Thread: Rear-ended!

    Rear-ended!

    My first proper encounter with a car vs bike situation today. The gist of it is that I stopped to give way and the bloke behind me didn't
    No damage to myself, but the bike'll need a bit of fixing. Bent brake lever, bent clip on, fairing and mirror mount damage, exhaust cover scratched..
    Already started the insurance process, just got a few questions..

    -Recommendations for a decent shop that'll do the damage assessment and repair?
    -What are my chances of getting a 'courtesy' bike? My bikes my only form of transport and need it to get to work and back, so something to get around on is essential..
    -Am I alright to ride it in the meantime til I can get it to a shop?
    -What kind of rough time period should I expect for repairs and getting back on the road?

    It's all pretty terrible timing cos I've got semester break in a week and wanted to book my restricted in the time off.. Ah well, I'm still in one piece!

    Good you can still see the good in it; and in light of a few incidents involving bikes lately the fact that you've come out of it ok is not to be sneezed at.
    Hope all goes well with the insurance side of things; any chance you can borrow a bike to sit your R?

    Had a chat with the guy and the situations changed a wee bit, he's wanting to settle privately, since he doesn't have insurance and wants to keep as low as possible. Which is fair enough.
    He's asked me to go grab a couple of quotes from some shops for repairs and he'll pay out. Alot quicker than having to wade through insurance hassles too

    I feel a bit for him though, apparently he's had a quote for the damage to his bumper and bonnet.. at $2600

    Yeah, I had a situation like that once with the insurance. Guy wanted to avoid insurance involvement. But I reckon it's better protection if you report it to the company just in case this driver decides not to be cooperative anymore. It's just a phone call and no hassle. I choose the most reasonably priced repairer for my guy too. So it all worked out fine But not worth the risk not involving your insurance. It's what you pay them for!

    Yeah I've already got them involved, but I'll just cancel the claim. I trust the guy at this stage, he's a 66 year old professor at my uni, so if he decides not to co-operate it won't be favorable for him

    Your fully insured, he isnt, thats his choice/problem. Get the insurance to sort it and when your getting your quotes, ask about the chance of a loaner, keep getting quotes until you find 3 that have loaners (if any even have loaners that is) or maybe ask the insurance co. about it

    You will also need to report the accident to Police - as a matter of law. Whether they take action is a matter for them. The may just note it if is your wish, either way it has to be registered.

    Also take stock of any physical injuries no matter how slight. Get these registered at a doctors. if you get some form of ligament or muscle damage months later you may need to make an ACC claim.

    Not quite. That is not a matter of law - it is a matter of statute. You can choose to not consent to any of the "other courts" trying to enforce a rule on a matter of statute, but you are unable to do that on a matter of law.

    Be warned, if things go pear shaped once any repair work is done or money has changed hands your insurance co won't get involved. You'll be left chasing any shortfall privately.

    Speaking from personal experience here.

    "Experience" is currently in progress - watch this space. Qualifications are nil. Words written are opinion based on beliefs. The only part you can absolutely rely upon is that I dont have a hidden agenda - counts for a lot I think. Ie you get to keep both broken parts, no warranty etc.

    Anything you read on The Internet is just opinion anyway. It's up to the individual to read and search further on the topic and make their own "truth", unless you'd rather just subscribe to mine or someone elses - probably not?
