Great advice SpeedMedic. It wasn't Philpot the company that drove in front of the rider, it was just one driver. As Bykey Cop has said, he will be charged, and it looks like the charge will be a serious one. The driver didn't intend to cause harm to anyone, it was just a careless moment of bad judgement, so lets just allow justice to proceed and not prejudge any court case.Originally Posted by SpeedMedic

I beg to differ...driver was in too much of a hurry to probably meet deadlines and timetables. The road is a busy one FFS. Look left then look right it aint that technical really.Originally Posted by Jantar
Did he intend to cause harm? Shit when he pulled out of a give way sign without reasonable care he sure as hell DID!
I wont predjudice any court case but knowing our system he will get slap on wrist and be out there and maybe actually suceed in killing a biker

Probably? That is the key word. WE don't know for sure. But whether he did have deadlines to meet or not, it was the driver in charge of the truck at the time, not the company. It was the driver's decision to pull out when he did. I would believe that the driver really did not see the motorcyclist, and THAT failure is the proof is his guilt to careless use.Originally Posted by MadDuck
Interesting, If your interpretation is correct and he DID intend to cause harm, then he also intended to fail to meet his deadlines. Sorry MD, but your two statements are contradictory.Originally Posted by MadDuck

The poor biker was too trusting...... on our roads you can't trust any of these damn cagers, especially in SUV's or Trucks....... if you do trust them then you do so at your own peril....
Hope he makes a full recovery and hopefully all the repairs will be paid for.
I remember someone's sig here that went "They miss seeing trucks and trains and you expect them to see you???"
I cant believe you are defending the actions of the driver. At the end of the day he ran over a damn biker. Yes ran him over
Put your fancy words aside for a minute and think about it. Maybe time you relocated to Texas!

It looks like we are at cross purposes here. I am certainly NOT defending the drivers actions. he was obviously careless, and that is a serious charge, but one that should be able to be prosecuted successfully. However trying to prove that he deliberately caused an accident may just be unprovable.Originally Posted by MadDuck

Yup I agree - that driver should be given a real lesson by the law..... the bastard DRIVES for a living you'd expect him to exhibit "a reasonable duty of care" I'd guess.... he was putting his cargo at risk and "working" in a manner that caused direct harm to another person....
Any news on the chaps injuries yet??
Balls and Arse.. poor guy, hope he gets well soon
Some truck drivers, are the best drivers on the road, there are some real cowboys out there tho, a lot on the motorway, who sit there in their 30 ton truck, 5 feet off your ass at 100Kmh, in their 30 ton weapon. lucky it wasn't one of those who "Just didnt see him"
on a side note
How does the rt100 go Bykey Cop ?

that - it scares the hell outa ya when they do it to you
when you are driving a car let alone riding a bike.
Do all those truckies not actually understand the law of physics and what happens if they had to break suddenly with 30 tonnes of weight
behind them? Scary stuff
Hi guys
I drive trucks in Auckland and i would say that i hope the rider gets better soon and it looks bad.
You also have to think about how long it takes to get a truck moveing and how fist the bike was going ( i am not defending the truck driver )![]()
There is bad drivers and riders and good.
I spend about 9 hours a day in a truck and peaple think that i now what they are going to do before they do it. When i get a good gap between me and the next car some one wall just jump in then i back off and the next one jumps in. Please think about it and be atleast 5m or more in front before moveing infront its not that hard.
Allways ride to your skill level and enjoy![]()

Thread hi-jack here: You would be amazed at the number of drunk drivers convicted in Court who are full-time truck drivers, FFS! their whole income depends on them driving for a living - and holding a drivers licence, BUT they drink-drive?Originally Posted by justsomeguy
