    Accident justice?

    I got struck by an old dude in a ute, his fault, wrote off my shiney R1.
    6 months later he went to court (last week), i went in to see what goes on.
    All i can say is: What a crock of shit!
    he got a $700 fine. $300 less than the guy who went in front of him for being stopped at a breath check road stop. The road stop guy didnt cause an accident, yet the guy that hit me, stuffed my bike and put me out of work and i cant return to work for maybe 3 months........Justice?

    How about if you have an accident and send someone to hospital, you have to resit your license or do a driving skills test?

    It's pointless expecting (or even hoping for) justice.

    I bought my first bike from a very nice lady who got taken out by some old biddy who failed to stop at a stop sign. She was fined $40, which even in the '70s was a feeble slap on the wrist, especially given that she had made a habit of doing this. The bike's owner spent weeks in traction in hospital, had a cast from her toes to her chest for weeks, then a full-length leg cast, then had calipers, then had to walk with sticks for a few months, and probably ended up with a permanent limp.
    No more biking for her, but the dear old duck in the car carried on driving.
    ... and that's what I think.

    Or summat.


    Or maybe not...

    HTFU. The guy who broke my back and neck, rooted my career and gave me a permanent head injury got a $600 fine and 1 month's disqualification.

    This sounds like Careless Use Causing Injury. Was he disqualified? No reparation payable to you for your injury? Its possible he had diddly squat and the judge couldn't do anything else.

    Careless driving causing injury is supposed to be a mandatory 6 months disqualification.

    yeah prime example on motorway patrol last night, there was some stupid woman who was rubber necking an accident and rear ended 1 car that then caused a 5 car pile up....she got a $200 fine ffs
    And same program some driver calls *555 on some driver apparently swerving in a lane like they are drunk....cops catches up and breath tests the driver....clear, then proceeds to ticket them $150 for failing to drive within their lane? now where is the evidence of this....the cop just went on the word of another motorist..
    The police/justice system/politicians in this country are all fucked...

    one extreme to another

    Im in the states living an interesting life shall we say.... and im looking at law enforcement.... and its one extreme to another here. if that kinda thing happened here in the states, well it would be a different story. people would be trying to sue each other senseless. So if new zealand ever goes down the road the states are in..... lets just say that true freedom comes at a price. Bloody sad and nice middle ground would be good.

    Agree..those fines are out of proportion to drink drive etc...

    Trouble is that NZ does not like to upset people...I have always said that a drunk driver who has an accident should not get full support...if we don't make people responsible for their actions then this will continue.

    Even with suing, the Insurer still pays so even then the responsibility is removed...unless drunk when an insurance policy excludes...

    Were you approached for a victim impact statement, and outline ALL of your losses?
