    As far as I'm concerned, if you crash it, you own it, but that should be established before said event. My bike insurance covers me for such an event, so if I crashed someone else's bike, I'd take possession and claim on my own insurance.

    It should be established before the test ride that the tester is keen to buy the bike pending the test ride and if he crashes it then he will immediately buy it. Why the hell should a seller see his saleable bike go out and a wreck come back and then wait for a few weeks for the bike to be make salealble again? What if the seller was about to buy another bike and needed to get his old one sold this week and could easily have done so prior to the crash?

    I like the idea of the full cash price being held by the seller while the buyer takes the bike for a ride, then if the bike doesn't come back in the same condition the seller keeps the money and the buyer fills out the change of ownership forms.
