    Yep.....me too. Hope they find the wanker. I am sure if a person is involved the law is they have to stop and that 24 hours applies to non-injury IF both parties have stopped? I might be wrong.

    You got it right there elle. When personal injury is involved, even if they go and report it within the next 24 hours they are still in the sh#t. They are required to stop and check, pass details and only leave the scene if there is no one injured.

    Ok guys, sorry I havn't updated, I had been out and sleeping etc. At my mrs atm for her b-day party, well helping her get it set-up for tonight.

    Anyways,

    People had rung in, one person followed the car that hit me, got the rego, and a good description of the drivers clothing etc.

    The cops got this car, but the driver had swapped places with a passenger. But that doesn't matter since they knew he was driving. So they breath tested him, he failed. Asked him to come for a blood test, refused.

    So they arrested him, charged with:

    -Failing to stop and check for injury.
    -Dangerous driving.
    -Driving drunk.
    -Failing to comply with the cops.

    Apparently this guy has a bit of a history with the police etc.

    So went into the station to give a statement, got some pics taken of my bike etc.

    Now the bitch is getting her fixed. I donno what's gonna happen insurance wise etc?

    I have 3rd party, fire and thieft.

    I donno if he was insured or not. And even if he is, I donno if they will pay out or not since he was pissed.

    so do they pay me? then go after him for the money or it is a "tough shit mate" and I have to take him to court for money?

    If he has insurance, they should pay for your damages but they will get the money from him as he is not covered.
    It is likely that he will not have any insurance though if he has a history of DIC, so you might have to request a damages payment from the court or take a civil case to recover costs.
