    Your observations are correct. Classified ads on trademe by dealers (and I deal with this everyday, I'm in car sales and we advertise on trademe) are subject to normal conditions of sale. The sale process is handled entirely by the dealer, not through trademe. Auctions on the other hand are completely different. We sell cheap trade ins via auction process and they are not covered by the CGA etc. We don't have to put 'as is where is' on them at all. The process is still handled by us (ie paperwork).

    Regarding your second point, a dealer cannot contract out of the CGA by normal sale process. You can say 'as is where is' in the ad and on the sales agreement, but it wouldn't stand up in court etc. You would still be bound by the applicable acts.

    Here's what the selelr said in a reply email just received:
    "Hi, thanks for questions
    Bike runs well hasnt been used for the last 2 years due to injury but battery and very possibly oil and filter were replaced about 3 years ago. Rego is on hold due to not being able to ride bike- situation is not going to improve so hence selling bike. Every time bike has gone through WOF it has not had any problems - only one thing the plastic mounting that the right rear indicator is attached to is broken but is taped up and works fine. Speedo goes to 240kph. Very difficult for us to take to Auckland."

    That would be the one I'd go for then.

    It evens looks like it's got the original exhaust on it (although looks like someone may have painted the headers black.

    Should I ask for WOF and rego (though the latter not a must) to be done? Should a new battery and oil filter be put in? Should there be a worry of rust in the fuel tank?

    Its $1500...I think you are buying 'as is'...if the owner puts rego/warrant on, dont be offended if the price is increased to cover that extra cost.

    My 550 had had both bottom seems re-welded due to rust before I got it hense the repainted tank. It may be a common fault once they are older.
    I have evolved as a KB member.Now nothing I say should be taken seriously.

    Quite a lot of the cars for sale on TradeMe in the $4-8k range are being sold by "trade-in wholesalers" that seem to operate exclusively off TradeMe. They normally run auctions to avoid the CGA, which is fair enough. Do you have any idea whether they ever sell by a normal sales process if pushed?

    Understood.

    But a minimum of WOF would be nice just to know the bike won't need anything immediate, unless someone round that neghbourhood would be happy to have a look for me?

    You could offer/insist to pay for the WoF test. Pass or fail ... you know what condition it is in.

    A new battery/oil AND filter (fuel filter too) after purchase ... is cheap insurance ...

    Getting the fuel tank lined is a good idea. Regardles of rust being an issue now (or not).

    The govt. is looking at tightening up the laws relating to this very issue.
