    Angry Minor accident - advice needed

    Hi there,

    Parked in a loading zone today in New Market behind a honda HRV remuera tractor - FULL OF PEOPLE except the driver

    I first approached the vehicle from behind until my head was alongside the rear window - which had a passenger and then reversed so that my back wheel hit the curb and the front faced the road - there was about 6-8 feet between the SUV and me.

    I had a quick payment at Bond and Bond.....so I would be only 2 mins - empty store.

    Just as I was leaving - still on the bike - putting it in neutral and getting off. I saw the driver cross the road and we made eye contact - happy that she had seen me and anyway all the people in the car knew I was there anyway I took off.

    Barely turned my back and THUD bitch backed into my bike and dropped it and was about to take off....

    Ran stopped her - she says - Oh did you park behind me??

    Made her come out and wait until I pick my bike up and see that luckily only my right mirror glass has broken - nothing else.

    But I need to replace the glass as it's cracked.

    I ask her if she's gonna pay for it - she says it's my fault as that was not a designated motorcyle parking area-----

    Then she said that she did not know I was parked behind her and that she did not know there was a bike there -

    When I questioned her about seeing me when she was crossing the road - she said - Oh, I thought you were leaving.......

    Now this is a load of shit - the family must have known I was there....anyway asians/chinese so - Family immediately forget english - or don't speak it - so I cannot speak to them women insists that it is my fault as it is not a designated motorcycle parking......

    I began to get a bit pissed and said in a rather angry voice that you CAN park a motorcycle on the road - you don't need "special" motorcycle parking.....

    She then threatened me that she'll call the cops - so I say GOOD go ahead and call them they'll sort you out....this got her a bit taken back......then she goes ohh... don't have a phone - can you go and call them.....effing bitc_ .........

    The only damage done to her car was a scratch on the spare wheel cover these SUV type things carry.. two minutes and a bit of scratch remover and she'll be fine......

    Anyway I was getting late so just got her rego details and pushed off......

    I need a new mirror and I really don't want to pay for it.......I'm flat broke anyway and I'm pretty sure it's her fault for backing into me.

    How much would a mirror cost for a ZZR250?? Cos depending on that I'll bother with contacting my insurance company to go sort this out......

    Can you insurance people and others please advice

    For a car, as long as its not a funny shape or curved, it normally costs about $40ish dollars to get a new glass cut. Might pay to check a glass shop and see what they can do

    HEY COCK BAD LUCK , SAUVARINS IN KINGSLAND CAN PUT NEW MIRROR GLASS IN THE HOUSING FOR $20 OR YOU CAN GET AN AFTER MARKET ONE , BEWARE JUDGEING DISTANCE WITH NEW UNCURVED MIRROR.
    YOU SHOULD HAVE CALLED THE COPS IMMEDIATLY AND SAID SHE WAS TRYING TO LEAVE WITHOUT GIVING DETAILS

    Visited action wreckers as I needed something there - and he said the glass could be replaced but it would never reflect properly - I would be better off getting a new one.....

    Dude... if you were legally parked,(also a wof/reg/ dont need class 6) it's her problem, drivers have an obligation to check behind vehicles before reversing. It's in the road code(I dont have a class 6, but working on it!)
    Call your insurance company, give them her contact details so they can kick her arse. She might have a special AKL licience.

    I was a bit hesitant to call the cops as I don't have a wof or rego -- need a bloody part for me rear brakes that is taking forever to come from Japan - need that to get the wof and rego and I didn't have L-plates on. Wof and rego expired just under 2 weeks ago.

    as an ex claims handler I can safely say that you should lodge a claim with your insurer. you are definatly 100% not at fault.

    couple of pointers
    1) person reversing = always at fault (unless you like drive into the front of them or something crazy)
    2) even if your not 'meant' to be there. she still didnt see you = careless driving. IE. if you were doing something you perhaps should IE. moving down the left of a line of waiting traffic and someone opens a door on you. they are at fault (for a couple of reasons, also note that the road code says you may not open a door at anytime that it may cause injury to a person)
    3) if you were stationary and the other vehicle was moving, they are at fault. The idea is. what if it was a person or a child?

    If you need any help talking to your insurer, then im quite happy to help.

    If you DONT have insurance (god forbid) then lodge a complaint with the police.

    THAT REALLY IS CARELESS IF SHE HIT A BIKE SHE COULD EASILY HAVE BACKED INTO A KID .

    I'm inbetween jobs and just come off paying HP payments, wof and rego payments for my car......

    EDIT : Well I have a part time job - but the company is in financial difficulties - so I am looking for a new job - in the mean time the current company is searching high and low for some money to bring me up to date with the payments owed.

    I need a little rubber elbow that carries brake fluid from the rear brake reservoir to the brake master cylinder - since that bit is broken I cant transfer the rear brake fuild - so no back brakes.

    Dude you made a mistake not calling the plod.I'd suggest NOW you are basicly screwed. Shoulda, coulda .woulda is now besides the point-Reality is you hit her up for the money with no impartial witnesses -she will deny the whole thing or say you lied about the whole thing,
