    Hi thanks for that but my lawyer gave me that yesterday she also gave me this.
    2 a includes noise that exceeds a standard of noise prescribed by a national enviromental standard that is why i ask for that test to be done because i don't beleive my radio was above that standard.

    i guess the problem with boundaries is (and i'm presuming busapete lives in the apartments at gulf harbour here) in a corporate body situation, where is the boundary?

    auckland council has already prescribed that with the level nominated at western springs (85db??)

    a noise meter shouldn't be too hard to come by.

    section 43 1(b) RMA outlines the ability to prescribe standards, but i can't find the standard - it should be held by the council that took your stereo, as they will/should be working to that standard.

    Maybe problem could be solved by making less noise? Talk to your neighbors and find out what is annoying them and find a compromise?

    Thanks CaN. For those that are wondering we are not in a appartment we have a stand alone home.I have also ask council to help re noise level to give me a indacation of level but the problem is that one officer can come out and say that is fine and then the next will say no its not and whamo take your stereo so nreally they have been no help what so ever i have also found out that the guy next door works for northshore city council I also asked them to orginize a meeting with these people so that it could be sorted out and they said no not there job.OK TO UPDATE noise control officer has rang century21 head office told them what is going on and told them that they should try to sort it out as it's not a very good image for them i have now been sent home to think about it.

    Erm... Did they take a reading of the noise level before they took your stereo?

    Surely if they can't prove that the stereo was over the subscribed council db limit then they have no 'right' to take the stereo.. thus its theft. Ring the police.. haha =)

    I think your've been wronged by the council... and its pretty obvious that your neighbor is using there 'connections', have you talked with them to discuss the matter.. i.e. gone to them in person to discuss the matter?

    pardon? what right did the council have to call cent21? how is it 1. C21's problem, 2. any of the council's business.

    i'd be contacting the council GM and having a discussion IN PERSON, outlining my concern at the insinuation that the neighbour, through their council contacts is getting preferential treatment, and that someone has gone WAY outside their jurisdiction in calling century 21 and narking on you.

    they cant tell you to turn a stereo down if its in your car....

    think you can get a good set of 12inch subs from supercheap for around the $150 mark
