It was said before, people are always nice at the time, but they get advice from 'bush' lawyers and suddenly don't want to play ball anymore. Word of advice to everyone; if involved in a crash call police even if the party at fault says they are to blame and will pay out etc etc
or to get a WOF... so you can then take the vehicle off excemption. (i cant find my policy but i am sure the fine print raves on about illegal activities etc etc. I have always assumed illegal to be runnning around on a bike with no WOF and on hold. So i am a little bit interested in these comments from others stating that a WOF and Rego are not required to make a claim. Insurers are tight arsed bastards and while i concede no wof or rego isnt in the same league as rape or murder, it still fucking with the system.)
Call me old fashioned, but knowingly riding an unroadworthy, unregistered vehicle isn't particularly clever, indeed I suspect that it's probably illegal.
Then getting involved in something that wasn't "your fault" adds an interesting dimension to the above scenario. If you can win over the driver of the other vehicle and get them to reimburse you for the repair of your unwarranted, unroadworthy vehicle that you had no business riding on the Queen's highway, then very well done. Very well done indeed.
I suspect that this situation could have been a lot different if there had been material damage to the other vehicle or even a resultant injury or death. But then that may not have been your "fault" either and you could have walked away Scot free.

Fortunately we live in a society where it is NOT OK to run into other vehicles, even it they technically are not entitled to be on the road at the time. The police are free to ticket anyone they catch for using a vehicle on the road with no rego or WoF ($200 fine for each offence - $400 total) but the car driver is still responsible for driving into a stationary vehicle and damaging it.

Cut the long story short WOF doesnt matter, if it's absence didnt cause the accident. Same story with me. If anyone gona tell you that your story is a dead end and you r fucked - tell them to fuck off. I've dealt directly with insurance, and everything went smooth as. the main thing is to make sure that the person accepted liability. if they did - you gonna be fine.
What to do:
1. get your bike to repair shop (haldanes for me)
2. Get them to do an assessment.
3. Send the assessment sheet to insurance.
4. Their assessor will do an appraisal
5. negotiate the payout.
points to note:
Make sure they raise the claim straight away with no delays.
Persistence is the key here. Keep plugging the insurance company for actions.
Do not mention the WOF if u not being asked about it. If asked - tell em it's not relevant to the crash, as it didnt have an effect on the outcome.
Many more points, but dont have time to describe all of it.
I've done it all and cheque is in the mail. I've also been in constant contact with my lawyer, what made it much easier for me.
