some police officer decides to stop me and give me a ticket.... I want to have something on paper that I can carry on me at all times....
So who to ring to get this? Or will bike shops get copies of the new law as they did for when we were allowed to ride on city bus lanes?

Im not sure if this is a ltsa or a polica issue, but il post it anyway, Ive got on my desk 4 tyre valve caps that have a LED and light sensor in them and they light up when the wheels on a car/bike turn when its dark outside.
If you were pulled over while your bike had these on, would you be ticketed?
I assume this would be considered part of that law about car neons how your not allowed to let the light source be seen from outside the car?
Il post a pic later when its dark to illustrate what I mean.

Absolutely not! If all the seatbelts are used and you are jamming more passengers in unrestrained then you are overloading and allowing people to ride in an unsafe position. You would get no mercy from me if I found you driving around with unrestrained kids.

Heinous crime against fashion they may be, but I reckon that if they served to make a bike more visible, they'd be a good idea. (says the dork who rides wearing black helmet and armour and doesn't even own a retroreflective vest )

I read the old thread re neons and checked up LTSA's site - they've mentioned that under the new lighting regs, neons ("cosmetic lighting" in their terminology) will not be banned but will be regulated - light source not visible, angled downwards etc.
