Kids bikes - classed as a moped?

So I take my son on his little JR50 down the road to the park to rip about on it. Its guttless as hell and we both wear a proper helmet, but I saw Police 10-7 and the fined a guy on a CRF50 for driving on the road to get a pie! LOL!!

So if I was to get caught/told off by the police, would I be able to say its classed as a moped? I have my motorbike license so would they make me get it a WOF and Rego?

moped don't need wofs, pretty sure they do need indicators lights etc though, if you go slowly on the footpath you may be less likely to run into issues with the cops

you need a plate and a rego to be a moped, and although they do not need a wof they do need to have lights etc,

I had a 125cc pit bike 4 stroke Pitmaster one and I rode it on the road heaps to a grass clearing around the corner got pulled up with my helmet on of course told him what i was up to and he was sweet. Basically depends if the cop is a good C**T or if hes having a bad day.
