    Clearway question

    Here's a new wrinkle on the passing on the left thread.

    Talking to a colleague yesterday who received a ticket for passing on the left, however it occurred in a "clearway" during the signposted clearway hours of operation.

    I would have thought that when it's a clearway it is actually a lane and he wasn't passing on the left at all.

    Anybody else had this happen to them ?

    I can think of a clearway in Dunedin where if I got ticketed for that I would challenge it because it clearly operates as two lanes during the particular marked hours. Hard to say without knowing how wide the clearway is and how it is marked. The clearway could be just the width of a parking bay to prevent parking to allow people to get past right turning traffic. Is it marked in lanes ? I'd just ask the council or NZTA if they look after it what their view is. If they say it should operate as two lanes then you could argue the case.

    Is the clearway marked as two lanes?

    Or as one lane which is really wide.

    If it's one lane, the ticket is kosher (a bit on the nose, but legal)

    If it's marked as a lane, it's permitted to pass on the left using it. If it's not marked as a lane it's not much use as a clearway since nobody can use it lawfully, thus defeating the entire purpose of having it.
    If it wasn't for a concise set of rules, we might have to resort to common sense!
