    So you don't even know if it's any good? WTF?? And if it doesn't work what will be the conclusion? If your first step in diagnosing a problem is to blame someone else,I don't think there is much hope for you lot....

    Less mature people than ourselves might consider hijacking his trademe auctions with comments about poor customer service and poor quality parts.

    If there's a genuine problem with his products then surely it's not Hi-Jacking rather it's a public service so no one else gets ripped off? Has anyone else dealt with this guy? Are there some good stories about this trader out there?

    Just interesting to see if a balanced view can be obtained or if it's all doom and gloom. I know some traders have in the past 'bullied' purchasers into making good feedback - could some of his good feedback be false?

    Is he a proper shop/mail order company or just some guy with a trademe website?

    You are entitled to a refund if it is a faulty new or used part (whether its a mechanical or electrical component)

    From what I have read I think the fault must lie with the seller
    Reasons

    1. The bike runs with the old system
    2. It was installed by a certified and approved mechanic (not a backyard mechanic, which makes warranty claims very difficult)
    3. It is hear say that he stated the bike was going when he took it out, why did he remove it from a perfectly good bike in the first place?

    I would pursue it to the bitter end, however sometimes its just not worth the waste of time, but then again he probably lives for that and it is probably about time someone took him to task.

    I would go back to him and say something like this
    Hi ****

    I am sorry for threatening you in my last email, as you can appreciate I was angry and annoyed at the part failure, and I felt we weren't going anywhere.
    However I have had time to think about it, and can I suggest the following to resolve things more amicably.
    (The Mechanics name) agrees that the (part) was faulty before it was installed, as with prior experiences with (mechanics name) he would fix or replace the unit if they felt it was caused by them.
    I would be happy to resolve this issue if you could send me another unit to try, we will test it prior to fitting it onto the bike so we both know it is in good working order and fit for its intended purpose.
    If it works as it was intended for, then I will return the faulty one to you ASAP.

    By writing something like that, it often appears that you are backing down and then they drop there hands off guard, sometimes they reply admitting some of the blame, or they send the new part and then you are in the better postition to negotiate. Its called getting the monkey off your back and onto theirs.
    Ensure you only use facts, dont make things up or misleading statements, because if it ends up in court you will be found out!

    Having taken several companies to the small claims court I would suggest you do the same. Make your claim plus the cost of the court fee about $40.00 from memory. You bought parts from a dealer to be fit for a particular purpose only to find they were unmerchantable quality according to you.
    You could let them know thats your intentions and quite often they will cave in because the time taken from business to mess about in court isn't worth it for them.
    Be totaly clear in court with no maybes,could be's ..not sure,can't remember etc be 100% clear and factual.
    If it does come down to not knowing exactly who's to blame ,then usually the court draws a line down the middle and you both get 50/50 buts thats better than nothing.
    So far I have never lost a case yet mainly because I knew full well I was correct in the first place.
