    Good on you for stopping mate, and for thinking about the impact of it later. As others have mentioned, you would have been in the wrong regardless. Although I have heard of someone who stopped in time, got off the bike and smacked the pedestrian in the head then carried on!

    There was no pedestrian crossing for miles...

    I fully locked up the back trying to avoid hitting her.

    Just glad I didn't hit her, would no doubt have got me in shit. That Jaywalking law sounds like a big grey area.

    It shouldn't be, I think you'll find the cases where a driver was charged with careless (or whatever) when a pedestrian has been hit any significant distance from a controlled crossing or intersection are the exception not the rule. Pedestrians are still duty bound to make sure the way is clear before stepping out (even at pedestrian crossings). Not that you want to tempt fate...

    Interesting. Then the Wellington City Council and Police are breaking the law by having 'Jaywalkers' blitzs and issuing people $200 instant fines or whatever?? Which has happened at times. I thought the law stated that you were 'jaywalking' if you crossed the road within X metres of a pedestrian crossing?? I don't have a book so cant remember the details.

    Ergo my point on page one. If people didn't adopt non-legal terms, there wouldn't be any confusion. Crossing a road and failing to use a controlled crossing if you are within a certain distance of the crossing is illegal, it's just that here, "jaywalking" is not the correct term for it.

    I presume the term comes from the Jay bird? Buses give me the willies. In Wellington you have to be really really careful as they are plentiful, fast and quite quiet. I have seen so many people nearly wiped out because they are distracted, usually on the cellphone, whilst trying to cross Wellingtons very narrow CBD busy streets. They aren't anywhere near even half the width of say Queen Street in Auckland and I think a lot of people just take the risk. I know I do too but I always wait for buses as they can tend to be on top of you very quickly. I am not really sure that the 30 KPH limit is been strictly held to but I have noticed a drop in speed of the buses since that poor guy got hit some days ago. I haven't seen any form of enforcement either as promised but its not if I hang around all day to see it neither. I would be curious to know what Insurance Companies do in cases like this if the pedestrian claims the bike rider is at fault.

    I was wondering what that meant ! Thanks now I will be able to go back and actually see the point made.

    If Latin is dead... how come they aren't naming flowers 'Lord Derosso' ??

    for a start latin is cool! but what u shoulda done is hit her just hard enough to knock her down then gone to the police and put in a complaint against her for intentionally trying to get hit by you. It always seems that the police believe whoever gets to them first.

    A few years ago i had the misfortune to hit a pedestrian on my bike..........
    Little old man simply stepped out in front of me from between parked cars, not sure shore who got the biggest fright, me taking the evasive action attempting to avoid him, or him when my mirror clipped him. I stopped and issued a few choice words of advice regarding him taking more care to not try and knock me off my bike and went on my way...
    Thinking on it a bit later (as I had drawn blood on the bloke) i went and reported it to the local police.....the cop i spoke to just laughed and said served him right!

    i hit some kid on my bicycle coming home from school one day....thought hed be a smart ass and walk out in front of me...i didnt bother to change my course and ran straight into him.
    also had some kid pretend to run out in front of my motorbike once. jerk. if id been able to i would have stopped and belted him. kid was young, but old enough to know better.
