    Bike problem.. any one had this before?

    Ok I will break it down.
    A person gets pulled up on a bike. they have been a little bit naughty, and as a result of the person not having a bike licence, the bike gets impounded.
    Now the person who was riding the bike is neither the registered owner, nor the actual owner, but they did have access to the keys.

    The question:
    Is it possible to get the bike out of impound early? Of course fees etc are going to have to be paid regardless, but the bike is required for use by the actual owner of it. Is there a way for the actual owner to get the bike back ASAP, without having to wait the whole 28 days?

    Of course, this is a purely hypothetical situation!!.

    Yes. If you are the owner and someone else got it impounded they will release it to you.

    The R/O can appeal, but the grounds are fairly strict. Basically the bike only gets released early if the R/O can prove that there was no way he could know the rider didn't have a lawful right to ride.

    Out of interest, you don't get impounded for not having a licence. It's only for driving while your licence is disqualified, suspended or revoked, or if you've never had a licence and you've been previously forbidden. Or for racing or a burnout. Never for just not having a bike licence.

    Go the Police station to appeal the impound. If they say no, you can appeal the decision to a district court judge.

    I made a phone call, and I stand corrected, The rider was currently disqualified. He thought his disqualification had run out a week ago, turns out he was wrong!!

    Well the onus is on the rider to go get his licence back when the disqualification ends.

    From close experience, when the time has elapsed, One has to apply for new licence (coz they come and collect your old one from you)...and drive around with a temporary licence until the plastic one arrives.

    The rider misled the owner...so should be putting this right...

    Why is this story different to the one you posted on trademe?, there you said rider B had bought the bike from rider A, but had not changed the papers yet, this story suggests that he had just borrowed he bike. Hey if you are caught doing the crime, do the time, 28 days is not that long.
