There was a thread on here a while ago where one of our guys saw someone doing something dumb, didn't intervene (enough) and the guy ended up dead later that day.
On one hand it wasn't really his fault and the accident couldn't be blamed on him, but he felt like shit for quite a while for the sake of something he could have done.

This is a very interesting debate that you are holding about the motorway buslanes and one that is often mentioned on KB.
It makes very good reading!
It looks as though we might need to see someone challenge a ticket and then see what is determined through case law.
I think that there would be a fair chance that if you cited this information to a police officer they would think about not giving you the ticket. There certainly would be a good chance that it would be thrown out in court.
I think the main thing here is for us to respect our use of the bus lane...i.e. don't piss off the bus drivers and get out of their way.
As long as we are cruising in the lane and not going hard out it is unlikely an officer will be inclined to chase after us and stop us (unless they have instructions from above to crack down or they are having a bad day).
What do you reckon? I look forward to reading your thoughts...

First day ever riding to work, soon after the law came in, "Choice..use bus lanes", got pulled over, he just told me not too, "Bloody beurocrats" were his words, the cops hate the law as much as we do.
They are even running around excluding us for residential bus lanes too, I think it's just to keep the signmakers in business while giving the perception of trying to get traffic moving.

I have set my limits of max 50K and 20 above speed of traffic if there is heaps of room and give way to anything else.

Hey, that's awesome research and valuable information. What it does highlight is the discrepency between state law and local government law. As I mentioned in the thread "Motorway bus lanes" the info that I was given was that according to the 'law' motorcyclists were entitled to use bus lanes. That was directly from police national headquarters traffic enforcement. That is, of course in conflict with the information you have posted Divot. In Wellington there are no dedicated motorway bus lanes so the law has no application here. Confusing matters is that state law is contradictory to local government law, where both Auckland City ouncil and Wellington City Council allow bikers to use bus lanes (within the city) and this fact is signposted on the bus lanes (in wellington at least). Yes, these are two types of road we are talking about but the reality is that it is this ambiguity in the law that is causing confusion.Originally Posted by Divot
