Way to go NZ legal system, you fail us once again!
My sympathies. I think we'd all be dirty in your position and I admire your restraint.
The police perspective is that this is a minor prosecution amongst a hundred other minor prosecutions. Not minor to you certainly, but measured against assaults, arson, robbery, manslaughter, rape etc this offence is ordinary. A traffic accident where the offender admits guilt straight up. Over and done with.
Still I'm surprised at the light fine.
You are entitled to complain and you should do so. Scummy will know how best to go about that although its not hard. Ultimately the Police Complaints Authority is who you are entitled to contact, just don't transfer your anger to the police.
The offender has been dealt with and I cannot see a re-sentencing - could be wrong but such things are rare as rare things.
I gave the district commissioner a "Please explain" letter as the haste of the sentencing caused at least two breaches of law. The police seem to admit that the "error" was caused by the police prosecutor. The senior officer that I have now been dealing with said (as I already knew) the the prosecutor would probably not remember the case as he deals with many everyday. My reply was that I understood that he would not remember my case up to this point, but I hoped that he would not forget it in future. I wanted him reminded that when he makes a mistake like that there is someone who gets affected.
But on a lighter note... the insurance company decided to get my bike fixed.... Somehow they concluded that the pile of bolts that carry my rego plate in the guide of a 1984 Yamaha XJ550 (with over 100,000Km on the clock) is worth $2000. I told them they were out of their tree but if they wanted to spend $960 repairing a $1000 bike that was there outlook. I think I have to take the bike in for repair starting tomorrow.![]()
If one wants to push their position, yes. It's a test of wills, not size. I have parked my bicycle in front of a moving bus several times because I was pissed and have never lost. The last thing the driver wants to explain is why they squashed a cyclist.
This is actually why I gave up bicycle commuting. I just got too agro.
