    Wee bit of an update,

Big ups to all the folks who told me to get the cops involved ASAP. Will be happening at the scene if there ever is another..

In my attempt to take this guy to disputes tribunal I have a piece of paper that requires his name and home phone number.. (I have his address and and some other stuff, but whenever I rang his mobile he hung up on me) and I asked the police to go to his place for me. They said it'd take atleast a month.. then 5 days later (today) they gave me a call! Got all his details, got his side of the story (the bastard lied to the cops saying he was with his mum, only has a learners..) and the cops have now placed him with a fine for failing to give way!

Which is all great news because that means the disputes tribunal is already gonna be in my favour. I'm gonna give him a call and offer him what I paid for the bike ($3.5K) or he can make me take it to court and i'll be asking for full damages ($4.5), court fees, work missed, ACC bill, and the cost of the quote..

    All a matter of time.

Much respect to the police now, they helped me alot faster than I could of hoped for, and without them i'd be out of pocket and out of bike.. They even wished me well for getting a new one

    Great news.

The only thing I would say (from experience) is do not accept any kind of payment plan from him.

Let him borrow the money from someone and let them take the risk. He needs to pay you off in full. If it comes to court you may get stuck with a $10/week plan but that would be a last resort.

Remember at $10 a week it will take 8 and a bit years to get your money.

I agree. The other thing that worries me that now he has been fined is, wether the fine or your damages will take precedence if he pleads poverty.

Yeah i've been a bit worried about that myself.. I've been doign alot of research on the matter and apparently the court can repossess his car and sell it and give me the money, but it's registered to his parents! So that's a no go..

I'm trying to keep my hopes up and not think about all that rubbish until court time rolls aorund but it's a constantly looming thought.

Apparently if he does 'plead poverty' all I can do is get a court assessment done to see if he's telling the truth and if he actually can't pay it the information just sorta stops.. It's says you can talk to a solicitor to discuss your options.. so pretty much, nothing! But things have gone my way so far.. I've been doing alot of good deeds for Karma's sake and it's kicked me in the teeth a few times so I reckon i'm owed a wee bit of a good spin.

My wife had a similar thing happen recently, the cops did a little leg work for her that resulted in an instant result (non payer suddenly changed their mind ). Go the cops!

To be honest, i'm not really expecting this guy to pay much, but I should be able to sort out a few of the problems and get it running again pretty quickly.

@Saslex: About the injury thing.. I don't really want to report it to the police.. i mean I know I was 100% in the right and there's nothing that could go against me just.. not a fan of dealing with the police. I'll be heding to A&E tommorow and will mull it over then.

    Thanks for the support folks.
Don't be such a tool, you need to allways involve the Police, no matter what they say. I think you might have made things harder on yourself now, but hopefully Im wrong.
Those who insist on perfect safety, don't have the balls to live in the real world.
