Ok so I was just heading home through Auckland on the motorway today and was cruising south through Spagetti Junction at 85km/h or so when I got pulled over. Supposedly for today Spagetti junction is 60km/h it seemed.... Anyways... I must have met this bike cop on a bad day or something and he decided to bring all the guns out fining me $230 for going 27km/over the speed limit, $100 for not having L plates on my bike (Yeah that's my bad there, had my Learners for a year and a half now and sorta threw them out a year ago) then he also fines me $100 for exceeding the Learners open road speed limit of 70km//h... In the end adding a total of $430 for going 87 on the motorway...
Just wondering if there's anyone out there that's able to let me know if he is able to fine me the $100 for exceeding the Learner speed, as well as this $230 one?
If there's any past experiences or know of any of these situations? and is able to help me it would be a HUGE help! Cheers

Someone may correct this, but I believe that you can only be fined for either exceeding the posted speed limit, or exceeding the learner licence limit (invariably the higher fine of the two). But you can't be fined for both on the one offence?

Yeah i thought that aswell... seems a bit daft to charge 2 fines for the same thing.

Why not? Exceeding the posted speed limit and exceeding the coonditions of your license are two seperate offences, no?

True that they'll often organise a back-up charge though.

As for getting off... The speed was posted huh? Did you go check?

No I did not see any posted speeds. And in doing so I was sticking to a speed that's always been there. 80km/h... the same speed the other traffic that was flowing around me also. The cop did say there was a 60 sign 80 meters back or so from where he caught me but the fact is I didn't see it. So in saying that it's one of the biggest cases of bulsh fines I've seen, yes I WAS going faster than the posted speed i didn't see at the time. So yeah I understand that there will be no way in hell Ill be able to get fully off the fine, but what I'm mainly pissed off about is the fact that A. I am already getting charged for the speed I was travelling. B. I'm already getting charged for a Licence breach. And C for fuck sakes its the bloody motorway that's universally known for going 100 (80 around the Bridge and Spagetti Junction). Remember the fact that I still thought it was an 80km/h area, there is no way in hell I'm going to sit at 70km/h on an open road on a small 2 wheeled vehicle on NZ's busiest road.

Also a note if I am to do a restricted test us learners often get told to travel at the open road speed.

Seems to me he was just trying to meet his damned quota for the week rather than make the road safer....

No, you should only get 1 set of demerits.

Write in to the address at the top left of the ticket, and your best option would be to admit 1 speeding offence but ask to be warned on the other (probably best to chose breach of learners for this) as it goes towards double penalty.

Only take you an hour and 50 cents to post the letter so its worth a go.

So ... in the next two years .... a ticket for exceeding any posted speed liimit (or any traffic offence for that matter) and you are walking for three months ...

Suck it up on the last 2, you know you're meant to use L plates, and you know you have to stick to 70. You took a risk (which sounds like you've been doing for a while) and you got pinged. Just be thankful you haven't been done more often for it.

On the speeding ticket, go take a look and make sure there's a 60 sign, if there is you weren't paying attention - suck it up.

Alright then cheers. ill send in the letter and see what happens. And yeah guess it seems a case of sucking it up and taking the hit then, hope for the best that they may consider giving me a warning for one of the licence breaches, then spend that extra $100 getting my restricted sorted so this doesn't happen again!... :

as far as i know the 70 kph speed limit on learners licence is why they are not allowed on the motorway........would just be a moving hazard

No. In relation to the speeding, it's two laws but only one offence. Being fined (and demerited) for both is effectively a double jeopardy, or being punished twice for the same single action.

Riding without L-plate though is a separate action, and can (and should) be fined and demerited separately.

What puzzles me though, I though a breach of learner licence fine was $400...?
