    Thats what I mean, I know they can but the hours of care and love to the bike argument is going to fall over real fast in court a.

    Got to hand it to him though - he might not be smart, but he sure is angry!

    The other thing that occurs to me is that if the brakes came on without the use of the pedal, then there's a reasonable chance the brake light didn't come on either - and I've heard that used as an exception to the 'following vehicle is always at fault' rule.
