Lightbulb Passing stationary traffic - or not!

Mate of mine has just received a ticket in the post for passing stationary traffic at the Featherston St side of the intersection with Bunny St in Wgtn. lights were red and traffic was in both lanes. He crawled between lanes to front (up to lights). A car tried to block him but he got through. Later, he received a Police notice requesting information re rider/owner, stating that he had illegally passed on the left of traffic.

What's the ruling on this? Must admit, I don't know where i heard it from, but I thought bikes could do this as long as they were going no more that 10km/h faster than the traffic they were passing.

Mind you, just relooked at road code, and it is now clear that I cannot use the median hashed area between paraparaumu and Otaihanga to pass the stationary traffic on the way home (whoops).

Lane splitting in moving traffic is a grey area, one that has had plenty of discussion on here.
Moving past other vehicles whilst they are stopped (filtering) is not a grey area. They are considered to be 'parked' and you can pass to the right or left of them.
The road code covers both types as well. Go have a read.
Do you realise how many holes there could be if people would just take the time to take the dirt out of them?

Im a new rider and this does confuse me some too. I thought the only "legal" thing we are allowed to do is filter, passing stopped cars and only on the right, can we filter on the left too? and what if the traffic starts moving!! arrhhh :-)

Filter (stationary cars) in the same lane left or right. If you are on the left and they move - you are now in the wrong.
Lanesplit (moving cars) only within the same lane and on the right.
It's covered in the road code under the section on .overtaking

you haven't told us what offence he has been ticketed for. passing stationary traffic on the left or right is not an offence. passing moving traffic on the left (however slow it may be) is.

your rode code is only a guide. the legislation is what you need to read.

Might be the car that tried to block him put a complaint in.

As above Legal passing on left if vehcles stationary (Different case in point a car needing to cross yellows to overtake parked vehicles)

Might be worth defending stating of course you (sorry your mate) were ony passing stationary vehicles and calling their bluff - one word against another and goind to court with evidence might (or might not) be their thing

yet another case of muddled road rules dating from the 50's

Oh I belive it should be defended (but not my call) as it sets a precedent for that car. Your mate could always put up a wip round here for legal coin help.At the very least we would know who they were and catch them running red lights etc.

you could do them on this rule
    "Important
When you're following another vehicle and you don't intend to overtake them, you must leave enough space in front of your vehicle for vehicles behind to pass you."

It's just convenience envy. Like penis envy, but without the penis.

When it rains car drivers put their wipers on. Bike riders just have to suck it up. Do bikers get pissed off that car drivers have heaters and wipers? Not normally. It costs the bikers nothing. But maybe some do.

When traffic gets heavy, bikers filter. Most car drivers couldn't care less, as it costs them nothing. But some get a weed on that they can't filter too.

    It's just convenience envy.

    Spoken by a psychology major.

Fuck I was *taught* to filter. I was also expected to filter during my test if it was safe to do so.

I better go and find a big city to practice filtering in ... not enough traffic around here to do it ...

I am not so sure they are jealous, I think they dont really give a shit, and dont think at all, it is all about them and where they have to be RIGHT FUCKEN NOW!

I am a bit of a newbie to this Auckland traffic at peak times. I am lucky, I am not tangled up in enough traffic to be a real pain, but coming home I do get a bit.

I got a bit of traffic today, and put on my "new and improved" filtering hat, and pootled past traffic along the very edge of a flush median I had my indicator on and everything. I came up to the next roundabout and indicated to move back into the main flow of traffic. There was room, I checked. As I started into the roundabout (single laned one) this friggen car comes around with me, infact undertaking me almost as we went around

I did not carve her up in any way shape or form, I was considerate and just happened to be able to get in front of her in traffic. I am picking that is what ticked her off, that or the fact she was in a blazing hurry to be somewhere as evidenced by her driving behaviour afterwards

You should have seen her rip away from the lights at SH17/Oteha Valley, she was late for something

Never on the left! That is begging to get taken out, or get a puncture, or get a ticket. Far canal, passing stationary traffic on the right is dangerous enough, who needs the extra risk?

Read the notice carefully. Note that you have to go to REASONABLE LENGTHS to identify the rider. Write back and tell them you went through all your diaries, fuel dockets, logbooks, etc, etc, ad nauseum, but you can find no written evidence that is usable in a court of law, and you asked everyone (since its a shared vehicle) and that you believe this is more than a reasonable effort as required by law.

This is why you must always have your right indicator on when filtering, hehe.

In the end its bullshit, coz if the traffic was stationary they dont have a leg to stand on. I'd tell them to go fuck themselves and refuse to discuss, but I'm a cunt like that.
