    I'd like to know the answer to this one.
    Prolly need a bit more info on the accident though.
    Last I knew it was legal to lanesplit to the right, as in to the right of the vehicle, but still to the left of the line. As this is (was?) a legal move, you'd guess if you got knocked off doing it it would be the other vehicle at fault.
    BUT, when was the last time you saw a cage (or bike) left enough in their lane to let ya past to the right?

    Story last weekend, crash on the northern side of the Harbour Bridge, all cars at a stand still, bikes filtering at speed (cos the cars are stoped, its safer right?) and with emergancy services making there way to the scene from the city. Bloke telling me this was in the line of cars and likes bikes. But was appalled at the way in which the bikes were filtering. It was hot and some car owners were opening thier doors.
    It can be done with ease, but shouldn't be frowned upon if something goes wrong.

    They actually do this on some freeways in the US of A. Works really well and from what I heard the constabulary get very grumpy if cars invade the lane in any way whatever (especially when Mr CHIPS is occupying the lane..)
