    Cheers everyone for the input yep its going into colemans to get a full check, i was worried about my swing arm and bearings and the wheel, if thats fucked then its going to be big $$$$ and i would say he will have to go through insurance, i will update once i have got the quote done...

    * Right here you have a bargaining point. Its all good and well being the nice guy and settling for cash, but if he trys to delay or anything of the sort you can just tell him that you'll let the insurance company handle it. Im sure he wont want to fuck up his no claims bonus.
    if:
    a) He gives you the money, get the bike fixed, ring insurance company to say you wish to go no further with the claim. Confirm with the person you are speaking with that the claim has been cancelled. (This is important. I cancelled a claim for a cage incident once but it was sitting on their system as though they paid out! ie. they tried to put my premiums up).

    b) He trys to fuck you around, just continue on with your insurance claim, fill in your forms. The insurance company will sort it out.

    I mean if the guy fronts for all the repairs in cash all good -then ya can probably do a lot of the stuff yourself.
    or maybee you might decide on alternative solutions -like a better can at a small extra cost to yourself.

    He nailed you from behind so it is his fault (except in very few circumstances). Leave it up to your insurance company and let them deal with it. That is what you pay them for, and since it is his fault, they will nail his ass to the wall to get the dough. They are bigger, meaner and have deeper pockets than you do, so stand clear and let them earn their dollars. If he is insured, his company will pick up the tab.

    Thats what im thinking of doing at the mo.... getting prices worked out tomorrow and will see if the wheel is buckled or not soon.....
