Well done me ol mate, let me know a week or two in advance and we'll move a Thursday night for you. Great news on the plate BS! I'm with Big Dog on this one, roadside interpretations by inexperienced Police personnel who damn well should know better can't be allowed to go unchallenged.

On the way back from Salt Lake Cycles in Helensville on 14 June 2015 I was stopped, doing nothing wrong, and issued with an infringement notice for number plate not being mounted in prescribed manner. I was polite and friendly and pointed out that this particular issue had already gone to court and did not go in favour of the police. I opted to go to court to challenge the $150 fine and twenty demerit points that comes with it.

I was also told on two seperate occaisions by the Police Infringement Bureau that I could be stopped again and issued with another fine and more demerits if I continued to ride my bike on the road.

Case was heard today 13 October 2015 North Shore District Court infringement notice V2042934 Martin vs Police. I WON😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃😃 😃😃😃😃😃😃😃 woooooooooo hoooooooooooooooo

The main issues were 1. Definition of what upright means 2. Number plate not being visible as it is side mounted. The law used to try and pin this on me was Land Transport (Motor Vehicle Registration & Licensing) Regulations 2011, regulation 77 (1) (b) (i).

Many thanks to Jon61 for his support and coaching; invaluable stuff. Thanks eveyone else for your support, and in posting comments here😃

Refering to the court case should it happen to you

Anyone wanting to refer to the court case should you happen to be issued with an infringement notice should quote New Zealand Police v Martin CRi 2015 - 044 - 002638. Also quote a similar case for same infringement which did not go in police favour New Zealand Police V Pearson DC AK CRI-2010-004-021568 (both cases were heard ar North Shore District Court)
