    My thoughts on things.
    1. I was speeding and I knew it (didn't quite think it was by that much) so I guess I deserve whatever I get. From a policing point of veiw I probably picked a shit place to open the throttle. In saying that from a safety point of veiw I could not think of a better time and place to be doing it.
    2. Can you negotiate at all with the police prosecutor on this stuff. As in I'll take my shafting quitely if you do me for 49km over instead of 52 which would mean no going to court and just a big fine and lots of demerits.
    3. I don't really have a leg to stand on I guess I could ask for the calibration certs and stuff and try that one on because I guess I've got nothing to lose execpt a few more costs, but would the judge look more favourably on me if I just bend over and take it without resisting.

    IMHO... (I'm an electronics engineer not a lawyer, do seek proper advice)

    In most things, the court is NOT obliged to make the penalty as tough as the police ask for.

    But, in this case, the law sets out the penalty, not the judge, or the prosecuter.

    If you have admitted to the speed claimed, you have had it. Your only chance is to defend it, and you can only put a bob on that if you denied the charge from the outset, or at least said "no comment"

    Cast doubt on the radar, the cops quals, other vehicles in the beam etc etc if you can.

    Even if you have "no chance", ask for "disclosure". Get the cops quals to use the radar. Get the calibration certificate, and the service history of the radar. (Maybe it has had a dodgy history..) Find out if the last ticket was the same speed... was it even you who earned the ticket ?

    It WILL cost you court fees if you lose, which in this case I think is really likely.

    But, you get to say your bit about a good road, no traffic, etc etc, you get to face your cop, and he will be getting a boot up from the arse from his boss - can't meet a quota in court, but wages bill the same, and best of all, you might win. Cop may leave, miss the appointment, turn up drunk. Radra might be dodgy.

    And all for $150 ! (At least thats what the old court costs were)

    DON'T HAND THEM YOUR LICENCE... MAKE THEM WORK FOR IT !

    And the cops and their bosses don't give a fat-rats arse about going to Court etc, well not down here anyway and I don't know of anywhere the bosses DO 'hate' it..

    Sure, the one thing that DOES irk me a little is going into Court on a day off when I had other plans (not often) but I soon get my grin back when I 'win' - and I get to take the day off later anyway.

    And the best part is I still get paid regardless whether I 'win' or 'lose'.

    BTW I'll post on KB the first time I DO 'lose'.

    My sympathies. Just defended a case in court recently - judge dismissed the case at a preliminary hearing so I won but still had to pay $3.8k in lawyers fees and lost a days income. My case was last on the list, so got to spend the day in court watching the proceedings. Never been to court before this.

    I don't think you'll get off going to court, but you may as well write a letter to the infringement bureau anyway - if nothing else it will get your thoughts and what happened on that night on paper as it may be months before your court appearance.

    The police prosecutor won't change the speed but will probably make a good recommendation to the court for you if you plead guilty, given your good driving record, the traffic and road conditions etc. From what I saw, the magistrate definitely favoured this when deciding fines.

    I believe this is the case too - it's 40km/h over a permanent posted limit for an automatic 28-day walk, vehicle impoundment and cameo at the courthouse.
    If it wasn't for a concise set of rules, we might have to resort to common sense!

    you would question the cops integritity if he dropped the kms by a couple.

    you will be ok though, clean record etc and you havnt been done for the dangerous just the 50kph over which im sure isnt as severe a punishment

    And there's no such thing as a cheap lawyer...

    Once when my license was in jeopardy (careless use) I hired a lawyer. I got a fine *and* a lawyer's bill, but I kept my licence.
    Everyone else done for careless use that day lost their license.

    I can't help feeling that this had rather less to do with my relative guilt, or lack thereof, than of the legal system looking after its own interests.
    (Feel free to interpret that how you will...)

    Whatever, I still think that if your license is important to you, you should seek legal assistance.
