    May 2006 SkidMark tells us that he got a speeding ticket and the cop wrote down his license number. That's over 3 years ago.

    So over 3 years on Learners.

    26 New section 121A inserted

    The following section is inserted after section 121:

    121A Enforcement officer may give directions or immobilise vehicle if driver breaches certain licence conditions

    (1) An enforcement officer may exercise all or any of the powers conferred by subsection (2) if the enforcement officer believes on reasonable grounds that a person who is for the time being in charge of a motor vehicle has, in relation to a prescribed class of motor vehicle, breached any condition of a class 1 or class 6 learner licence or a restricted licence held by that person.

    (2) The enforcement officer may—
    (a) forbid the person to drive a motor vehicle until that person is able to comply with the conditions of that person's learner licence or restricted licence:
    (b) direct the person to drive to a specified place (for example, the person's home):
    (c) take possession of all ignition or other keys of the vehicle, and for that purpose require the person to deliver up immediately all such keys:
    (d) take any steps that may be necessary to make the motor vehicle immobile or to move the motor vehicle to a place where it does not constitute a traffic hazard.

    (3) An enforcement officer may arrest without warrant a person who fails to comply with a power exercised under subsection (2).

    (4) The power to take possession under subsection (2)(c) or to immobilise or move under subsection (2)(d) continues until—
    (a) the driver is able to drive the vehicle without breaching the conditions of that driver's licence; or
    (b) another person is able to drive the vehicle without breaching—
    (i) that person's licence:
    (ii) any enactment.

    He CAN ticket you again if he sees you, but I don't think he can tell you what to do. In fact, unless you are under arrest, the cops are rather limited about what they can compel you to do.

    I take the "no" approach. If they fail my attitude test, I SHOW them (do not hand it to them) my license and then leave. They can sort the paperwork out, I am uninterested. There are plenty of cops who prepared to be fair and not take the fine-tooth-comb throw-the-book hold-you-up-for-twenty-minutes approach.

    If they have taken something of yours, an easy test is to demand they return it immediately. If they must - then they will, unless they are very brave or very stupid.

    Another thing you can do if they mention taking keys, is forbid them from touching your bike. "Do not touch my motorcyle" or "You are warned not to touch my motorcycle."

    A lot of the time, the police will ask if they can do something, or guesture towards it, and then take a lack of objection as a consent. You must make it politely, but firmly very clear to them that unless you are compelled by legislation you do not consent.

    "you cant because i am forbidding you to, if you ride it i will arrest you"

    etc etc

    hes on kb apparently...

    rides a v strom and has ridden with toto etc...

    if i see him on his roadbike ill show him how to really ride then shove him in a ditch...

    i could've done a runner i just couldn't be fucked. was still hungover as a mother fucker cus i was out on town til 5am

    you have just threatened the life of a cop on a public just after you said he is on KB - you must really want to be arrested and sent to jail

    and saying you were still hungover why the fuck ride then did you get breath tested cause no doubt you would have still been over the limit

    your a liability to yourself and to others on the road - its people like you that cause the gubbermint to hammer riders with the proposed ACC levies

    I hope there are cops reading this thread

    I'm sure there is more than enough evidence here to be able to cancel Marks licence and to arrest him on conspiracy and threatening to endanger other road users

    Whats the law about that for anyone in the know ?
