Queue me spending an hour trying work out how to get out of it.
Context - I was in an empty bus lane, no yellow line, stopping for 30 seconds to check directions on my phone (back wheel to curb, engine off, stand down - no mobile phone offence here!).
Overzealous parking warden jumps out of no-where, snaps photo of me on bike and says "fine in the post or do you want to wait for it?".
So, the offence according to the ticket:
Being a driver or person in charge of a vehicle did stop [sic] stand or park the vehicle in a lane restricted to a specified class or classes of vehicle without belonging to that class.
My loop-hole defence is simple. The bus lane in question is restricted to "Section 1.6 Land Transport (Road User) Rule 2004 states:
"bus lane means a lane reserved by a marking or sign installed
at the start of the lane and at each point at which the lane
resumes after an intersection for the use of—
(a) buses; and
(b) cycles and motorcycles (unless either or both are specifically
excluded by the sign)"
A motorbike is not "without belonging to that class".
Obviously they fucked up the legislation.
That said though, Auckland Transport don't seem to have noticed either, their website stating:
"Vehicles must not stop or park in any bus or transit lane unless they are permitted to use the lane or the vehicle is an emergency vehicle (ambulance, police car, fire engine etc.) that is being used in an emergency and is operating its beacons."
I noticed another fuck-up though.
A motorbike is:
"(a) means a motor vehicle running on 2 wheels, or not more
than 3 wheels when fitted with a sidecar; and
(b) includes a vehicle with motorcycle controls that is
approved as a motorcycle by the Director; but
(c) does not include a moped"
So mopeds aren't motobikes.
Motorbikes, cycles and buses can use bus lanes.
Therefore, mopeds technically can't even drive in bus lanes.
Sigh...... the land transport act. Riddled with errors.....
And just to add to the general incompetence, the "Lane Bus" road marking actually reads "Lane ɒﻞS".
Lastly, the comprehensive list on Auckland Transport's website has no mention of "Lower Albert Street" bus lane.
Lol - let's see if get off. If I do, I can park in every bus lane![]()
