I just about hit some silly pedestrian today. She didn't look... First mistake. She also had big, ugly looking headphones for her iPod on... 2nd mistake.

Was she trying to make it as a Darwin award cantidate?

When I tooted at her for having to make an emergency stop, she gave me a nasty glare and made a signal that seemed to say I should have ridden around her. This really wasn't an option, as I had no idea whether she was going to keep sauntering across, or see me and stop halfway.

I can't decide whether this was a damned if you do / damned if you don't situation, or whether I made a mistake and could have dealt with the situation better. What does everyone think?

Sounds like it waz more the fault of the pedestrian than yerself matey. What were the circumstances of the crossing, it wasn't a pedestrian crossing was it?

did you ride really close and give her a fright? thats what I do, makes them more carefull for next time, also gives us a chance to get our own back, as you can be sure the ones that aren't looking when walking out, are the same ones who aren't looking when pulling out, and if she really looked like she'd been beaten with an ugly stick, hey whats another whack around the side of the head gonna hurt her?

What is it with pedestrians - they are always looking the wrong way when they step out, if they look at all. I do enjoy making them shit their pants with a good blast on the horn

The law on pedestrian crossing is very strict. You must be able to stop for a pedestrian on a crossing even if they dont look, and run out in front of you - it would still be your fault.

Though you havn't said if it was a crossing involved. Either way - you didnt hit her - so no harm done.
Just remember, that it doesnt matter whos right and wrong when youre lying in a hospital bed!

If it's a ped crossing and you hit them then you are in the wrong, but if they are jaywalking and you hit them then they are in the wrong cos jaywalking is a fineable offense!

WRONG WRONG WRONG a jaywalking retard walked on to the road a few years ago as my wife was turning left at a busy intersection.....result...him broken leg.....result...... her charged and convicted with careless driving 6 months loss of licence and $500 fine plus $900 for temporary licence doesnt matter how it happens motorist vrs pedestrian motorist always in wrong.

Hmmm sounds like your wife got a harsh deal, if in fact the ped was jaywalking!

I always thought you were not suppose to try and stop when confronted with a 'dog' or similar beastie. Unless its a horse of course of course..... hows that poem go? Sounds like this one would still have hurt you more than her. Had a dog attack me once that ended up with a boot in its face at 80 kph. I don't think it chased bikes after that and it actually lived not to bark about it later. Had very little time to react. Thank the lord for modern brakes though as they are sooooooo much better than brakes even 10 years ago.

As far as I am aware "jaywalking", in New Zealand, is NOT a legal term; specifically you won't find the word "jaywalking" in the Land Transport Act (irrespective of legal status) - it is only a 'common use' term, an American one at that, of which it is a bad habbit to emply. Our law is based on English law, where "the practice of crossing roads wherever convenient is both commonplace and legal", ergo there is such thing as "jaywalking".
In the USA, while definitions do vary from state to state, it does have legal definition; something along the lines of "violation of pedestrian traffic regulations and laws" (IIRC), i.e. it is not limited to crossing a road in an unsafe or dangerous manner.

Not that anyone cares about details anymore...
