    Noise control took my stereo. Help wanted

    I will start with the beginning we moved hear about 8 months ago BIG MISTAKE we have had a couple of partys at christmas time partys where finished around 10.30 11.00 but my f--king neighbours rang noise control with no action from them because nothing wrong with noise levels.We also beleive these are the people resonsiable for cutting cables on the busa. Well tuesday come home from work and dog ranger has left me a note say they have had complaints about yours can you ring me. look out front and someone has throwen fijoes over the fence at dogs and bee bee pallets on path what would that say.Any way went to work yesterday and left radio on for dogs this seems to make them think some one is home f--k me they rang noise control i got a phone to go home and turn radio down might i add the stereo was not that loud and when i ask at what level the noise was at which was at legal advice that i ask this question was told it was at his opion that it was to loud so i moved spreakers to door and went outside and painted the fence and left itgoing for a while so they came and took stereo i ask again for them to do a the national standard noise test again they said they don't have to SUCKS.So what i would like to know if anyone out there knows how i would go about having this test done privately and who i would ring because these bastards are just victimizing us and i have a guts full

    maybe i do have a hearing problem that is why i asked them to do the national emviromental standard noise emission test

    it's pretty subjective really. there may be a local body guideline - your council should have that.

    RESOURCE MANAGEMENT ACT 1991
    PART 12 - DECLARATIONS, ENFORCEMENT, AND ANCILLARY POWERS
    Excessive noise
    326. Meaning of ``excessive noise''—

    (1)In this Act, the term ``excessive noise'' means any noise that is under human control and of such a nature as to unreasonably interfere with the peace, comfort, and convenience of any person (other than a person in or at the place from which the noise is being emitted), but does not include any noise emitted by any—

    (a)Aircraft being operated during, or immediately before or after, flight; or

    (b)Vehicle being driven on a road (within the meaning of section 2(1) of the [Land Transport Act 1998]); or

    [(c)Train, other than when being tested (when stationary), maintained, loaded, or unloaded.]

    [(2)Without limiting subsection (1), ``excessive noise''—

    (a)includes noise that exceeds a standard for noise prescribed by [[a national environmental standard]]; and

    (b)may include noise emitted by

    (i)a musical instrument; or

    (ii)an electrical appliance; or

    (iii)a machine, however powered; or

    (iv)a person or group of persons; or

    (v)an explosion or vibration.]

    where in gulf harbour are you cause my neighbours dont talk to me so they leave me alone only on saturday/sunday morning when I go for a ride i get this stare from the window when I start the bike up

    You received a noise complaint and then pointed the speakers out the door?
    That would be asking for trouble.
    Wouldn't it have been better to have noise control come out and give you an opinion on the noise level?
    In general, I get bloody sick of thumping stereos or band practice at our neighbours. It only lasts for an hour in early evening so I haven't complained, but it makes me feel like giving the bike an extended warm-up in the morning.

    (1)Every occupier of land (including any premises and any coastal marine area), and every person carrying out an activity in, on, or under a water body or . . . the coastal marine area, shall adopt the best practicable option to ensure that the emission of noise from that land or water does not exceed a reasonable level.

    (2)Subsection (1) does not limit the right of any local authority or consent authority to prescribe noise emission standards in plans made, or resource consents granted, for the purposes of any of sections 9, 12, 13, 14, [15, [[15A, and 15B]] ].

    When we had this type of shit on site it was quite expensive. However because we faced damages for failing to complete on time we were able to threaten the council with recovery of the damages if we were prevented from completing on time. That ususally worked a treat, they would then start to apply the law instead of their ear.

    North Shore City Council (at the time) had set out a test method. It required that they monitor the noise level at the boundary and that it should not exceed certain levels at certain times.

    We obtained a sound power meter from Tech Rentals and kept this on site. Their whole argument fell over when they found that they could not take measurements until 2:00 am as abmient background noise did not drop below their standard until then.

    As I say however it usually involved threat of damage and a letter from a lawyer.

    Wait 'til they go away for a w/e.....go and turn off their mains switch. Find the drain head adjacent to their toilet, lift the grate & stuff a whole newspaper waaay down the pipe, replace grate.
    Does the db level vary depending on where you live? Here it is 95db and noise control are not interested until 1hr at that level has passed. And I can set my lawnmower going on the fenceline at full noise and just keep topping up the fuel tank - that is not a problem. Go figure!
    Do you realise how many holes there could be if people would just take the time to take the dirt out of them?
