Assume there was either a re-trial, or more to this than was on the video? Surely he didnt serve a year inside for speeding?
as I understand it there wasnt a retrial, but i thought it was interesting, and the guy did bring up some good arguments, regarding the duke or whatever he was getting a qaurter of the sentence for a similar TYPE of crime which brought about a far worse result.
Could also be said the biker referred to didnt actually have a 'result', he was just seen riding fast.
I can understand that sometimes a court may impose a miximum sentence not for the severity of a crime, but as an attempt to discourage others from doing the same thing, but one would have thought the could would consider the duke (or was he an earl?) and his case would hav made a far more compelling case for receiving a sentence to discourage others
Same old story tho, we don't get to hear about the circumstances like if it was his 20th time stopped for doing the same thing etc etc.

here is the write up from the local rag after he was sentenced. seems to me that there is just the element of speed really, apart from passing his mate on a deserted road.
Id have thought that if he had a history of riding badly, then that would have been mentioned, but no mention of it.

They were both doing the same speed.
They do mention an allegedly 'modified number plate' but there were no charges for that.
Other than that, he did pass the other guy, but they were both going like the clappers anyway, so yeah, it doesnt really add up does it?

A quick search and the MCN site gives a bit more info, it wasn't for speeding at all.
Sounds like he got done for dangerous driving with a pretty reckless overtake, and his piss poor attitude can't have helped with sentencing.Both admitted speeding on the 60mph road but were not charged with that. The police could not charge them with it because it happened more than six months ago.

This gives a bit more background. He was convicted for driving while disqualified in 1993 and he had a bad attitude. Also, he overtook his mate on the brow of a hill toward oncoming cars. It's still hard to see how he deserved 12 months in jail, or why his mate didn't.
